Introduction

Firms interested in bidding on the construction of the Wastewater Treatment Facility Enhanced Nitrogen Removal Upgrade are invited to submit a Statement of Qualifications (SOQ) to the Town of Oak Bluffs. This Request for Qualifications (RFQ) procurement is conducted pursuant to M.G.L. Chapter 149, Section 44 D1/2 and 44 D3/4. This RFQ is the first phase of a two-phase procurement process as set forth in

M.G.L. Chapter 149. A Prequalification Committee has been established and is prequalifying firms

interested in bidding on the construction of the wastewater treatment facility improvements project through this RFQ process. The PREQUALIFICATION COMMITTEE will evaluate submitted SOQs based upon the identified evaluation criteria and will select those respondents it deems qualified. Only those respondents deemed qualified will be invited to bid in response to a detailed set of plans and specifications which will be issued in the second phase of the procurement process. The Town expects the bidding to be initiated on or about March 30, 2023.

  1. Project Description

The proposed upgrade to the Oak Bluffs WWTF will take place on the site of the existing Sequencing Batch Reactor (SBR) Wastewater Treatment Facility at 17 Pennsylvania Ave, Oak Bluffs. The WWTF is to be converted to a Membrane BioReactor (MBR). The Town of Oak Bluffs currently has a treatment capacity of 370,000 gpd. The permitted discharge capacity is 620,000 gpd at maximum month flow which is the ultimate design capacity of the MBR. Existing plant processes consists of preliminary treatment (primary clarifier, primary sludge pumps, 6mm rotary screen, grit removal), SBR process tanks and equipment, tertiary effluent filtration, and ultraviolet (UV) disinfection. The primary clarifier and grit removal will be demolished, with the preliminary treatment structure modified for the addition of two, 2-mm rotary screens. The primary sludge pumps are to be relocated and repurposed for thickened sludge pumping. The SBR process equipment will be replaced with MBR equipment in two phases in order to keep the WWTF operational. The tertiary effluent filtration, and in-channel UV disinfection are to be demolished. The filter and UV building will be converted for sludge dewatering. The UV disinfection will be replaced with an in- pipe UV system adjacent to the MBR process equipment. Existing electrical appurtenances including a Motor Control Center (MCC), local panels and wiring are to be sequentially demolished as the existing equipment is replaced. An existing 400 kW generator and Automatic Transfer Switch (ATS) are to be replaced. Electrical improvements include a new electrical service, switchgear, 1MW standby generator, ATS, MCC, local panels, and wiring. control system improvements include replacement of two Programmable Logic Controllers (PLCs), connecting new equipment I/O, and upgrading the existing Supervisory Control and Data Acquisition (SCADA) system.

The project will be subject to the minimum wage rates set under the Massachusetts Prevailing Wage Laws and Davis Bacon Wage Laws.

Project Schedule

GHD Inc. has submitted plans and specifications to the Massachusetts Department of Environmental Protection (MassDEP) and is finalizing the documents based on MassDEP comments. It is anticipated that permission to solicit bids will be granted by March 30, 2023 at which time plans and specifications will be provided to those contractors and sub-contractors prequalified by the Town for this Project. It is anticipated that the contract will be awarded by June 1, 2023.

Contractor and Subcontractor Prequalification Process

This process will prequalify contractors and subcontractors in accordance with applicable sections of

M.G.L. c. 149.

Interested firms must submit an SOQ, by the deadline set for submission. The Prequalification Committee will review and evaluate the SOQs received. The Prequalification Committee anticipates concluding the RFQ evaluation process within 30 days from submission of SOQs. Only those firms determined to be

qualified by the Prequalification Committee will be invited and permitted to submit a bid on the project. Firms that are not selected as qualified by the Prequalification Committee and firms that do not participate in the RFQ phase will be precluded from bidding on the project.

This RFQ is Phase One of the procurement process. After the deadline for the submission of SOQs has passed, the Prequalification Committee will prepare a register of the names of the firms submitting SOQs which will be available for public inspection. The Prequalification Committee will review and evaluate the SOQs submitted, information on prior project performance, information obtained from references, information obtained from governmental agencies and entities, and such other information asmay be obtained. The Prequalification Committee at its sole discretion may request additional information to clarify or supplement the information obtained.

Based upon its review and evaluation, the Prequalification Committee will prepare a list of prequalified general contractors and subcontractors. The Prequalification Committee shall endeavor to identify at least three general contractors and three subcontractors in each of the subcontractor categories which it deems qualified. If the Prequalification Committee does not rate at least three general contractors and three subcontractors in each of the subcontractor categories, it will either invite bids under sections 44B to 44E or if two contractors or subcontractors are prequalified, the Town may invite bids from those prequalified contractors and subcontractors.

  1. Treatment of Information submitted to the Awarding Authority and its PrequalificationCommittee

The Prequalification Committee shall have no obligation to treat any information submitted in or in connection with a SOQ as proprietary or confidential, with the exception of the audited financial statement which is deemed confidential. The Prequalification Committee’s obligation with respect to protection and disclosure of such information shall at all times be subject to applicable laws, including the Massachusetts Public Records law. The audited financial statement shall remain confidential and shall not be a public record to the fullest extent permissible under the law. The PrequalificationCommittee shall have the right to use all or portions of the SOQ and accompanying information, as it considers necessary or desirable in connection with the Project. By the submission of a SOQ, the respondent thereby grants to the Prequalification Committee an unrestricted license to use the SOQ, including all materials submitted therewith, in connection with the Project.

  1. Communication between Town and Respondents

Unauthorized communications or contact between the general contractors or the subcontractors, their employees, agents, or other related entities interested in submitting SOQs and the project designer or the Prequalification Committee, or any other person or entity assisting the Prequalification Committee with regard to this project are strictly prohibited. Any issues brought to the Prequalification Committee’s attention at the RFQ Informational Meeting which require additional clarification will be addressed by issuing a written addendum. Oral and other clarifications will be without legal effect. All such addenda will be considered part of this RFQ, and the respondent shall be required to acknowledge receipt of all addenda on the RFQ Proposal Response Form

attached to the RFQ. All addenda will be mailed or emailed to all respondents who have mailed or emailed an RFQ Interest Form for the Project or requested the RFQ It shall be the sole responsibility of the Respondent to ascertain the existence of any and all addenda issuedfor this RFQ.

  1. Status of Request for Qualifications

This Request for Qualifications is solely a request for information. It does not represent an offer, nor does it confer any rights on any respondent. The Town shall not be responsible under any circumstances for any costs incurred by any respondents to this RFQ.
