The Work generally consists of redevelopment improvements at Osborne Park including selective removal and earthwork; construction of new gravel pedestrian trails with ADA-related grading features; timber edging, retaining elements, exercise stations, drainage improvements, rain gardens, an infiltration basin, storm drainage structures, streambank restoration, trail lighting, landscaping, a fishing pier, and a prefabricated boardwalk with gangway, floating dock, and kayak launch. An additional prefabricated floating dock, with a kayak launch proposed as a separately bid additive alternate and is contingent on permitting approval.

ADVERTISEMENT FOR BIDS
Owner: City of Euharlee, Georgia
The City of Euharlee, Georgia, hereby invites sealed Bids for construction of OSBORNE PARK RE-
DEVELOPMENT - PHASE 3 IMPROVEMENTS, Project No. A26001, located at Osborne Park, 111 Covered
Bridge Road, Euharlee, Georgia.
Separate sealed Bids for furnishing of all materials, labor, tools, equipment, and appurtenances necessary
for the completion of the construction of Osborne Park Re-Development - Phase 3 Improvements will be
received at City of Euharlee City Hall, 30 Burges Mill Road, Euharlee, Georgia 30145, Attention: Carolyn T.
Banks, City Clerk, until 2:00 p.m. local time on Thursday, August 6th, 2026, and then publicly opened and
read aloud.
Each sealed envelope containing a Bid shall be plainly marked on the outside: "Bid for OSBORNE PARK
RE-DEVELOPMENT - PHASE 3 IMPROVEMENTS." Bids received after the stated time will not be
considered, and no Bidder may withdraw a Bid within 60 days after the actual date of opening.

BID DOCUMENTS
Bidding Documents may be examined at the office of CTI Engineers, Inc., 650 Henderson Drive, Suite 420,
Cartersville, Georgia 30120, and at Euharlee City Hall, 30 Burges Mill Road, Euharlee, Georgia 30145.
Bidding Documents must be purchased through CTI Engineers, Inc. at a cost of $150.00 per set. Only
Bidders purchasing Contract Documents through CTI Engineers, Inc. will be considered qualified bidders and
will be placed on the official plan holders list for receipt of addenda.
All questions regarding the Contract Documents shall be submitted in writing to Joseph H. Byrne, P.E., CTI
Engineers, Inc., at jbyrne@ctiengr.com, and to be given consideration must be received at least five (5) days
prior to the date fixed for opening of Bids.

BID REQUIREMENTS
Each Bid must be submitted on the prescribed Bid forms and must be accompanied by a Bid Bond, certified
check, or cashier's check in the amount of not less than five percent (5%) of the Bid amount, payable to the
Owner.
The successful Bidder will be required to furnish Performance and Payment Bonds, each in the full amount
of the Contract Price, and to provide required insurance in accordance with the Contract Documents.
The Contract will be awarded to the lowest responsive and responsible Bidder, based on the Base Bid only,
and any Add Alternatives selected by the Owner, as described in the Bid Schedule and Supplementary
Conditions.
The Work shall reach Substantial Completion within 210 consecutive calendar days from the date stated in
the Notice to Proceed and Final Completion within 240 consecutive calendar days from the date stated in the
Notice to Proceed. Liquidated damages will be assessed in the amount of $500.00 for each consecutive
calendar day of delay as provided in the Contract Documents.
Surety and insurance companies must have an AM Best rating of A-10 or greater, be listed in the Federal
Registry of Companies holding Certificates of Authority and Acceptable Sureties on Federal Bonds, be
licensed by the Georgia Insurance Department and the Georgia Secretary of State to do business in the
State of Georgia.
Contractor must have minimum Worker's Comp and General Liability Insurance in full force and effect.
No proposal will be considered unless it is accompanied by satisfactory evidence that the Bidder holds
Georgia State Contractor's License of proper classification and in full force and effect, in compliance with the
provisions of O.C.G.A. Sec. 43-14-2 et seq. Pursuant to O.C.G.A. 13-10-91, all contractors and sub-
contractors performing work within the State of Georgia on a contract with a public employer must register
and participate in a federal work authorization. City of Euharlee, Georgia will require certification from
contractor that this requirement has been met.
Each Respondent shall submit with its proposal a copy of current Business License and/or Occupational Tax
Certificate issued in the state it resides. If bidder cannot prove this license, it will be required to obtain one
from City of Euharlee, Georgia if it is the Awarded Respondent.
SUPPLEMENTARY INVITATION TO BID / SPECIAL GRANT CONDITIONS
This Project is funded in part through the Land and Water Conservation Fund (LWCF); therefore, Bidders
shall comply with all applicable federal, state, and local requirements included in the Contract Documents,
including E-Verify requirements, debarment and suspension certifications, equal opportunity requirements,
accessibility requirements, and applicable Buy America / Build America, Buy America provisions. All
contractors shall be in good standing with the City of Euharlee and shall abide by all Federal Requirements
set forth for the project (i.e. Federal Labor Standards, Equal Opportunity, Accessibility, and Build America
Buy America Requirements). Individuals or firms responding to this Invitation to Bid may not appear on any
list of service providers who are debarred from participating in federally funded contracts.

