Subject: Fixed Price Contract for the procurement of CROSSLAB SILVER W/OQ ( Preventative Maintenance. Agreement, Qualification Service, Service Calls) for an AGILENT GC/MS, and Agilent HPLC System.

Notice of Intent to Limiting sources to: Agilent Technologies or Agilent Technologies service provider network

Pursuant to the authority of Federal Acquisition Regulation (FAR) Subpart 8.405-6 (a)(i)(1)(B), (only one source can provide the supplies required at the level of quality required because the supplies are highly specialized), the Food and Drug Administration (FDA) intends to award a delivery order to Agilent Technologies service provider network: FedPoint Systems, LLC, Government Scientific Source, Technical Communities and TEVET.

FDA has a requirement to obtain Preventative Maintenance and Qualification Service for an

AGILENT GC/MS, and Agilent HPLC System under Request for Quote FDA-RFQ-25-126020 as a brand name acquisition. This is a Small Business Set Aside.

The Preventative Maintenance and Qualification Service delineated in here entails performance of diagnostic tests and replacement of various instrument parts. The supplier shall be able to install replacement parts that are compliant with original equipment manufacturer (OEM) specifications to ensure safe and effective operation of the instrument. Agilent Technologies, Inc. is the sole equipment manufacturer and ISO 9001-certified source for factory-authorized service for Agilent hardware and software, parts, training, technical support, and at-your-site service and support procedures. Only Agilent service representatives are certified through current and ongoing factory training and hold factory authorization to perform service on Agilent equipment. Agilent does not certify, authorize, or warrant any individuals, third parties, or other equipment manufacturers outside Agilent’s authorized service provider network to provide service or support for any Agilent product. Preventative Maintenance and Qualification Service performed by providers who are not Agilent factory-authorized could: invalidate Agilent’s warranties, and/or lead to irreparable damage, and/or cause safety hazards.

If this Preventative Maintenance and Qualification Service contract is not awarded to Agilent or to Agilent’s service provider network, an alternate contractor will not be able to provide this service since Agilent does not certify, authorize, or warrant any individuals, third parties, or other equipment manufacturers outside Agilent’s authorized service provider network to provide service or support for any Agilent product. Services performed by providers who are not Agilent factory-authorized could: invalidate Agilent’s warranties, and/or lead to irreparable damage, and/or cause safety hazards. Only Agilent representatives and Agilent authorized service providers are able to attend factory training, including update trainings, and to receive ongoing service notes in order to remain certified and authorized.

Without Preventative Maintenance and Qualification Service, the data generated by the instruments would be unreliable and not in compliance laboratory policy. Furthermore, Preventative Maintenance and Qualification Service by an alternate contractor would violate the Agilent instrument warranty

This notice is not a request for competitive proposals. However, any party that believes it is capable of meeting this requirement as stated herein may submit a written capability statement that clearly supports and demonstrates their ability to perform the requirement. Capability statements must be received by the response date and time of this notice. Submissions will be reviewed to determine if they can meet the requirement. A determination by the Government to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government.

It is anticipated that an award will be issued to Agilent Technologies or Agilent Technologies service provider network within approximately fifteen (15) days after the closing date of this notice unless the Government determines that any other organization has the capacity to meet this requirement.
