INSTRUCTIONSTOBIDDERS
PART1GENERAL
1.1 DEFINITIONS
A. The Bidding Documents consist of the Advertisement or Invitation to Bid, Instructions to
Bidders,BidForm,andothersamplebiddingandcontractforms.
B. TheproposedContractDocumentsconsistoftheFormofAgreementbetweentheOwner
and Contractor, Conditions of the Contract (General, Supplementary and other
Conditions), Drawings, Specifications and Addenda issued prior to execution of the
Contract.
C. Addenda are written or graphic instruments issued by the Engineer prior to the execution
of the Contract which modify or interpret the Bidding Documents by additions, deletions,
clarificationsorcorrections.
D. ABidisacompleteandproperlyexecutedproposaltodotheWorkforthesumsstipulated
therein,submittedinaccordancewiththeBiddingDocuments.
E. TheBaseBidisthesumstatedintheBidforwhichtheBidderofferstoperformtheWork
described in the Bidding Documents as the base, to which Work may be added or from
whichWorkmaybedeletedforsumsstatedinAlternateBids.
F. AUnitPriceisanamountstatedintheBidasapriceperunitofmeasurementformaterials,
equipmentorservicesoraportionoftheWorkasdescribedintheBiddingDocuments.
G. ABidderisapersonorentitywhosubmitsaBidandwhomeetstherequirementssetforth

H. A Sub-bidder is a person or entity who submits a bid toa Bidder for materials, equipment
orlaborforaportionoftheWork.
1.2 BIDS
A. Submit Bid Form along with required enclosures in a sealed envelope, with the Bidder's
name,licensenumber,andprojectnamewrittenontheoutside;placethissealedenvelope
inanotherenvelopeanddelivertotheOwnerattheaddressspecified.
B. Bids will be received until the date and time specified at which time they will be publicly
openedandread.
C. Fill in and sign the bid form correctly. Bids that show any omission, alterations of form,
additionsnotcalledfor,conditionalBids,oranyirregularitiesofanykindmayberejected. If
erasures are necessary and appear on the forms, each such erasure must be initialed by
thepersonsigningtheproposal.
D. Bidsthatarenon-responsiveorfailtofollowtheInstructionstoBiddersmayberejected.
E. NobidmaybewithdrawnafterreceiptofBidsforaperiodof60days.

1.3 ACCEPTANCEOFBID(AWARD)
A. ItistheintentionoftheOwnertoawardacontractforworkunderthisprojecttothelowest
responsible Bidder; however, in the interest of suitability to the need of the Owner and/or
economy, equipment, materials and furnishings other than the lowest in price may be
selected.
B. TheOwnerreservestherighttorejectanyorallBids,toacceptanybidsubmitted,towaive
any formalities, and to negotiate with the low Bidder or Bidders any changes considered
necessaryordesirable. TheOwnerreservestherighttorejectanyBidwhensuchrejection
is in the interest of the Owner to reject the bid of the bidder who has previously failed to
performortocompleteontimeContractsofasimilarnature;andtorejectthebidofabidder
whoisnot,intheopinionoftheEngineer,inapositiontoperformtheContract.
C. The Owner shall have the right to accept Alternates in any order or combination, unless
otherwisespecificallyprovidedintheBiddingDocuments,andtodeterminethelowBidder
on the basis of the sum of the Base Bid and Alternates accepted. Alternates may be
acceptedatanytimeduringthebidholdingperiod.
1.4 PRE-BIDMEETING
A. Refer to the invitaiton or adveristement for bids for the date, time and location of the Pre-
BidMeeting.
B. APre-BidMeetingwillbeheldforpurposesofconsideringquestionsposedbyBidders. All
interpretations and corrections to Contract Documents deriving from this meeting will be
documentedviaAddendum.
C. IftheBidderdoesnotattendthePre-BidMeeting,itistheBidder'sresponsibilitytoobtain
thePre-BidMeetingMinutesandallAddenda.
1.5 DISQUALIFICATION
A. TheOwnerreservestherighttodisqualifyBids,beforeorafteropening,uponevidenceof
collusionwithintenttodefraudorcommitotherillegalpracticesuponthepartoftheBidder.
1.6 CONTRACTOR'SLICENSE
A. AllBiddersmusthaveproperlicensesforcontractorsasrequiredbyStateLaw. TheBidder's
license number shall be listed on the bid form and on the outside of the inner sealed
envelopeinwhichthebidissubmitted.
1.7 CONFLICTOFINTEREST
A. Bidders must disclose in writing with their bid the name of any owner, officer, director, or
agentwhoisalsoanemployeeoftheOwner.
B. BiddersmustdiscloseinwritingwiththeirbidthenameofanyemployeeoftheOwnerwho
owns,directlyorindirectly,aninterestof5percentormoreintheBidder'sfirmoranyofits
branchesorsubsidiaries.
C. Bysubmittingabid,theBiddercertifiesthatthereisnorelationshipbetweentheBidderand
any person or entity which is, or gives the appearance of, a conflict of interest related to
thisproject.

