Subject: Notice of Intent to Award a Sole Source Contract for Blood Gas Test Cartridges.
In accordance with Federal Acquisition Regulation (FAR) 8.405-6(a)(1)(i)(B), the Navajo Area Indian Health Service (IHS), Crownpoint Healthcare Facility (CHF), intends to award a non-competitive, sole source purchase order to WERFEN USA LLC. This purchase order is for delivery of Blood Gas Test Cartridges specifically designed for the use in the Crownpoint Laboratory Department’s existing GEM Premier 5000 Blood Gas System. The anticipated delivery date is 30 days from the date of award. The assigned North American Industry Classification System (NAICS) code for this procurement is 325413 – In Vitro Diagnostic Substance Manufacturing, with a small business size standard of 500 employees.
Werfen USA LLC is the sole organization qualified to provide these test cartridges, which are uniquely designed for compatibility with the GEM Premier 5000 Gas Analyzer. This Compatibility is crucial for ensuring accurate, reliable, and safe operation of the laboratory’s equipment.
This notice of intent to award a sole source contract is not a request for competitive proposals, and no solicitation will be issued for competitive quotes. Any response to the notice must demonstrate, with clear and convincing evidence, that competition would be advantageous to the Government.
A determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. Any solicitation resulting from the analysis of accordance with the FAR Part 5. However, responses to this notice will not be considered adequate responses to a solicitation. No proprietary, classified, confidential, or sensitive information should be included in your response. The Government reserves the right to use any non-proprietary technical information in any resultant solicitations(s).
