IftheIssuingOfficeentersintoacontractasaresultofthisIFB,itwillbeaEstablishedPriceContractcontract
containingtheContractTermsandConditionsasshowninPartVofthisIFB.
I.3IFB-008.1CNoPre-bidConference(Oct.2006)
Therewillbenopre-bidconferenceforthisIFB. Ifthereareanyquestions,pleaseforwardthemtotheIssuing
Officepriortothebidopeningdateandtime.
I.4IFB-009.1Questions(February2012)
AllquestionsregardingtheIFBmustbesubmittedinwritingtotheemailaddressoftheIssuingOfficerprovidedin
thesolicitation. Whilethereisnosettimelineforthesubmittalofquestions,questionsreceivedwithin48hours
priortothebidduedateandtimewillbeansweredatthediscretionoftheCommonwealth. Allquestionsreceived
willbeanswered,inwriting,andsuchresponsesshallbepostedtoeMarketplaceasanaddendumtotheIFB. The
IssuingOfficershallnotbeboundbyanyverbalinformationnorshallitbeboundbyanywritteninformationthatis
noteithercontainedwithintheIFBorformallyissuedasanaddendumbytheIssuingOffice. TheIssuingOffice
doesnotconsiderquestionstobeaprotestofthespecificationsorofthesolicitation.
I.5IFB-010.1AddendatotheIFB(Oct.2006)
IftheIssuingOfficedeemsitnecessarytoreviseanypartofthisIFBbeforethebidresponsedate,theIssuingOffice
willpostanaddendumtoitswebsiteatWWW.PA.GOV/DGS itistheBidder'sresponsibilitytoperiodicallycheck
thewebsiteforanynewinformationoraddendatotheIFB.
I.6IFB-011.1BSubmissionofBids-ElectronicSubmittal(May2011)
a. Bidsarerequestedfortheitem(s)describedintheInvitationForBidsandallthedocumentsreferencedinthe
form(collectivelycalledtheIFB). BiddersmustsubmittheirbidsthroughtheCommonwealth'selectronic
system(SRM).
b. ItistheresponsibilityofeachbiddertoensurethatitsBidisreceivedthroughtheelectronicsystempriorto
thedateandtimesetfortheopeningofbids("BidOpeningTime"). NoBidshallbeconsideredifitarrivesafter
theBidOpeningTime,regardlessofreasonforthelatearrival.
BidsthataretimelyreceivedpriortotheBidOpeningTimeshallbeopenedpubliclyinthepresenceofoneor
morewitnessesatthetimeandplacedesignatedinthisIFBfortheBidopening.
c. Bidsmustbefirm. IfaBidissubmittedwithconditionsorexceptionsornotinconformancewiththeterms

ThisIFBisbeingmadeavailablebyelectronicmeans. IfaBidderelectronicallyacceptstheIFB,theBidder
acknowledgesandacceptsfullresponsibilitytoinsurethatnochangesaremadetotheIFB. Intheeventofa
conflictbetweenaversionoftheIFBintheBidder'spossessionandtheIssuingOffice'sversionoftheIFB,the
IssuingOffice'sversionshallgovern.
I.9IFB-029.1Prices(Dec62006)
ThebidsubmittedbythesuccessfulBidderwillbeincorporatedintoanyresultingContractandtheBidderwillbe
requiredtoprovidetheawardeditem(s)atthepricesquotedinitsBid.
I.10IFB-030.1ApprovedEqual(Nov2006)
WheneveranitemisdefinedinthisIFBbytradenameandcataloguenumberofamanufacturerorvendor,theterm
'orapprovedequal,'ifnotinsertedtherewithshallbeimplied. Anyreferencetoaparticularmanufacturer'sproduct
eitherbytradenameorbylimiteddescriptionissolelyforthepurposeofmoreclearlyindicatingtheminimum
standardofqualitydesired,exceptwherea'nosubstitute'isrequested. Whena'nosubstitute'isrequested,the
IssuingOfficewillconsiderBidsforthereferencedproductonly. Theterm'orapprovedequal' isdefinedas
meaninganyothermakewhich,inthesoleopinionoftheIssuingOffice,isofsuchcharacter,quality,and
performanceequivalenceastomeetthestandardofqualityofproductsspecifiedforwhichitistobeusedequallyas
wellasthatspecified. ABidderquotingonaproductotherthanthereferencedproductshall: a)furnishcomplete
identificationinitsBidoftheproductitisofferingbytradename,brandand/ormodelnumber;b)furnish
descriptiveliteratureanddatawithrespecttothesubstituteproductitproposestofurnish;andc)indicateanyknown
specificationdeviationsfromthereferencedproduct.
I.11IFB-031.1Alternates(Oct2013)
ABidderwhowantstoofferanalternatemustnotifytheIssuingOfficeinwriting,atleastfive(5)dayspriortothe
scheduledBidopening,thattheBidderintendstoofferanalternateinitsBid. An"alternate"isaproductthat
deviatesfromtherequirementsofthespecificationsinitscomposition,qualities,performance,sizedimension,etc.
ThewrittennotificationfromtheBiddermustincludeacompletedescriptionofthealternateandmustidentifythe
product'sdeviationsfromthespecifications. Uponreceiptofthenotification,theIssuingOfficewilldetermine
whetherthealternateisacceptable. IftheIssuingOffice,initsdiscretion,determinesthatthealternateis
acceptable,theIssuingOfficewillissueachangenoticetotheinvitationforbidsthatrevisesthespecifications. If
nochangenoticeisissuedrevisingthespecification,aBidofferingthealternatewillnotbeconsideredforaward.
IfanitemoritemsintheIFBaredesignated"nosubstitute,"thisprovisiondoesnotapplyandnoalternatemaybe
proposedbyabiddernorwillanyalternatebeconsideredbytheIssuingOffice.

