CITY OF BIXBY, OKLAHOMA
Separate sealed bids for the
Project No. SD29-2501 CDBG Stanley Storm Sewer, Needles to McKennon
for the City of Bixby, Oklahoma will be received by the City of Bixby, Oklahoma at City Hall, 111 North Cabaniss, Bixby, Oklahoma 74008, until 2:00 P.M.,May 28, 2026 for furnishing tools, materials and labor, and performing the work necessary to be done in the construction of the above. A pre-bid conference for prospective bidders will be held on May 12, 2026 at 2:00 P.M., (not mandatory, but highly encouraged) in the Council Room, City Hall, 111 North Cabaniss, Bixby, Oklahoma.
All bids that have been duly received will be publicly opened and read aloud by the Director of Public Works, or his designated representative, in the Council Room of the City of Bixby, Oklahoma, at the time and date shown above.
All bids must include assurances that the following provisions will be complied with:

Federal Labor Standards Provisions, US Department of Labor, 29 CFR 5;

Section 3 of the Housing and Urban Development Act of 1974, as amended; 12 U.S.C. 1701U, which requires that, to the greatest extent feasible, opportunities for training and employment be given lower-income residents of the project area and contracts for work in substantial part by persons residing in the area of the project, if $200,000 in CDBG funds are awarded to the project.

Section 109 of the Housing and Community Development Act of 1974, which assures that no person shall, on the grounds of race, color, natural origin or sex, be excluded from participation in, be denied the benefits of or be subjected to discrimination;

Certification of Non-Segregated Facilities, which assures the bidder does not maintain or provide any segregated facilities;

Equal Opportunity provisions - Executive Order 11246, as amended, which assures non-discrimination;

Minority Business Enterprise and Women Business Enterprise provisions, which encourage minority-owned businesses and women-owned businesses to bid on the project;
-
Assurances that surety companies executing bonds appear on the Treasury Department's list and are authorized to transact business in the State where the project is located.

The Contractor must comply with the requirements of the Build America, Buy America (BABA) Act, 41 USC 8301, and all applicable rules and notices, if federal funds are included and total project cost is greater than or equal to $250,000.

The Owner reserves the right to waive any informality or to reject any or all bids.
The sealed proposal of each bidder shall be accompanied by a Noncollusion Affidavit, Business Relationship Affidavit, Experience and Equipment Questionnaire and a Certified or Cashier's Check or Bidder's Surety Bond in the sum of five percent (5%) of the amount of the bid will be required from each bidder to be retained as liquidated damages in the event the successful bidder fails, neglects, or refuses to enter into said contract for the construction of said public improvements for said project, and furnish the necessary bonds within ten (10) days from and after the date the award is made.
Bids received more than ninety-six hours, excluding Saturdays, Sundays and holidays, before the time set for opening of bids, as well as bids received after the time set for opening of bids, will not be considered and will be returned unopened.
No bidder may withdraw his bid within sixty (60) days after the actual date of the opening.
