SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL ITEMS IN ACCORDANCE WITH FAR 13.5

Acquisition Plan Action ID: 36C252-26-AP-0588

Contracting Activity: Department of Veterans Affairs, Great Lakes Acquisition Center, in Milwaukee, WI, on behalf of the Jesse Brown VA Medical Center, in Chicago, IL. 2237#: 537-26-1-735-0001.

Nature and/or Description of the Action Being Processed: This is a sole source for an urgently needed MRI Trailer. There is currently an ongoing MRI lease at the Jesse Brown VAMC (36C25224P0527), but that contract is set to expire on November 14. Due to unforeseeable construction delays, an MRI Trailer extension is needed. Unfortunately, a -8 extension of six months was already used, therefore this is an Emergency Bridge for six more months, to hopefully allow construction at the Jesse Brown VAMC to conclude.

Description of Supplies/Services Required to Meet the Agency s Needs: This is a six month lease of a Siemens MRI Trailer from Salvadorini Consulting LLC, the vendor of the currently installed MRI Trailer.

Statutory Authority Permitting Restricted Competition:Â
FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement.  Competition is restricted on this procurement for the reason below:
       ( ) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements
       (X) Unusual and Compelling Urgency
       ( )  Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services
       ( ) International Agreement
       ( ) Authorized or Required by Statute
       ( ) National Security
       ( ) Public Interest

Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The Sole Source will be to SDVOSB Vendor Salvadorini. Salvadorini is the current lessor of the MRI Traileer at Jesse Brown, and this would just be a continuation of that service.

Provided by the station, and approved by VISN 12 Deputy Director, Mr. Ike Lusk, the following bullet points were provided as justification for the sole source due to unusual and compelling urgency.

Not approving emergently, would result in hundreds of patients being impacted/ not receiving care timely and/or causing harm.
1.5 MRI Construction is now slated to end March 2026, so an extension for the MRI Trailer is needed for an additional six months.
Sending Veterans out to the community for similar services would cost millions, compared to the cost of the trailer extension.

Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Due to the urgent nature of the needed lease, there was no solicitation.

Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The original contract with Salvadorini was competed and found to be the best value to the government (36C25224P0527). The price for this sole source will be the same as that contract.

Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Minimal market research was conducted due to the urgent and compelling urgency needed to secure this contract.

Any Other Facts Supporting the Use of Other than Full and Open Competition: None.

Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None.

A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: If there is any other overrun of construction at the Jesse Brown VA Medical Center, competition would be solicited.
