INVITATION TO BID

Sealed Bids for the General Contract for the Ocean Avenue Extension Seawall Replacement will be received by the
Town of York, C/O Nicole Pestana, 186 York Street, York, ME 03909, September 29, 2026, at 11:00 A.M., and at
that time and place will be publicly opened and read aloud in the Town Hall.
The work of this contract includes furnishing all labor, materials, equipment, and incidentals necessary to perform
replacement of the existing Ocean Avenue Extension Seawall as described in the Information For Bidders.
The work is shown on the project drawings entitled "Ocean Avenue Extension Seawall Replacement,” prepared
by GZA GeoEnvironmental, Inc.
Bid sets are available at the Town website: https://www.yorkmaine.org/Bids.aspx. Bid sets may also be available
upon request at the Emergency Management Department, Town Hall, 186 York Street, York, ME 03909.
A pre-bid meeting/site visit will be held on September 10, 2026, at 2:00 P.M. at the project site, 16 Ocean Avenue
Extension, York, ME 03909.
Questions regarding the project or bid documents must be submitted in writing to Nicole Pestana,
Emergency Management Director, Town of York, 186 York Street, York, ME or, via email to
npestana@yorkmaine.org, by September 15, 2026, at 4:00 P.M. Written clarifications or interpretations will be
issued by Addenda not later than five days before the bid opening date. Only questions answered by formal
written Addenda will be binding. Oral and other clarifications or interpretations will be without legal effect.

For all further requirements regarding bid submittal, qualifications, procedures, and contract award, refer to the
Information For Bidders that are included in the bid documents.
The successful bidder agrees to reach substantial completion by May 31, 2027.
The Town reserves the right to reject any bids, in whole or in part, to waive any formality or technicality in any bid
and to accept any item in any bid. The Town also reserves the right to waive all informalities not involving price,
time, or changes in the Work and to negotiate contract terms with the Successful Bidder.

INFORMATION FOR BIDDERS

Notice is hereby given that the Town of York (the “Owner”), will receive sealed bids for furnishing all labor,
materials, equipment, and incidentals for the project known as:
OCEAN AVENUE EXTENSION SEAWALL REPLACEMENT

Sealed Bids for the General Contract for the Ocean Avenue Extension Seawall Replacement will be received by the
Town of York, C/O Nicole Pestana, 186 York Street, York, ME 03909, September 29, 2026, at 11:00 A.M., and at
that time and place will be publicly opened and read aloud in the Town Hall.
Town of York authorized representatives shall represent the Owner in the execution of this contract.
The Owner agrees to examine and consider each bid submitted in consideration of the bidder’s
agreements, as herein above set forth and as set forth in the bid.
In the event that there is a discrepancy in the bid between the lump-sum price written in words and
figures, the price written in words shall govern.
The bids will be compared on the basis of the prices bid, and the contract will be awarded to the lowest
responsible and eligible bidder. The lowest bid will be determined as the sum of the base bid items.
No award will be made to any bidder who cannot satisfy the Owner that he/she has sufficient ability and
experience in this class of work and sufficient capital and plant to enable him/her to prosecute and
complete the work successfully within the time specified. The Owner’s decision or judgment on these
matters shall be final, conclusive, and binding.
The Owner may make such investigation as it deems necessary, and the bidder shall furnish to the owner,
under oath if so required, all such information and data for this purpose as the owner may request.
The Bidder shall submit references for similar projects and all pertinent information including contacts
for said projects.
The work of this contract includes furnishing all labor, materials, equipment, and incidentals necessary
to perform replacement of the existing Ocean Avenue Extension Seawall, including, but not limited to,
mobilization and demobilization of equipment and materials; develop and provide a storm contingency
plan; install and maintain temporary measures to protect existing site features to remain in place during
the work; install and maintain temporary pedestrian and vehicular traffic barriers; install temporary
erosion and sedimentation controls; demolish, remove, store, dispose of existing stone masonry seawall
and stair structures or salvage suitable wall stones for reuse; remove and dispose of existing deleterious
and unsuitable excavated materials; reconstruction of approximately 344 linear feet of stone masonry
seawall with reinforced cast-in-place concrete footings; reconstruction of stone masonry access stairs;
replacement of new metal pipe railings/guardrails; complete incidental site work; complete site,
laydown areas, and Contractor’s access location restoration and demobilization. The work is shown on
the project drawings entitled "Ocean Avenue Extension Seawall Replacement,” prepared by GZA
GeoEnvironmental, Inc.

