Notice of Intent to Sole Source NKV-330 Ventilation System

The Department of Veterans Affairs, Regional Procurement Office – West (RPOW), intends to award a Firm Fixed Price, Sole Source contract under the authority of FAR 6.302-1(a)(2)(ii) to Nihon Kohden America, LLC., 15353 Barranca Pkwy, Irvine, CA 92618 for the procurement of five (5) NKV 330 Non-Invasive Ventilators, to include accessories, and staff training for Jack C. Montgomery VA Medical Center located in Muskogee, OK, Eastern Oklahoma VA Healthcare System.

This request for NKV 330 Non-Invasive Ventilators will be placed on a sole source basis with Nihon Kohden America, LLC. as the following circumstance in FAR 13.106-1(b) applies: only one source is capable to provide the supplies and/or services required at the level of quality required because the NKV 330 Non-Invasive Ventilators are proprietary and may only be purchased and serviced through Nihon Kohden America, LLC. The Eastern Oklahoma Healthcare System at the Jack C. Montgomery VA Medical Center located in Muskogee, OK currently utilizes NKV 330 Non-Invasive Ventilators. The substitution of any other part or unauthorized service personnel other than that from the manufacturer, Nihon Kohden America, LLC, will void the warranty of the equipment and cause the equipment to not function properly nor be incompliance for use.

Delivery schedule will be discussed prior to issuing the contract award.

The anticipated award date is March 31, 2025.

This notice is not a request for competitive quotes; however, that all responsible sources and interested parties may identify their interest and capability to meet the requirements by submitting technical data for this requirement data within 15 calendar days of this notice posting (no later than March 6, 2025, by 08:00 AM CST, to Angela Kyte, via email at angela.kyte@va.gov which shall be considered by the agency.
