Advance Contract Award Notice:

An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.

1.        BACKGROUND:

TC ASD is responsible for the provision of aviation services in support of TC operations as well as those of other federal departments and agencies. ASD’s Technical Services Branch provides maintenance services on several types of fixed wing and rotary wing aircraft. Scheduled and unscheduled maintenance services are regularly required on the ASD and clients’ fleets of aircraft across Canada. The maintenance services are required to ensure continuous safe operation in support of ASD’s mandate.

2.        DEFINITION OF REQUIREMENTS:

ASD has a requirement for inspection and maintenance services performed by the Original Equipment Manufacturer (OEM) or an OEM authorized repair facility to return one (1) Pratt & Whitney PW207D engine S/N PCE-BLL0524 and its components and LRU components, to serviceability.

Pratt & Whitney:        PW207D        S/N: PCE-BL0524

Services that may be needed to return the engine, it’s components and LRU components to serviceability could include the following:

a)        Inspection;

b)        Repair;

c)        Overhaul;

d)        Modification;

e)        Testing; and

f)        Recertification

3.        CRITERIA FOR ASSESSMENT OF THE STATEMENT OF CAPABILITIES (MINIMUM ESSENTIAL REQUIREMENTS:

MINIMUM ESSENTIAL REQUIREMENTS

#1        The bidder must demonstrate* that it has experience performing all of the following services in accordance with the specifications of the Original

Equipment Manufacturer (OEM-Pratt&Whitney) on the PW207D2 engine its components and associated line replaceable units (LRU):

•        Inspection

•        Repair

•        Overhaul

•        Modification

•        Testing

•        Recertification

*In order to demonstrate meeting this requirement the Bidder must provide documents** that prove their facility is the OEM or an OEM authorized and certified facility to perform the services listed in this criterion to the PW207D2 and its components and LRUs.

4.        APPLICABILITY OF THE TRADE AGREEMENT(S) TO THE PROCUREMENT:

This procurement is subject to the following trade agreements:

5.        JUSTIFICATION FOR PRE-IDENTIFIED SUPPLIER:

Transport Canada intends to enter into a sole source contract with Standard Aero Limited, 707 Flight Road, Winnipeg, Manitoba, R3H 1C6 Canada for inspection and maintenance services to return ASD’s PW207D2 engine to serviceability.

Standard Aero Limited is reasonably believed to be the only repair station/facility in North America that meets the mandatory essential criteria, is approved, and authorized by the Original Equipment Manufacturer (OEM) to perform the inspection and maintenance services/Work required and accepts the General Conditions 2010C (2022-12-01) Services (medium complexity) included in the resulting contract.

Should Canada receive a statement of capabilities from a supplier that contains sufficient information to indicate that it meets the requirements set forth in this ACAN, a competitive process will be triggered with a technical and financial evaluation methodology of the bids proposed by the potential bidders.

6.        GOVERNMENT CONTRACTS REGULATIONS EXCEPTION:

The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6 (d) that states “only one person or firm is capable of performing the contract.”

7.        EXCLUSIONS AND/OR REASONS TO INVOKE LIMITED TENDERING REASONS

All of Canada’s free trade agreements allow for limited tendering and the following limited tendering

reason contained in the trade agreements is applicable and invoked on the following grounds:

a.        where the goods or services can be supplied only by a particular supplier and no reasonable

alternative or substitute goods or services exist for any of the following reasons (CAP Code 71

Exclusive Rights):

i.        N/A

ii.        the protection of patents, copyrights, or other exclusive rights; or

iii.        due to an absence of competition for technical reasons.

8.        OWNERSHIP OF INTELLECTUAL PROPERTY:

Standard Aero Limited is reasonably believed to be the only repair station/facility in North America that meets the mandatory essential criteria, is approved and authorized by the Original Equipment Manufacturer (OEM) to perform inspection and maintenance services to the PW207D2 and accept the terms and conditions 2010C medium complexity that will be included in the resulting contract.

9.        PERIOD OF THE PROPOSED CONTRACT:

The proposed contract is from date of contract award to March 31st, 2025.

10.        ESTIMATE COST:

The total estimated value of the contract is $500,000.00 CND (Taxes extra, if applicable).

Suppliers who consider themselves fully qualified. available to provide the services described in the ACAN and accept and comply with the 2010C general conditions applicable to this requirement may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.

13.        CLOSING DATE FOR A SUBMISSION OF A STATEMENT OF CAPABILITIES:

The closing date and time for accepting statements of capabilities is November 21, 2024, at 2:00 p.m. EDT.
