1. Receipt and Opening of Bids.
The City of Acworth invites sealed bids on forms attached hereto, which all the blanks of which must be
appropriatelyfilledin. Allbidswillbereceivedbythecityby2:30p.m., Wednesday, JulySeptember16, 2026
and then at the said office at the specified location to be publicly opened and read aloud.
Bids shall be dated, placed in an enclosed sealed envelope, and addressed to:

The City may consider any bid informal that is not prepared and submitted in accordance with the provisions
hereofandmaywaiveanyinformalitiesorrejectanyandallbids. Anybidmaybewithdrawnpriortotheabove
scheduled bid opening or authorized postponement thereof. Any bid received after the time and date specified
shallnotbeconsidered. Nobiddermaywithdrawabidwithin30daysaftertheactualdateoftheopeningthereof.
2. AddendaandInterpretations.
Nointerpretationofthemeaningofthespecificationsorbiddocumentswillbemadetoanybidderorally. Every
request for such interpretation shall be in writing, and addressed as follows. Requests for interpretation must
bereceived atleastfive (5) dayspriortothescheduleddateofthebidopening.

Anyand all suchinterpretations andanysupplemental instructions shall be in theform of written addenda to
the specifications, which ifissued, will be forwarded by email atthe respective address registered, no later than
five (5) days prior to the date fixed for the bid opening. Failure of anybidder to receive anysuch addendum
or interpretation shall not relieve such bidder of any obligation for their submitted bid. All addenda so issued
shallbecome partofthebiddocuments. Allpotentialbiddersmustregistertoreceive abidpacket.
3. Method of Award- Lowest Responsive Bidder.
Award will be based on the lowest bid received that meets all specifications herein.
4. Obligation of Bidder.
At the time of the bid opening, each bidder is expected to be familiar with the project and/or materials to be
supplied. Failure bythebiddertobe thoroughlyfamiliar withthespecifications willnot relieveasuccessful

bidder oftheir obligation to furnish the project and/ormaterials. Itisthe responsibility ofthe bidder toregister
with the city to obtain the most up-to-date bidder information packet and any related addenda. Obtaining
bidderinformation packets fromthirdpartiesdoesnotrelievethebidderfrommeetingbidobligations.
5. Delivery & Installation.
The project, including all materials, labor, and installation, must be fully completed no later than November
16, 2026, unless an extension is approved by the City Manager. Any materials damaged during delivery,
handling, or installation shall be repaired or replaced at the contractor' s expense.
6. LawsandRegulations.
Thebidder'sattentionshallbedirectedtothefactthatallapplicableGeorgiaStatelaws, Municipalordinances,
and the rules and regulations of all authorities having jurisdiction over the process shall apply. Failure to do
somayresultin rejectionofthebid. Salestaxshouldnotbeincluded.
7. Warranty.
New fence installation should have workmanship warranty against defects and guaranteed for a period of not
lessthanone (1) yearfromthedateofinstallation.
8. E-VerifyProgram
All contractors and sub-contractors must complete the provided E-Verify Affidavit. The bidder's completed
affidavit is due at the time of bid submission. Failure to complete and sign these forms may disqualify bidder.
Subcontractor(s) documents will need tobeprovided priorto subcontractor starting work. Subcontractors are
not authorized to begin work until required documents are submitted.
9.Certificate of Insurance
Contractor must supply a current Certificate of Insurance with the City of Acworth 4415 Center Street
Acworth Ga 30101 listed as a certificate holder. The winning bidder' s completed Certificate of Insurance is
duenomorethanfive (5) businessdaysafterbidopening.
10. Contract
Contractor must supply City with contract signed by bidder. This is due at the time of bid submission as apart
ofthebidpacket.
