Section 00 11 00 - NOTICE TO BIDDERS
Sealed bids for the new Snow Removal Equipment Building (SREB) will be received in the Fort Smith Airport Commission Conference Room on the Second Floor of the Terminal Building, 6700 McKennon Blvd., until 3:00 p.m. local time on Tuesday, April 21, 2026 at which time the sealed proposals will be publicly opened and read aloud.
Work includes General Construction, Mechanical Work, Electrical Work and Site Work, all to be let under one prime contract.
A mandatory pre-bid conference will be held at the Fort Smith Regional Airport in the Commission Conference Room on the Second Floor of the Terminal Building, 6700 McKennon Blvd., Fort Smith, AR. at 2:00 p.m. on Tuesday, April 14, 2026. Each Prime Contractor is required to attend this conference for their bid to be considered. Subcontractors are welcome to attend.

Obtaining bidding documents through any source other than the Architect is not advisable due to the risks of receiving incomplete or inaccurate information, and the Bidder runs the risk of basing his/her proposal on such incomplete and inaccurate information. The documents obtained through the Architect or his representative(s) are considered the official version and take precedence if any discrepancies occur.
Sets may be obtained by Prime Contractors, Subcontractors, or Material Suppliers.
A bid bond in the amount of 5% shall accompany each bid. Each bid proposal shall include with it a bid security in the amount of 5% of the total bid offered, if the bid is in excess of $20,000. The bidder will be required to submit a bidder’s deposit, which includes enclosing a cashier’s check payable to the order of the Owner drawn on a bank or trust company doing business in Arkansas or by a corporate bid bond in an amount equal to 5% of the bid.
All Contractors must be licensed on the day of the bid submittal. All bidders shall conform to the requirements of Arkansas Contractors Licensing Law for Contractors. There shall be only one (1) bid submitted per State Contractors License. Bidder’s license shall be indicated on the bid form.
THE ATTENTION OF THE BIDDERS is called to the fact that security of the Airport is of prime concern at all times, and this Contract is subject to restrictions to this end as set out by the Contract Documents. All of the work must be accomplished in such a manner so as to minimize interference with aircraft and coincident aircraft operations. All work is subject to the Construction Safety Plan and other provisions and restrictions as outlined in the Contract Documents.
It is the policy of the Department of Transportation (DOT) that disadvantaged business enterprises as defined in 49 CFR Part 23 shall have the maximum opportunity to participate in the performance of contracts financed in whole or in part with Federal funds. All bidders and proposers shall make good faith efforts, as defined in Appendix A of 49 CFR Part 23, Regulations of the Office of the Secretary of Transportation, to subcontract 3.3% of the dollar value of the prime contract to small business concerns owned and controlled by socially and economically disadvantaged individuals (DBE). In the event that the bidder for this solicitation qualifies as a DBE, the contract goal shall be deemed to have been met. Individuals who are rebuttably presumed to be socially and economically disadvantaged include women, African -Americans, Hispanics, Native Americans, Asian-Pacific Americans and Asian-Indian Americans. The apparent successful bidder will be required to submit information concerning the DBE’s that will participate in this contract. The information will include the name and address of each DBE, a description of the work to be performed by each named firm, and the dollar value of the contract (subcontract). As a part of its bid, the bidder will be required to document its efforts to procure the services of DBE subcontractors for this contract. Any bid that fails to meet these requirements will be considered non-responsive.
No bid may be withdrawn within Ninety (90) days after the scheduled closing time for receipt of bids. The awarding of this contract work is contingent upon the Fort Smith Airport Commission’s receipt of funding from the Federal Aviation Administration.
The Owner’s award of this contract is conditioned upon Bidder or Offeror satisfying the good faith effort requirements of 49 CFR §26.53.

The Fort Smith Airport Commission reserves the right to reject any or all bids and to waive formalities, except for those affecting Equal Employment Opportunities’ matters.