APPLICABLE REGULATIONS
City of Euharlee, in accordance with Title VI of the Civil Rights Act of 1964 and related statutes and
regulations, hereby notifies all contractors that it will affirmatively ensure that in regards to any contract
entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to
submit proposals in response to this invitation and will not be discriminated against on the grounds of race,
color, sex, or national origin in consideration for an award. The General Contractor and all Sub-contractors
shall insure that employees and employment applicants are not discriminated against because of race, color,
creed, sex, or national origin.
The successful contractor must comply with all applicable local, state and federal regulations, including:

* In addition, all manufactured products used in the project must be produced in the United States.
This means the manufactured product was manufactured in the United States, and the cost of the
components of the manufactured product that are mined, produced, or manufactured in the United
States is greater than 55 percent of the total cost of all components of the manufactured product.
* If documentation of domestic steel/iron manufacturing is not available, then a waiver request is
necessary.

steel, manufactured products, and construction materials used in federally funded projects for
infrastructure must be produced in the United States. Projects over $250,000 must provide
documentation showing BABA adhered to. (Example: Contractor's BABA certification letter). Waivers
may be granted when:
* Use of a U.S. product is impractical or inconsistent with the public interest
* Product is not mined, produced, or manufactured in the U.S. in sufficient and reasonably available

Special Conditions: No groundbreaking work or development activities should take place until the following
conditions are met: USACE review and permitting complete. Core Base Bid Phase 3 work will proceed under
the existing Nationwide Permit verification. No construction of the dock / kayak launch alternate shall take
place until USACE review of the proposed minor modification is complete and written concurrence is
obtained.
* Minimum Wages: Under Executive Order 13658 (January 2015)
* Electrical Wires: All new electrical wires must be underground.
* Historic Properties: The requirement that all construction work be halted immediately in the event
that previously unidentified historic properties are discovered within the Area of Potential Effect
(APE) during project construction.
RECOMMENDED QUALIFICATIONS
It is in the best interest of City of Euharlee, Federal Highway Administration, Georgia Department of Natural
Resources and all future trail users to ensure that the bid is awarded to the lowest responsive, responsible
and qualified bidder. Bidders are encouraged to include documentation to demonstrate evidence of the
recommended qualifications below:
* Prior shared-use trail construction experience
* Prior experience working on federally funded contracts
* References for similar completed projects
* Professional Trail Builders Association (PTBA) membership
Bid packages shall include all forms and certifications required by the Contract Documents and solicitation
requirements, including acknowledgment of addenda and any grant-related certifications required at bid time.
Failure to submit required bid forms, bid security, and certifications may render a Bid nonresponsive.

No groundbreaking or development activities shall begin until required permits and regulatory approvals
identified in the Contract Documents have been obtained. Bidders are specifically advised that grant-related
requirements and federal provisions referenced in the Contract Documents apply to this Project.
ORDER OF PRECEDENCE
In the event of any inconsistency between this Advertisement for Bids, any supplementary invitation
language, or grant-related solicitation narrative, and the Drawings, Specifications, Agreement, General
Conditions, Supplemental Conditions, or other Contract Documents, the Contract Documents shall govern
unless a specific supplementary provision expressly states that it modifies the Contract Documents.
OWNER'S RIGHTS
City of Euharlee, Georgia reserves the right to accept or reject any and all Bids, to waive formalities,
technicalities or irregularities and to award the Contract in the best interest of the Owner or to re-advertise if
necessary.