1.8 NON-DISCRIMINATION
A. TheBiddershallnotdiscriminateagainstanyindividualsandwilltakeproactivemeasures
toassurecompliancewithallFederalandStaterequirementsconcerningfairemployment,
employment of people with disabilities, and concerning the treatment of all employees
withoutregardtodiscriminationbaseduponage,race,color,religion,sex,nationalorigin,
ordisability.
1.9 INTERPRETATIONOFDRAWINGSANDSPECIFICATIONS
A. Examine Drawings and Specifications and all Addenda or other revisions thereto and
thoroughly familiarize himself with the detailed requirements thereof prior to submitting a
proposal.
B. ShouldaBidderfinddiscrepanciesorambiguitiesin,oromissionsfromtheSpecifications
andDrawingsboundherein,orshouldbeindoubtastotheirmeaning,notifytheEngineer
in writing immediately. Engineer will issue an interpretation in the form of an addendum.
ThisaddendumwillbeforwardedtoallBiddersofrecord.
C. Addenda will be issued no later than four days prior to the date for receipt of Bids except
anAddendumwithdrawingtherequestforBidsoronewhichincludespostponementofthe
dateforreceiptofBids.
D. Actpromptlyandallowsufficienttimeforareplytobeprovidedbeforethedateestablished
forsubmissionofBids.
E. AcknowledgereceiptofalladdendaontheBidForm.
F. NooralinterpretationswillbemadetoanyBidderastothemeaningorintentoftheContract
DocumentsorbeeffectivetomodifyanyoftheprovisionsoftheContractDocuments.
1.10 SUBSTITUTIONS
A. References are made to certain specific products solely to denote the quality standard of
the desired product and are not intended to restrict Bidders to a specific brand, make,
manufacturer,orname. Theseproductshavebeennotedtoassistinestablishingmaterial
types and acceptable products. Equivalent products will be considered acceptable
providedthattheapprovalofthespecificproducthasbeengiveninwritingbytheEngineer.
B. Writtenrequestsforsubstitutionofequivalentproductsfromprimebidderswillbeconsidered
ifreceivedbytheEngineer14calendardayspriortothebidopening.
C. Identifytheproductorthefabricationorinstallationmethodtobereplacedineachrequest.
Includerelatedspecificationsectionsanddrawingnumber.
D. Providecompletedocumentationonboththeproductspecifiedandtheproposedsubstitution
includingthefollowinginformationasappropriate:
1. Comparisonofspecifiedandproposedsubstituteproductdata,fabricationdrawings,
andinstallationprocedures.
2. Sampleswhereapplicableorrequested.
3. Detailedcomparisonofsignificantqualitiesoftheproposedsubstitutionwiththose
oftheworkspecified.

4. Coordination information, including a list of changes or modifications needed to
otherpartsoftheWorkandtoconstructionperformedbytheOwnerandseparate
Contractors that will become necessary to accommodate the proposed
substitution.
E. Certification by the Bidder or manufacturer that the substitution proposed is equal to or
betterineveryrespecttothatrequiredbytheContractDocuments,andthatitwillperform
equal or superior to product specified in the application indicated. The Bidder waives any
right to additional payment or time, which may subsequently become necessary because
ofthefailureofthesubstitutiontoperformadequately.
F. Engineer's Action: The Engineer may request additional information or documentation
necessaryforevaluationoftherequest. TheEngineerwillnotifytheBiddersofacceptance
of the proposed substitution by means of an addendum to the bid documents. If the
proposedsubstituteisacceptedthroughanaddendumusetheproductspecifiedbyname.
Engineer's Substitution Approval during bidding and subsequent addendums does not
void the Bidder's responsibility to submit the required shop drawings and comply with the
othercontractdocumentsandrequirements.
1.11 SITEINVESTIGATION
A. Examine the site to determine the extent of work involved, size of work, etc., and the
conditionsunderwhichtheworkmustbestagedandperformed. Examinethegroundsand
buildings,utilitiesandroadsandascertainbyanyreasonablemeansconditionsthatwillin
anymanneraffectitswork.AsktheEngineerforanyadditionalinformationthathedeems
necessary to be fully informed as to exactly what is to be expected prior to submitting a
proposal.Thedrawingshavebeenpreparedonthebasisofsurveysandinspectionsofthe
site and physical conditions at the site. This, however, does not relieve the Bidder of the
necessity for fully informing itself as to the existing physical conditions. Secure field
measurementsforquantitiesuponwhichproposalisbased. Carefullyexaminetheexisting
conditionsascomparedtotheContractDocuments.
B. Thesubmissionofabidwillbeconstruedasevidencethatsuchaninvestigationhasbeen
made,andnosubsequentallowancewillbemadeinthisconnectiononbehalfofthebidder
foranyerrorornegligence.
C. UponarrivalattheProjectSite,immediatelyproceedtothemainentrance/officeandadvise
theadministrativepersonnelofitspresenceandpurpose. Signthevisitor'slog,givinghis
name,hiscompanyandthetimeanddateofthevisit.
D. Inspection of thework areas shall occur between thehours of 8:00 AMand 5:00 PM. No
inspectionswillbeconductedonSaturdays,Sundays,orholidays.
1.12 BIDSECURITY
A. Bid bond, deposit of cash or a certified check drawn on a bank or trust company insured
by the FDIC in an amount equal to not less than 5% of the gross amount of the bid is
required.
1.13 PERFORMANCEBONDANDLABORANDMATERIALSPAYMENTBOND
A. APerformanceBondandPaymentBondintheamountofthecontractisrequired. Include
thecostofprovidingPerformanceBondandPaymentBondintheBaseBid.