Unlessotherwisespecifiedinthisinvitationforbids,allproductsofferedbyBiddersmustbenewor
remanufactured. A'new'productisonethatwillbeusedfirstbytheCommonwealthafteritismanufacturedor
produced. A'remanufactured'productisonewhich: 1)hasbeenrebuilt,usingneworusedparts,toacondition
whichmeetstheoriginalmanufacturer'smostrecentspecificationsfortheitem;2)doesnot,intheopinionofthe
IssuingOffice,differinappearancefromanewitem;and3)hasthesamewarrantyasanewitem. Unless
otherwisespecifiedinthisinvitationforbids,usedorreconditionedproductsarenotacceptable. Thisclauseshall
notbeconstruedtoprohibitBiddersfromofferingproductswithrecycledcontent,providedtheproductisnewor
remanufactured.
I.13I-IFB-033.1ModificationorWithdrawalofBid(Nov2006)
a. BidModificationPriortoBidOpening. Bidsmaybemodifiedonlybywrittennoticeorinpersonpriortothe
exacthouranddatespecifiedforBidopening.
1) IfaBidderintendstomodifyitsBidbywrittennotice,thenoticemustspecificallyidentifytheBidtobe
modifiedandmustbesignedbytheBidder.TheBiddermustincludeevidenceofauthorizationforthe
individualwhosignedthemodificationtomodifytheBidonbehalfoftheBidder.TheBidmodificationmust
bereceivedinasealedenvelope. ThesealedenvelopemustidentifytheassignedCollectiveNumberandthe
BidOpeningTime,andshouldstatethatenclosedintheenvelopeisaBidmodification
2) IfaBidderintendstomodifyitsBidinperson,theindividualwhowillmodifytheBidmustarriveintheBid
OpeningRoompriortotheBidOpeningTime,showapictureidentificationandprovideevidenceofhis/her
authorizationtomodifytheBidonbehalfoftheBidder. IfaBidderintendstomodifyitsBidinperson,the
Biddermaydosoonlyinthepresenceofanagencyemployee. (Theagencyemployeewillobservethe
actionstakenbytheindividualtomodifytheBid,butwillnotreadtheBidorthemodification).
b. BidWithdrawalPriortoBidOpening. Bidsmaybewithdrawnonlybywrittennoticeorinpersonpriortothe
exacthouranddatespecifiedforBidopening.
1) IfaBidderintendstowithdrawitsBidbywrittennotice,thenoticeshallspecificallyidentifytheBidtobe
withdrawnandshallbesignedbytheBidder. TheBiddermustincludeevidenceofauthorizationforthe
individualwhosignedthebidwithdrawaltowithdrawthebidonbehalfoftheBidder.Exceptasprovidedin
Subparagraphc,below,bidwithdrawalsreceivedaftertheexacthouranddatespecifiedforthereceiptof
Bidsshallnotbeaccepted.
2) IfaBidderintendstowithdrawitsBidinperson,theindividualwhowillwithdrawtheBidmustarriveinthe
BidOpeningRoompriortotheBidOpeningTime,showapictureidentificationandprovideevidenceof
his/herauthorizationtowithdrawtheBidonbehalfoftheBidder.
c. BidWithdrawalAfterBidOpening. BiddersarepermittedtowithdrawerroneousBidsafterBidopeningonlyif
thefollowingconditionsaremet:
1) TheBiddersubmitsawrittenrequestforwithdrawal.
2) TheBidderpresentscredibleevidencewiththerequestthatthereasonforthelowerBidpricewasaclerical
mistakeasopposedtoajudgmentmistakeandwasactuallyduetoanunintentionalarithmeticalerrororan
unintentionalomissionofasubstantialquantityofwork,labor,material,orservicesmadedirectlyinthe
compilationoftheBid.
3) TherequestforreliefandsupportingevidencemustbereceivedbytheIssuingOfficewithinthree(3)
businessdaysafterBidopening,butbeforeawardofthecontract.
4) TheIssuingOfficeshallnotpermitaBidwithdrawaliftheBidwithdrawalwouldresultintheawardofthe
contractonanotherBidofthesameBidder,itspartner,oracorporationorbusinessventureownedbyorin

