TheDepartment is seeking one or more qualified lawyers or law firms (“OutsideCounsel”) to represent the Department’s interests in producing contracts aswell as loan and other related documents for complex, multi-party, multifamily affordablehousing developments receiving funding and assistance from the Department underthe programs described in I.B, above.  Inits response to this RFQ, a successful responder must demonstrate experienceand competence in cross-cutting regulations, including Uniform Relocation Act,Davis Bacon, and various federal energy standards, and working with the above fundingand assistance programs as well as with Community Housing DevelopmentCorporations, affordable housing land use restriction agreements, and all formsof real estate ownership including but not limited to, ground leases andcondominium regimes, and how those programs interact with Texas real estate,lending laws, and the Department’s governing statute in Chapter 2306 of theTexas Government Code.  Additionally, asuccessful responder must be able to demonstrate a capacity to respond quicklyand effectively to comments from parties’ counsel, the Department’s MultifamilyFinance Division staff, and the Department’s legal staff so as to assureclosing at a time requested by the developer.
