This Request for Proposals (“RFP”) outlines the existing Project, provides a general description of services anticipated, specifies submittal requirements, identifies selection criteria, and explains the selection process. A response to this RFP (a “Proposal”) should serve as a complete and detailed approach to providing the required services (the “Services”). The RFP and resulting agreement are intended to be comprehensive (i.e., separate proposals for any single portion of the Services will not be considered).

The objective is for entities responding to this RFP (“Proposer”) to submit sufficient information to allow the Town to select a CMAR to enter into a contract with full service following agreement and execution in September 2026 and be completed by December 2026. Proposals should serve as a complete and detailed approach to the management and delivery of the Services.

SECTION 1: GENERAL INFORMATION
1.0 INTRODUCTION
The Town of Johnstown (the “Town”) is soliciting proposals from qualified Construction Manager at Risk
(CMAR) firms to provide design phase and potentially construction phase services for the Raw Water
Transmission Project (“Project”).
This Request for Proposals (“RFP”) outlines the existing Project, provides a general description of services
anticipated, specifies submittal requirements, identifies selection criteria, and explains the selection
process. A response to this RFP (a “Proposal”) should serve as a complete and detailed approach to
providing the required services (the “Services”). The RFP and resulting agreement are intended to be
comprehensive (i.e., separate proposals for any single portion of the Services will not be considered).
The objective is for entities responding to this RFP (“Proposer”) to submit sufficient information to allow the
Town to select a CMAR to enter into a contract with full service following agreement and execution in
September 2026 and be completed by December 2026. Proposals should serve as a complete and detailed
approach to the management and delivery of the Services.
Assuming the Town and the selected design phase CMAR firm reach an agreement on a Guaranteed
Maximum Price (GMP) and associated Contract Terms with the selected design phase CMAR firm, the Town
will proceed with the CMAR firm to construction of the proposed improvements. Construction is desired to
begin immediately following the design phase, with a desired Substantial Completion of the Project by
December 2028. The Town is reserving its right to break the Project into a multi-phased approach that could
include an early work package (EWP) for the pump station intake during irrigation off-season for Lonetree
Reservoir and additional EWPs for civil and site work as appropriate.
1.1 PROJECT SUMMARY
The Town is experiencing rapid growth and has proceeded with a facility expansion and upgrade project to
the existing Water Treatment Plant (WTP). As the raw water supply will become the limiting factor for
treatment capacity, the Town is currently in the 60% design phase of the Project. The Project will bring the
ultimate capacity to the WTP through the construction of a new pump station and transmission main.
The Project alignment crosses several jurisdictions, including the Town of Berthoud, Larimer County, Weld
County, Colorado Department of Transportation (CDOT), and the Town of Johnstown. The Project also
includes multiple infrastructure crossings, including the Consolidated Home Supply Ditch (CHSD),
Burlington Northern Santa Fe (BNSF) Railroad, Lake Ditch, Christian Lateral, Harry Lateral, and CDOT
Highways. To date, easement acquisition is 80% complete.
The Project’s Construction Budget is currently planned to be financed by the Town’s Water Fund, one of
Johnstown’s enterprise funds. The CMAR will work with the Town’s Project Team to value engineer costs that
meet the Town’s budget.
The Project is summarized below:
A. Construction of a new pump station at Lonetree Reservoir that will include:
1. A new raw water intake while maintaining uninterrupted water supply to the adjacent existing
pump station

