The Town of Williston Public Works Department is seeking proposals for equipment rentals with operators for the plowing and removal of snow and ice on certain streets and roads within the Town of Williston.

Sealed proposals are due at the office of the Public Works Director on Thursday, September 24, 2020. no later than 2:00 local time. Proposals received after the above time and date will not be considered.

WINTER MAINTENANCE OPERATIONS
SPECIFICATIONS AND INFORMATION
GENERAL CONDITIONS: The Town of Williston Public Works Department is seeking
proposals for equipment rentals with operators for the plowing and removal of snow and
ice on certain streets and roads within the Town of Williston.
The successful contractor shall make the rental equipment and operators available to
the Town from November 1, 2020 to April 1, 2021 / November 1, 2021 to April 1, 2022,
24 hours a day, 7 days per week. Contractors must be able to furnish all equipment
and operators within one-half hour of a call by the Town Manager, Public Works
Director, or Public Works Foreman, or their representatives. Failure to have equipment
and operators available as specified gives the Town the right to back charge the
contractor the value per street for a minimum of one street value and a maximum of the
entire storm value for not being ready for use after the required call-in time has elapsed.
The Town may award a two winter season contract.
The successful contractor shall indemnify and hold harmless the Town and its agents
and employees from and against all claims, damages, losses, and expenses, including
attorney’s fees, arising out of or resulting from performance of the work, provided that
any such claim, damage, loss or expense; (a) is attributable to bodily injury, sickness,
disease or death, or to injury to or destruction of tangible property including the loss of
use resulting there from, and (b) is caused in whole or in part by any negligent act or
omission of the contractor or any of its officers, agents, employees, representatives,
subcontractors, anyone directly or indirectly employed by any of them, or anyone for
whose acts any of them may be liable regardless of whether or not it is caused in part
by a party indemnified hereunder and the contractor shall, at their own expense, defend
and protect said indemnified parties against all such claims and demands.
The successful contractor will provide, prior to the acceptance and award of the
contract, certificates of insurance naming the Town and the Williston School District as
an additional insured evidencing insurance coverage adequate to meet the obligations
set forth in the above paragraph. Coverage will be in the amount of no less than
$1,000,000 single combined limit, and insurance adequate to cover its obligations under
the State’s Worker’s Compensation Act.
Successful contractor will maintain an accurate log on all plowing activities including
location, snow depth, miles plowed and time records; and will submit to the Public
Works Department within 24 hours after each storm event is completed. Said hours will
be approved for payment by the Public Works Director and will become document for
payment.
Pricing shall include: equipment size and type, salt and sand application, operators,
fuel, oil, repair parts, insurance, worker’s comp insurance, parts, maintenance,
equipment to load materials, cellular phone, pagers, and all other essentials that may be
necessary to perform the function of snow plowing, sanding, and salting. The selected
vendor shall provide a contact list for the contract period to include home numbers, cell
and pager numbers.
All equipment, plows, materials spreaders, and wings must be reviewed and approved
by the Town prior to awarding the contract.
All equipment will be equipped and operated with DOT approved amber warning lights
while performing winter maintenance.
Bidders shall furnish the Public Works Department a statement on how they would meet
their obligation to the Town should they incur equipment breakdowns or other problems
affecting the snow removal operation.
The Public Works Director shall have the right to remove any rental piece of equipment
during a storm, without further payment if the rental unit is deemed by the Public Works
Director as not performing mechanically or operationally. Resolution of issues will be
made prior to the next storm without retribution of lost time in previous storm by way of
Town to Contractor.
Pricing shall be based upon storm events as a lump item for each item. We anticipate
an average of 40 callouts per season, however, this is an estimate only. Bear in mind,
during major storm events, more than one trip per storm will be necessary in order to
clear roadways. Past winter seasons have averaged 36 storms of 3 inches or less and
4 storms of 3 inches or more. Paved roads and streets shall have salt applied in areas
of corners, hills and within 30’ of intersections and will be bare within 24 hours of the
end of a storm event. Sand shall be used on Gravel road surfaces.
In the event that winter maintenance operations proved to be unsatisfactory according
to the conditions of this proposal, the Town of Williston reserves the right to cancel the
contract without notice.
The minimum snow removal equipment the selected contractor shall possess and will
be required to use in performing winter maintenance duties is as follows:
A. 23,500 lb. rated dump truck with 4 yard body and 10 foot front plow with
wing plow.
B. One ton dump truck with all angle 9 foot snow plow.
