Sealed bids will be received at the office of the City Clerk in the City Building, 400 East Military Avenue, Fremont, Nebraska, until 2:00 p.m., September 15, 2025, and be publicly opened and read in the Council Chambers at that time for all tools, labor and materials necessary to complete the work required for LUTHER ROAD SOUTH as per the Plans and Specifications prepared by the Engineering Department and on file with the City Clerk.
ESTIMATE OF QUANTITIES
The work is generally described as extending the concrete pavement and storm sewer system on Luther Road to the south end of Morningside Pointe Second Edition. The work includes construction of one (1) storm sewer manhole, two (2) curb inlets, 700 l.f. of storm sewer, 3800 s.y of 8” PCC pavement, 1275 l.f. of ditch excavation, and implementing erosion control.

Each bid shall be accompanied by a Bid Bond, Cashier’s Check or Certified Check, the amount of which is not less than Five Percent (5%) of the bid price of all work bid, and which shall guarantee good faith on the part of the bidder; and the entering into contract within thirty (30) days after awarding of the bid. Bids shall be considered valid for sixty (60) days after the date of the bid opening.
The bid shall be sealed and addressed to the City Clerk, Fremont, Nebraska, and labeled on the outside “LUTHER ROAD SOUTH.”
All construction should be done by a qualified or licensed contractor in the appropriate trade. Any bids received from contractors who are not qualified will be returned unopened.
The contractor will be required to furnish a Performance, Payment, and Maintenance Bonds in a sum equal to One Hundred Percent (100%) of the contract price for a period of one year past the completion of the project.
Any bid received which is not accompanied by a Bid Security will not be considered. The Bid Security of the successful bidder will be returned when the contracts have been signed, filed with and approved by the City. The Bid Security of the unsuccessful bidders will be returned when their bids are rejected. The City of Fremont hereby reserves the right to accept that bid which in its judgment will produce the best job of workmanship and material, whether or not it is the lowest bid; and reserves the right to reject any or all bids and to waive any or all informalities of any bid.
The successful bidder will be required to submit an acceptable Affirmative Action Statement and Program to the office of the Mayor within ten (10) days after the bid has been awarded by the Fremont City Council. Failure to submit an acceptable Affirmative Action Statement and Program within the time allotted shall result in the forfeiture of the bidder’s bond.
Before the Final Payment may be made on the Final Three Percent (3%) of the Contract, the contractor shall furnish a written clearance from the Commissioner of Labor of the State of Nebraska, certifying that all payments then due of contributions or interest which may have arisen under the contract have been made by the contractor or his subcontractors to the Unemployment Compensation Fund.
All work shall conform to the City of Fremont’s Standard Specifications for Public Works Construction, latest edition.
The contractor shall commence work soon as practical after execution of the contract. Once the work is started, the contractor shall remain onsite until all work is completed. ALL WORK shall be substantially completed BY December 15, 2025, with final grading and seeding to be completed by April 30, 2026. After April 30, 2026, liquidated damages will be assessed at Five Hundred Dollars ($500.00) per calendar day.
