Description

The Centers for Disease Control and Prevention (CDC) Office of Acquisition Services intends to award a sole source firm-fixed-price order to Becton, Dickinson and Company for a service maintenance agreement for the following BD Biosciences* Flow Cytometers in support of the CDC’s Immunology and Pathogenesis Branch (NCIRD):

A flow cytometer is a laser-based instrument that measures multiple physical and chemical characteristics of single cells or particles as they flow one by one in a fluid stream past one or more lasers. The three cytometer instruments identified above play a vital role in analyzing samples from ongoing clinical studies for several teams within NCIRD, making their operational integrity essential for the success of research initiatives.





*BD Biosciences is a part of Becton, Dickinson and Company.





NCIRD has a requirement for a Premium Service Plan for the above identified BD Biosciences flow cytometers, consisting of at a minimum: Original Equipment Manufacturer (OEM)-certified preventative maintenance conducted at least twice annually; unscheduled corrective maintenance as required; access to proprietary diagnostic tools; installation of OEM-issued software, firmware, and security updates; use of genuine OEM replacement parts; manufacturer-authorized technical and application support; a maximum 24-hour response time for technical support inquiries; and a maximum 48-hour response time for on-site repair services. Any diagnostics or repairs will be scheduled as necessary for the duration of the plan. These requirements are necessary to ensure uninterrupted support of ongoing clinical studies.





The period of performance for the resultant contract to Becton, Dickinson and Company is as follows:





Base Period: 2/1/2026 – 1/31/2027



Option Period 1: 2/1/2027 – 1/31/2028





Becton, Dickinson and Company is the only source available pursuant to Revolutionary Federal Acquisition Regulation Overhaul Subpart 12.102(a) and 41 U.S.C. as the vendor is the OEM of the above identified BD Biosciences Flow Cytometers. As the OEM, BD Biosciences maintains exclusive ownership and control of proprietary software, firmware, diagnostic utilities, calibration tools, engineering documentation, and specialized replacement parts required to maintain these systems. BD is the only source available to provide fully guaranteed technical support for panel design, experimental planning, and instrument use, including parts and maintenance services, as well as unlimited virtual user support.





Interested parties may identify their interest and submit documentation of their capability to perform the maintenance service requirement.





This notice of intent is not a request for competitive quotations; however, all responses received within the issuance period of this notice will be considered by the Government. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
