The City of Bismarck Public Works Utility Operations Department requests written qualifications from licensed and bonded contractors with the City of Bismarck for the purpose of being placed on a prequalified list for homeowners to solicit bids for replacement of their property’s lead or galvanized service line based on Federal Environmental Protection Agency and the North Dakota Department of Environmental Quality Lead Service Line Replacement requirements.

Each contractor is subject to the following requirements:

  • Bidders on this work will be required to comply with American Iron and Steel requirements of the Consolidated Appropriations Act, 2014. The requirements for bidders and contractors under this regulation are explained in the specifications.
  • Bidders are required to comply with Davis-Bacon prevailing wage requirements.
  • Bidders on this work will be required to comply with Title 40 CFR Part 33– Participation by Disadvantaged Business Enterprises in the United States Environmental Protection Agency Programs. The requirements for bidders and contractors under this regulation concern utilization of Minority Business Enterprises (MBE), Women’s Business Enterprises (WBE), and Small Business Enterprises (SBE) and are explained in the specifications.
  • The goal for MBE is 2% of the total dollar value of the project. The goal for WBE is 3% of the total dollar value of the project. To demonstrate a good faith effort to comply, bidders must include the MBE/WBE subcontractor solicitation form in the bid package.
  • To minimize surface disruption, environmental impacts, and costs associated with surface restoration, the project will require the use of trenchless construction methods (e.g., pipe pulling, pipe bursting, directional drilling) for the replacement of lead or galvanized service lines. The firm must demonstrate experience with trenchless technologies specific to water service lines in urban, suburban, and/or constrained environments.

  • MBE/WBE Subcontractor Solicitation Information Form
  • Notification of Subcontracts Awarded Form
  • Experience and Performance

An evaluation of the written qualifications received will be conducted. All contractors who meet the qualifications will be placed on the prequalified list. Contractors must maintain their status as a licensed and bonded contractor with the City of Bismarck to remain on the prequalified list.
