RFP 2023-031 – DESIGN-BUILD SERVICES FOR PARK RESTROOMS - AMENDED
SPECIFICATIONS AND GENERAL PROPOSAL REQUIREMENTS FOR THE DESIGN
CONSTRUCTION OF PARK RESTROOMS IN THE CITY OF PALESTINE
Sealed Proposal Bids Due Date: Monday, December 18, 2023, at 1:00 p.m.
I. PURPOSE
The City of Palestine (City) is accepting proposals for the selection of a design-build firm/team
for the design construction of two restrooms located at Greens Park in the City of Palestine. The
City of Palestine invites qualified companies to submit proposals to provide complete architectural
and engineering design and construction cost estimates for the construction of new restrooms at
Greens Park.
Sealed proposals are due in the City Secretary’s Office on or before Monday, December 18, 2023,
at 1:00 p.m. Sealed proposals will be opened on Monday, December 18, 2023, at 1:30 p.m., in the
City Hall Conference Room. To be considered, the sealed proposal must address each of the
requests for information in the Summary of Qualifications section.
II. SERVICES REQUIRED
This is a request for proposal for the selection of a design-build firm/team for the design
construction of two restrooms located at Greens Park.
• Restroom specifications must be provided for floor/foundation, wall systems, interior
finishes, doors, roof, exterior finishes, ventilation, accessories and signage, plumbing,
electrical, and external utility connections.
• The design can be a prefabricated building or a cinder block constructed building to match
the restrooms in existing city-owned parks.
• The roof must be composed of asphalt shingles or metal roofing, with two ventilation ports
on the roof line.
• New fixtures must meet ADA requirements and other state codes as required. The
contractor must be able to install the pad site with proper plumbing, water, and electrical
components.
• The contractor will be responsible for connecting the building's utilities.
• The contractor must be registered with the City of Palestine and obtain all necessary
permits for this project.
• The contractor must provide a written timeline of construction and design of the restrooms.
III. MARKET CONDITIONS
The city is aware of the extreme market fluctuations occurring for these services, so we strive to
arrive at a bid format that satisfies state bid law and protects vendors/contractors against future
price increases. We will ask your company to establish a baseline price for the services and
products listed to protect the vendor/contractors and the city. Prices can be negotiated after bids
are opened based on increases and/or decreases in the same amount as the market changes.
However, the winning vendor/contractor(s) will be asked to provide documentation proving a
change in price has occurred. If prices decrease over the term of this agreement, the winning
vendor/contractor(s) will be expected to pass along these decreases in pricing. The city will assume
that submitting a bid under this format allows your company to agree to this market protection. If
you have a different method of price protection, please include your information in your response.
IV. GENERAL INFORMATION
The City of Palestine is a home rule city located in Anderson County with a population of
approximately 18,544 per the 2020 U.S. Census estimate. The city operates under a Council-
Manager form of government with a mayor, six (6) council members, and a city manager. The
council members are elected from single member districts, with the mayor elected as large. The
city manager is the chief executive officer of the city. It is the city manager’s duty to execute and
implement policies as established by the City Council.
V. SUMMARY OF QUALIFICATIONS
Each Statement of Qualifications (SOQ) must address, but does not need to be limited to, the
following information:
Qualifications of Experience
1. The history of the company and your history, if any, in providing services to the City of
Palestine.
2. List the name and all addresses of the location(s) of your company. Which company
location will provide architectural and engineering design and construction cost estimates
for the construction of new restrooms at Greens Park?
3. The number of restroom designs and municipalities the company has worked with in Texas
in the past five years similar to the scope and size of this proposal and a list of these Texas
cities of similar size and scope with contact information for reference purposes.
4. Photos, videos, or links to videos of restrooms that the company has completed during the
last five years in Texas of similar size and scope.
VI. SUBMISSION OF RESPONSE
Proposals must be sealed and may be mailed or hand delivered. Sealed Proposals for RFP 2023-
031 – DESIGN-BUILD SERVICES FOR PARK RESTROOMS are due on Monday,
December 18, 2023, at 1:00 p.m. in the City Secretary’s Office.
Please include the following on the sealed bid envelope:
“RFP 2023-031 - DESIGN-BUILD SERVICES FOR PARK RESTROOMS – TO BE
OPENED: 12-18-23 AT 1:30 P.M.”

Proposal packets are required to include three (3) copies.
The vendor/contractor(s) will provide a certificate of liability insurance with the bid proposal to
remain on file with the City.
Your proposal shall be governed by the following schedule:
Tuesday, November 28, 2023, at 1:00 p.m., Central Standard Time (CST)
1700 Block of Queen Street, Palestine, TX, a mandatory site evaluation of the proposed location
of the new build is required before any company submits a proposal.
Monday, December 18, 2023, at 1:00 p.m., Central Standard Time (CST)
Sealed bid proposals are due in the City Secretary’s Office. The date and time received shall be
noted on the envelope or box and initialed. Proposals cannot be altered or amended after the
submission deadline. Any interlineations, alterations, or erasures made before bid opening must be
initialed by the signor of the proposal, guaranteeing authenticity. Bids Proposals received after the
published deadline shall remain unopened and be returned to the vendor/contractor(s).
Monday, December 18, 2023, at 1:30 p.m., Central Standard Time (CST)
Sealed bids will be opened and publicly read in the City Hall Conference Room at 504 N. Queen
Street, Palestine, Texas. Bids that are received, which are unmarked, shall be opened for
identification purposes only and resealed. The envelope or box shall be marked accordingly.
VII. EVALUATION PROCESS
After proposals are opened and publicly read, the proposals will be tabulated for comparison based
on the bid prices and quantities (lowest responsible vendor/contractor) or by the best value. Until
the final award of the contract, the City of Palestine reserves the right to reject any or all bids,
waive technicalities, and re-advertise for new bids. The City reserves the right to request additional
information concerning any proposals for clarification and waive any irregularities and
informalities in the submittal and evaluation process. This RFP does not obligate the city to pay
any cost incurred by respondents in the preparation of the proposals. Furthermore, this RFP does
not obligate the city to accept or contract for any implied services.
The Parks and Recreation Director and Assistant Director shall be responsible for preparing a
tabulation sheet for all bids received that will be made available to the public upon request. The
tabulation sheets will be forwarded to the city manager and City Council to make a final decision
on an award.
VIII. BID AWARD AND PRICING
The bids shall remain on file, open for inspection, for at least forty-eight (48) hours before the
contract may be awarded. After your response to this RFP is submitted, the city will present to the
City Council the final price, which may be awarded on Monday, January 8, 2024. Before City
Council approval, if any market changes occur, the responding vendor/contractor must notify the
Finance Department immediately. Once this Council approval occurs, pricing will be subject to
the Market Conditions terms listed previously for the price increases and decreases. After the bid
is awarded and the vendor/contractor is awarded a contract and wishes to approve adjusted pricing
to the agreement due to changes in the market, they must do so through certified mail or via E-
mail to the Parks and Recreation Department Director at psmith@palestine-tx.org. Documentation
verifying the reason for the price increase must be sent as part of the request. Upon review of
adjusted proposals, the City of Palestine may elect to dissolve the existing contract upon the
expiration date or accept the price adjustment(s).

Notice
Any notice provided by this RFP or required by law is to be given by the City of Palestine. Any
interpretations, corrections, or changes to this Request of Proposals will be made by addenda. The
sole issuing authority of addenda shall be the City of Palestine City Secretary.