whichthebidderhasasubstantialinterest.
5) IfaBidderispermittedtowithdrawitsBid,theBiddercannotsupplyanymaterialorlabororperformany
subcontractorotherworkagreementfortheawardedcontractor,withoutthewrittenapprovaloftheIssuing
Office.
d. FirmBid. Exceptasprovidedabove,aBidmaynotbemodified,withdrawn,orcancelledbyanyBidderfora
periodofsixty(60)daysfollowingthetimeanddatedesignatedforBidopening,unlessotherwisespecifiedby
theBidderinitsBid. IfthelowestresponsibleBidder,asdeterminedbytheIssuingOffice,withdrawsitsBid
priortotheexpirationoftheawardperiodorfailstocomplywiththerequirementssetforthintheIFBincluding
butnotlimitedtoanyrequirementtosubmitperformanceorpaymentbondsorinsurancecertificateswithinthe
requiredtimeperiod,theBiddershallbeliabletotheCommonwealthforallcostsanddamagesassociatedwith
there-awardorre-bidincludingthedifferencebetweentheBidder'spriceandtheactualcostthatthe
Commonwealthpaysfortheawardeditems.
e. ClarificationandAdditionalInformation. AfterthereceiptofBids,theIssuingOfficeshallhavetherightto
contactBiddersforthepurposeofseeking:
1) ClarificationoftheBidwhichconfirmstheIssuingOffice'sunderstandingofstatementsorinformationinthe
Bidor;
2) Additionalinformationontheitemsoffered;providedtheIFBdoesnotrequiretherejectionoftheBidfor
failuretoincludesuchinformation.
I.14I-IFB-034.1RejectionofBids(Nov2006)
TheIssuingOfficereservestherighttorejectanyandallBids,towaivetechnicaldefectsoranyinformalityinBids,
andtoacceptorrejectanypartofanyBidifthebestinterestsoftheCommonwealtharetherebyserved.
I.15Submission-001.1RepresentationsandAuthorizations(February2017)
Bysubmittingitsproposal,eachOfferorunderstands,represents,andacknowledgesthat:
A. AlloftheOfferor'sinformationandrepresentationsintheproposalarematerialandimportant,andtheIssuing
Officemayrelyuponthecontentsoftheproposalinawardingthecontract(s). TheCommonwealthshalltreatany
misstatement,omissionormisrepresentationasfraudulentconcealmentofthetruefactsrelatingtotheProposal
submission,punishablepursuantto18Pa.C.S.4904.
B. TheOfferorhasarrivedattheprice(s)andamountsinitsproposalindependentlyandwithoutconsultation,
communication,oragreementwithanyotherOfferororpotentialofferor.
C. TheOfferorhasnotdisclosedtheprice(s),theamountoftheproposal,northeapproximateprice(s)or
amount(s)ofitsproposaltoanyotherfirmorpersonwhoisanOfferororpotentialofferorforthisRFP,andthe
OfferorshallnotdiscloseanyoftheseitemsonorbeforetheproposalsubmissiondeadlinespecifiedintheCalendar
ofEventsofthisRFP.
D. TheOfferorhasnotattempted,norwillitattempt,toinduceanyfirmorpersontorefrainfromsubmittinga
proposalonthiscontract,ortosubmitaproposalhigherthanthisproposal,ortosubmitanyintentionallyhighor
noncompetitiveproposalorotherformofcomplementaryproposal.
E. TheOfferormakesitsproposalingoodfaithandnotpursuanttoanyagreementordiscussionwith,or
inducementfrom,anyfirmorpersontosubmitacomplementaryorothernoncompetitiveproposal.
F. TothebestknowledgeofthepersonsigningtheproposalfortheOfferor,theOfferor,itsaffiliates,
subsidiaries,officers,directors,andemployeesarenotcurrentlyunderinvestigationbyanygovernmentalagency
andhavenotinthelastfouryearsbeenconvictedorfoundliableforanyactprohibitedbyStateorFederallawin