2. A new custom pump station building
3. Installation of five (5) raw water submersible pumps sized for up to 21 MGD production
4. Electrical, Instrumentation and Controls, and SCADA systems
5. Yard piping
6. Installation of a new PVREA electrical service
7. Installation of a new diesel generator sized for 100% backup capacity
B. Installation of 10.6-miles of 30-inch transmission main with railroad, highway, and ditch crossings.
C. Construction of a blending vault to combine the Town’s two raw water sources ahead of the WTP.
D. Upgrades to the existing Johnstown Reservoir pump station to support the new blending operations.
E. Construction and coordination of the connection to the WTP.
1.2 GENERAL INSTRUCTIONS
The selected CMAR will become a member of the Town’s Project Team, which will consist of the selected
CMAR Firm, Civil Resources, LLC (the “Design Engineer”), and Town Staff. The selected CMAR Firm will
provide design phase consulting services to assist the Town in developing a Final Guaranteed Maximum
Price (GMP). The services will include but are not limited to constructability evaluation of the Project, value
engineering, cost evaluation, and schedule determination. Upon completion of design phase services, and
if an agreement is reached between the CMAR and Town on the GMP and Schedule, the selected CMAR Firm
will be contracted to provide construction phase services. Refer to this RFP’s attachments for additional
details about the design and key project elements. The Town intends to select a CMAR based on
qualifications and negotiate a GMP for the work package(s).
1.3 QUALIFICATIONS
CMAR firms must meet the following minimum qualification requirements to be considered for evaluation:
A. The CMAR firm shall have experience as a general contractor in the construction of at least three (3)
water transmission projects through substantial completion within ten (10) years prior to the date of
this RFP with at least one (1) in past five (5) years.
1. Submit a minimum of two (2) featured project references. Firms may supplement project
reference worksheets with project data sheets or other information deemed necessary for
consideration in the evaluation.
2. Each referenced project shall have a minimum construction contract amount of $5,000,000
and be relevant in size and scope to the work described in this RFP.
3. Experience shall highlight the CMAR has the ability to install 24-inch or larger pipeline.
B. The proposed CMAR Project Manager and Project Superintendent must have worked on at least one
of the aforementioned featured projects, either individually or as a team.
C. The CMAR firm must demonstrate safety performance and a history of compliance with

Occupational Safety and Health Administration (OSHA) construction industry standards.
D. The CMAR firm must demonstrate financial stability and sufficient staff, resources, and technical
experience to perform the work properly and expeditiously.
E. The CMAR firm must identify its permanent place of business and demonstrate how its location will
support timely mobilization and overall project delivery.
1.4 ADMINISTRATIVE INFORMATION
A. PROCESS SUBJECT TO PURCHASING POLICY
The RFP process shall be conducted subject to the Purchasing Policies section of the Financial
Policies published April 2022.
B. ISSUING DEPARTMENT
The Towns Representative listed in this RFP is to be the sole point of contact concerning this RFP.
Proposers shall not directly contact other personnel regarding matters concerning this RFP or to
arrange meetings related to such.
C. GOVERNING LAWS AND POLICIES.
Procurements are governed by state law and the Town’s Purchasing Policies further establish
requirements for the Town’s purchasing activities. Proposer shall familiarize themselves with the
provisions of the laws of the State of Colorado and the Federal Government, and with all local laws
and all regulations made which are pertinent to the proposed work and shall comply with the same.
D. EQUAL OPPORTUNITY
Proposer will not discriminate against any employee or applicant for employment because of race,
color, religion, age, sex, or national origin, or other reason prohibited by applicable federal, state or
local law, ordinance or regulation. Proposer shall abide by all federal laws in effect during the
Agreement period which govern Equal Opportunity Employment.
E. CONFLICT OF INTEREST
No officer, employee or official of the Town shall participate in a transaction, contract, activity, or
service of the Town which has a direct or predictable effect on their financial interests or the financial
interests of an immediate family member. This also applies to subcontracts with the Town. Soliciting
or accepting any gift, gratuity favor, entertainment, kickback or any items of monetary value from any
person who has or is seeking to do business with the Town is prohibited.
F. INSURANCE
1. The awarded Proposer will be required to, at its own cost, secure and continuously maintain
through the term of the Agreement the minimum insurance coverages listed below, with forms
and insurers acceptable to the Town. The Proposer understands and agrees that the
Contractor shall have no right of coverage under any existing or future Town comprehensive or
personal injury liability insurance policies. As a material term of this Agreement, Contractor
agrees to maintain and keep in force during the term of this Agreement one or more policies of
insurance written by one or more responsible insurance carrier(s) authorized to do business in