A pre-bid meeting/site visit will be held on September 10, 2026, at 2:00 P.M., at the project site, 16
Ocean Avenue Extension, York, ME 03909. All prospective bidders are encouraged to attend. If the
bidder chooses not to attend this meeting, they shall waive any information provided at this meeting.
Any responses to written bidders questions will be provided by addendum.
Each bid shall be made out on the bid form attached hereto, state the proposed lump sum and/or unit
price, whichever is applicable for performing the work, both in words and in figures and be signed by the
bidder with his/her business address on or before September 29, 2026, at 11:00 A.M.
Bids must be enclosed in a plainly marked package with the Project title for which the Bid is submitted
and the name and address of the Bidder. If a Bid is sent by mail, the sealed envelope containing the
Bid must be enclosed in a separate package plainly marked on the outside with the notation
“BID ENCLOSED”.
Bids received after the date and time prescribed for the opening of bids, or not submitted at the correct
location or in the designated manner, will not be accepted and will be returned to the Bidder unopened.
The Owner (awarding authority) reserves the right to reject any or all bids should the Owner deem it to
be in the public interest to do so.
The Owner may reject bids which are on a form not filled in. The Owner may reject bids which in its sole
judgment are incomplete, conditional, obscure or not responsive or which contain additions not called
for, erasures not properly initialed, alterations, or similar irregularities, or the Owner may waive such
omissions, conditions or irregularities.
Unopened Bids may be withdrawn by an appropriate document duly executed in the same manner that
a Bid must be executed and delivered to the plan where Bids are to be submitted prior to the date and
time for the opening of Bids. Upon receipt of such notice, the unopened Bid will be returned to the
Bidder.
If a Bidder wishes to modify its Bid prior to Bid opening, Bidder must first withdraw its initial Bid in the
manner specified in this section and submit a new Bid prior to the date and time for the opening of Bids.
If within 24 hours after Bids are opened any Bidder files a duly signed written notice with Owner and
promptly thereafter demonstrates to the reasonable satisfaction of Owner that there was a material and
substantial mistake in the preparation of its Bid, the Bidder may withdraw its Bid. Thereafter, if the Work
is rebid, the Bidder will be disqualified from further bidding on the Work.
Unless a bid is withdrawn as provided above, the bidder agrees that it shall be deemed open for
acceptance until the agreement has been executed by both parties thereto or until the owner notifies a
bidder in writing that his/her bid is rejected or that the Owner does not intend to accept it. Notice of
acceptance of a bid shall not constitute rejection of any other bid.
Workers’ Compensation, liability, and other insurance requirements are outlined in the Construction
Agreement. The Contractor shall comply with all laws, ordinances and regulations of the Federal, State
and Municipal Governments which may be in force during the life of the contract, in any manner
affecting his employees or the conduct of the work or the material used or employed in the work. The
certificates of insurance and copies of information or declaration page(s) and of endorsements are to be
reviewed and approved as to form by the Owner before work commences. Bidders that may “self-insure”
are to provide detailed evidence of coverage and may be required to produce additional financial
disclosures, such that any and all concerns raised by any Owner shall be redressed to the satisfaction of
said Owner. A bidder that fails to comply with said additional requests by Owner may be deemed to be
unresponsive and as such may be precluded from any further consideration by the Owner.