anyjurisdiction,involvingconspiracyorcollusionwithrespecttobiddingorproposingonanypubliccontract,
exceptastheOfferorhasdisclosedinitsproposal.

J. EachOfferor,bysubmittingitsproposal,authorizesCommonwealthagenciestoreleasetothe

workers'compensationliabilities.
K. UntiltheselectedOfferorreceivesafullyexecutedandapprovedwrittencontractfromtheIssuingOffice,
thereisnolegalandvalidcontract,inlaworinequity,andtheOfferorshallnotbegintoperform.
L. TheOfferorisnotcurrentlyengaged,andwillnotduringthedurationofthecontractengage,inaboycottofa
personoranentitybasedinordoingbusinesswithajurisdictionwhichtheCommonwealthisnotprohibitedby
Congressionalstatutefromengagingintradeorcommerce.

II.1 II-IFB-008.1b Lobbying Certification and Disclosure - Electronic Submission. (Oct 2006).
With respect to an award of a federal contract, grant, or cooperative agreement exceeding $100,000 or an award of a
federal loan or a commitment providing for the United States to insure or guarantee a loan exceeding $150,000 all
recipients must certify that they will not use federal funds for lobbying and must disclose the use of non-federal
funds for lobbying by filing required documentation. Offerors must complete and return the Lobbying Certification
Form and the Disclosure of Lobbying Activities Form, which are attached to and made a part of this IFB. The
completed and signed Lobbying Certification Form and the Disclosure of Lobbying Activities Form should be
submitted with the Bid Response. Commonwealth agencies will not contract with outside firms or individuals to
perform lobbying services, regardless of the source of funds.
II.2 IFB-010.1 License Required (Oct 2013)
It is unlawful for any individual, corporation, partnership, association or other entity foreign or domestic to engage
in the business of salesperson, broker, dealer, manufacturer, factory branch, distributor, distributor branch, factory or
distributor representative or wholesaler within COMMONWEALTH unless he has secured a license as required by
Act No. 84 of 1983, known as the Board of Vehicles Act. Before a Contract is awarded to any bidder and before a
bidder sells COMMONWEALTH any vehicle covered by this requisition, he must hold or secure an appropriate
license issued by the State Board of Vehicle Manufacturers, Dealers and Salespersons. Information and/or an

In order to be eligible for award, an offeror must be an Authorized/Franchised dealer representing the manufacturer
of Vehicles offered to the Commonwealth.
II.4 II-IFB-016.1 Post-Submission Descriptive Literature (Dec 2006)
T he Commonwealth may, during its evaluation of the bids, require any bidder to submit cuts, illustrations, drawings,
prints, test data sheets, specification sheets and brochures which detail construction features, design, components,
materials used, applicable dimensions and any other pertinent information which the Issuing Office may require in
order to evaluate the product(s) offered. The required information must be submitted within two (2) business days
after notification from the Issuing Office. Failure to submit the required information prior to the expiration of the
second business day after notification shall result in the rejection of the bid as non-responsive.
II.5 II-IFB-017.1b Reciprocal Limitations Act - Electronic Submittal (February 2007)
This procurement is subject to the Reciprocal Limitations Act. Bidders must complete and submit with the Bid
Response the State of Manufacture Chart , which is contained in GSPUR-89 ("Reciprocal Limitations Act
Requirements") which is attached to and made part of this IFB. The completed State of Manufacture Chart should
