COMBINED SYNOPSIS/SOLICITATION



This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 and FAR Subpart 13.5 procedures, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.



(A) The solicitation number is 70Z08423QELIZ0002 and is issued as a Request for Quotation (RFQ).



(B) The solicitation document and incorporated provisions and clauses are those in effect in accordance with the FAR. Service Contract Labor Standards Wage Determination Number 2015-4405, Revision 22, dated 12/27/2022 is applicable and is attached.



(C) This acquisition is issued as total small business set-aside. The associated NAICS code is 238220 and the small business size standard is $19.0 million.



(D) List CLINS, item descriptions, quantities, and units of measure: Please see the attached RFQ for the Schedule of Services.



(E) Description/Statement of Work/Specification: Please see the attached updated Performance Work Statement (PWS).



(F) Date(s) and place(s) of delivery and acceptance: This service is for a base year of 01 July 2023 through 30 June 2024 and contains four one-year options for an ultimate completed services date of 30 June 2028, if exercised by the Contracting Officer. The place of performance for this service is USCG Base Elizabeth City, 1664 Weeksville Rd, Elizabeth City, NC 27909



(G) FAR 52.212-1, Instructions to Offerors—Commercial Products and Commercial Services (NOV 2021), applies to this acquisition. Please see the attached RFQ terms and conditions for the submission requirements under Addendum to FAR 52.212-1, Instructions to Offerors.



(H) Evaluation: For the evaluation criteria, please see the attached RFQ for FAR 52.212-2, Evaluation – Commercial Products and Commercial Services (NOV 2021).



(I) Offerors are required to include a completed copy of FAR Provision 52.212-3, Offeror Representations and Certifications— Commercial Products and Commercial Services, with its Alternate I, with their offer. Offerors may complete this online at SAM: www.sam.gov. An offeror must state in their offer if they completed FAR 52.212-3 with Alternate I online and that is it up-to-date and valid.



(J) FAR Clause 52.212-4, Contract Terms and Conditions—Commercial Products and Commercial Services (NOV 2021) applies to this acquisition. Please see the attached RFQ terms and conditions.



(K) FAR Clause 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders— Commercial Products and Commercial Services (OCT 2021) applies to this acquisition. Please see the attached RFQ terms and conditions that are applicable to the acquisition.



(L) A statement regarding any additional contract requirement(s) or terms and conditions (such as contract financing arrangements or warranty requirements) determined by the contracting officer to be necessary for this acquisition and consistent with customary commercial practices: Not Applicable.



(M) The Defense Priorities and Allocations System (DPAS) and assigned ratings are not applicable to this solicitation.

NOTICE FOR FILING AGENCY PROTESTS



United States Coast Guard Ombudsman Program



It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO).



Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest.



Informal Forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer. If the Contracting Officer is unable to satisfy their concerns, interested parties are encouraged to contact the U.S. Coast Guard Ombudsman for Agency Protests. Under this informal process the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable).



Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions. If the protester’s concerns are unresolved, an Independent Review is available by the Ombudsman. The protester may file a formal agency protest to either the Contracting Officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for reasons of unusual and compelling urgency or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103(d) (2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. To be timely protests must be filed within the period specified in FAR 33.103(e).



Formal protests filed under the OPAP program shall be submitted electronically to OPAP@uscg.mil and the Contracting Officer or by hand delivery to the Contracting Officer.
