SEPARATE SEALED BIDS for furnishing all products, materials and services; and providing all labor, tools,

and equipment will be received by the Owner by U.S. Mail or by courier delivery (e.g. FedEx or courier

delivery service) at the following addresses until 2:00 P.M., local time, on Wednesday, January 8, 2025:

The P. O. Box will be opened at 2:05 P.M. Bids received after the deadline will not be considered and will

be returned unopened after the Bid is made. Unsealed Bids, including facsimile or emailed Bids, will not be

considered.

The Bidder shall provide the Bid Number, Project Name, Contractor Name and Contractor License Number

on the outside of a sealed envelope. Any Bid submitted which does not contain the above information will

not be opened and will be returned to the Bidder. The Bids will be publicly opened and read aloud at

2:30 PM, local time, on said date, in the Financial Services Conference Room, Suite 201 on the 2nd Floor

of the City Administration Building located at 300 Henry Ward Way, SE Gainesville, GA 30501. It is the

responsibility of the person/firm submitting a Bid to ensure that it is received at the physical address above

prior to the stated deadline.

THE PROJECT, Site Work & Infrastructure Improvements for Summit Street Cottages, will involve all site

work and infrastructure improvements shown on the civil engineering plans titled “Construction Drawings for

Summit Street Cottages”. Such work may include, but is not limited to, grading, construction and paving of

streets and driveways; sidewalks; parking pads and steps where applicable, installation and maintenance of

soil erosion and sedimentation controls, and installation of water/sanitary sewer connections and

stormwater management infrastructures.

THIS IS A FEDERALLY-FUNDED PROJECT, FUNDED WITH COMMUNITY DEVELOPMENT BLOCK

GRANT (CDBG) FUNDS. THE CONTRACTOR AND SUBCONTRACTORS MUST COMPLY WITH HUD

PROCUREMENT PROVISIONS IN CFR 24 PART 85.36, EQUAL EMPLOYMENT OPPORTUNITY

REQUIREMENTS, THE COPELAND “ANTI-KICKBACK” ACT, THE DAVIS-BACON ACT, CONTRACT

WORK HOURS AND SAFETY STANDARDS ACT, SECTION 3 OF THE HOUSING AND URBAN

DEVELOPMENT ACT AND OTHER REQUIREMENTS AS SET FORTH IN THE BID DOCUMENTS.

MINORITY AND WOMEN OWNED BUSINESS ENTERPRISES AND SECTION 3 BUSINESS

CONCERNS SEEKING BID OPPORTUNITIES UNDER THIS PROJECT ARE ENCOURAGED TO

RESPOND. THE SECTION 3 GOALS FOR THIS PROJECT ARE 25% OF TOTAL LABOR HOURS ARE

“SECTION 3 WORKER LABOR HOURS” AND 5% OF TOTAL LABOR HOURS ARE “TARGETED

SECTION 3 WORKER LABOR HOURS”.

THIS BID IS FOR WORK RELATED TO A PROJECT THAT IS SUBJECT TO THE BUILD AMERICA,

BUY AMERICA ACT (BABAA) REQUIREMENTS UNDER TITLE IX OF THE INFRASTRUCTURE

INVESTMENT AND JOBS ACT, PUB. L. 177-58. ABSENT AN APPROVED WAIVER, ALL IRON,

STEEL, MANUFACTURED PRODUCTS, AND CONSTRUCTION MATERIALS USED IN THIS PROJECT

MUST BE PRODUCED IN THE UNITED STATES, AS FURTHER OUTLINED BY THE OFFICE OF

MANAGEMENT AND BUDGET’S MEMORANDUM M-22-11, INITIAL IMPLEMENTATION GUIDANCE ON

APPLICATION OF BUY AMERICA PREFERENCE IN FEDERAL FINANCIAL ASSISTANCE PROGRAMS

FOR INFRASTRUCTURE, APRIL 18, 2022.

THE WORK will be awarded in one Contract with a performance period not to exceed two hundred forty

(240) calendar days.

starting Wednesday, November 27, 2024. Bid Documents may be obtained, starting on 12/2/2024,

PRE-BID CONFERENCE will be held for all Bidders on Friday, December 13, 2024 at 10:00 A.M. in the

Station Room, 1st Floor of the City Administration Building located at 300 Henry Ward Way, SE;

Gainesville, GA 30501. Attendance is optional but highly recommended.

A BID BOND in the amount of five percent (5%) of the total base bid shall accompany each Bid submitted.

The Bid Bond shall be prepared on the Bid Bond form attached to the Contract Documents or a Surety

Company's Standard Bid Bond, duly executed by the Bidder as principal and having as Surety thereon a

surety company licensed to do business in the State of Georgia and listed in the latest issue of U.S.

Treasury Circular 570.

THE SUCCESSFUL Bidder for this Contract will be required to furnish a satisfactory, complete Performance

Bond in the amount of one hundred percent (100%) and a satisfactory, complete Payment Bond in the

amount of one hundred percent (100%) of the Bid and insurances per the Bid documents.

THE OWNER reserves the right to reject any or all Bids, to waive informalities and to re-advertise. A

proposal acceptance period of ninety (90) days will follow the bid date.

CLARIFICATIONS Any explanation desired by Bidder regarding the meaning or interpretation of the Bid

Documents shall be requested in writing by 12:00 P.M. on Wednesday, December 18, 2024. All inquiries

Oral explanations or instructions given prior to award are not binding. Any final amendment or addendum

will be published no later than 12:00 P.M. on Friday, January 3, 2025.

ACKNOWLEDGEMENT OF AMENDMENTS

Receipt of any amendment to this Invitation to Bid shall be acknowledged, in writing, and shall be submitted

with the Bid.

TAXES

The Contractor pays all sales, consumer, use, and other similar taxes required by the law of the place

where the Work is performed.

Any information contained in this bid is subject to public disclosure.
