Description

This notice is being published in accordance with Federal Acquisition Regulation (FAR) Subpart 5.101 requiring dissemination of information for proposed contract actions. This is a notice of intent to award a sole source fixed price contract and is not a request for competitive quotes/proposals. The statutory authority for this sole source procurement is prescribed by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements.



Background: The Embassy requires the services of a local legal company to provide non-litigation legal support, specifically in interpreting and ensuring compliance with Ukrainian labor laws in line with U.S. Department of State requirements. This support is essential to the effective day-to-day operations of the Human Resources office.



A local firm brings necessary expertise in Ukrainian legislation, language, and administrative processes, enabling timely and accurate legal advice on employment matters, including contracts, terminations, and policy compliance. Their services will help prevent legal risks, ensure lawful employment practices, and support consistent HR operations.



Given the complexity and evolving nature of Ukrainian labor law, local legal counsel is the most efficient and cost-effective solution to maintain compliance and support the Embassy’s mission.



Local legal counsel “Sayenko Kharenko Advokatske Obednannya” is selected as they provide expert legal advice tailored to the unique legal considerations of the Embassy of the United States of America in Kyiv, Ukraine, ensure compliance with U.S. Government terms and conditions, and offer cost-effective solutions aligned with the Government's needs.



The Embassy of the United States of America in Kyiv, Ukraine intends to issue a purchase order contract with a fixed unit price as a sole source award to the Ukrainian legal firm “Sayenko Kharenko Advokatske Obednannya” on or about September 15, 2025, through May 31, 2026. The ordering period will be nine (9) months with an anticipated maximum value of USD 45,000, in which the funding will be obligated for the full period of service. Under this contract, “Sayenko Kharenko Advokatske Obednannya” will provide legal services related to non-litigation matters but the labor law of Ukraine.



The North American Industry Classification System (NAICS) code for this requirement is: 541199 – All Other Legal Services



This notice is not a request for proposals or quote. However, all responsible sources may submit a capability statement demonstrating the ability to provide the requested services, which shall be considered by the agency before the intended award date. Interested sources who submit data are responsible for appropriately marking information if it is proprietary in nature. The Government shall not reimburse interested sources for any information provided. No requests for capability briefings will be honored. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government.
