1 General Scope and Description
1.1 The purpose of this contract is to assist State in properly managing contaminated soil,
groundwater, sediment, waste materials, and regulated materials encountered during the
construction phase of the project and documenting the work.
1.2 State has two subject matter experts (SME) from the Office of Environmental Stewardship
(OES), Contaminated Materials Management Team (CMMT) and Regulated Materials Unit
(RMU)
1.3 State’s Engineer will additionally act as State’s Project Manager (PM).
1.4 State’s Project Management Team (PMT) will include the State’s Engineer, State’s PM, and
State’s Environmental Compliance Manager (ECM).
1.5 Contractor will assist in establishing a communication plan detailing routine notifications
with the State’s PMT and the SMEs, along with contingency communications.
1.6 Contractor will perform monitoring and documentation in accordance with the most current
MPCA, MDA, and/or MDH guidelines available at the time the work is completed, RMU
Special Provisions, CMMT Special Provisions, Response Action Plan (RAP), RAP Addenda,
Construction Contingency Plans (CCP), any regulatory approval conditions, and/or as
directed by a SME.
1.7 Monitoring will include observations of removal, handling, and disposal practices of any
contaminated soil, groundwater, other materials or structures (e.g. tanks), regulated
materials, that are encountered.
1.8 Documentation will include recording locations and depths where contaminated soil,
groundwater, and other regulated materials are initially encountered, stockpile locations,
debris areas, areas of soil reuse, dewatering operations, and disposal facilities.
1.9 Contractor will assist in drafting and/or reviewing soil, groundwater, and/or regulated
disposal documents, in support of the construction contractor’s responsibility, for obtaining
approvals for landfill disposal, recycling, and dewatering discharge permits for management
of contaminated materials, as directed by OES.
2 Project Location, Design and Construction Plans
2.1 State is conducting a long-term plan that includes improvements to address current and
future transportation issues on Interstate (I)-494, from United States (US) 169 to the
Minnesota River. The corridor will be completed in four separate construction projects,
Project One is underway and is anticipated to be completed in 2026. Project Two is
anticipated to begin in 2027 through 2030.
2.2 Project Two will: add E-Z Pass Lanes on I-494 from I-35W to Trunk Highway (TH) 77 in both
directions, add E-Z Pass lanes in in both directions from US 169 to TH 100, reconstruct ramps
and bridges at key interchanges (82nd Street, I-35W, TH 77), and include upgrades to
pavement, upgrade ramps, intersections, sidewalks, and bike/pedestrian infrastructure,
Improve drainage to reduce flooding and runoff, and landscaping, lighting, and community-
informed design features.
3 Scheduling
3.1 Construction Monitoring

3.1.1 Contractor will be prepared to attend up to four annual pre-
construction meeting(s) and up to eight semi-annual meetings (two for
each of the four years of construction) with SMEs to discuss response
actions and annual reporting associated with construction oversight
throughout the project timeline.
3.1.2 Contractor will be prepared to attend regular update meetings with the
construction team and the SMEs while construction activities are
occurring within special provision areas. Assume up to one meeting per
response action/special provision location.
3.1.3 Contractor will work with State to provide support to the construction
office for disposal documentation related to contaminated soil and
groundwater, and regulated materials.
3.1.4 Contractor will assist State in submittals to the appropriate regulatory
agency(s) and obtaining approvals as necessary.
3.1.5 Contractor will work with the State’s Engineer, construction contractor,
and their various subcontractors to coordinate oversight. For routine
oversight needs (such as locations known or documented with a
response action plan, special provisions, or similar document),
Contractor will arrive onsite within 24 hours of being notified to
perform construction oversight. For short notice oversight needs
(changes in schedule, change of conditions, unanticipated, or newly
discovered contaminated or regulated material oversight), Contractor
will arrive onsite within four hours of being notified.
3.1.6 Contractor will contact the State’s Project Engineer/Inspector
periodically to check on the construction contractor’s schedule.
3.1.7 Contractor will provide the status of the project, a minimum of once per
day for each day onsite, or as approved by the appropriate SME.
3.1.8 Daily field logs will be provided, a minimum of once per day for each
day onsite, or as approved by appropriate SME.
3.1.9 Contractor will track time spent on State right of way and City right of
way separately, as appropriate.
3.1.10 Contractor will invoice State monthly or as approved by State’s Contract
Manager. Contractor will mark the last project invoice as final invoice.
3.2 Response Action Plan Addendum (RAP)
3.2.1 Contractor will attend up to one meeting with the CMMT SME to discuss
the proposed RAP/CCP Addendum, if needed, prior to submitting the
draft documents.
3.2.2 Contractor will be prepared to attend up to one meeting(s) with the
CMMT SME and Minnesota Pollution Control Agency (MPCA) Brownfield
or Minnesota Department of Agriculture (MDA) project managers to
discuss the investigation results and written assurances/liability
protections.

4 Contaminated Materials Construction Monitoring
4.1 Excavation Monitoring
4.1.1 Contractor will determine the soil screening criteria to be used and the
limits of soil excavation in consultation with CMMT SME.
4.1.2 Contractor will perform soil monitoring to separate contaminated from
uncontaminated soil during excavation.
4.1.3 Contractor will provide Hazardous Waste Operations and Emergency
Response (HAZWOPER) (29CRF Part 1910.120, aka 40-hr) certified field
personnel who are current with annual refreshers.
4.1.4 Contractor will be able to provide field personnel who are Minnesota
Department of Health certified asbestos inspectors if needed.
4.1.5 Contractor, as directed by the CMMT SME, will assist in reviewing draft
soil and groundwater disposal documents, in support of the
construction contractor’s responsibility, for obtaining approvals for
landfill disposal and/or dewatering discharge permits for the
management of contaminated materials.
4.1.6 Soil Monitoring
4.1.6.1 Contractor will observe and document contaminated
soil within excavation limits.
4.1.6.2 Contractor will be prepared to collect and analyze soil
samples from excavation, if needed.
4.1.6.3 Determination of soil contamination will be based on
field screening measures, Phase II data, and/or as
approved by the CMMT SME.
4.1.6.4 Contractor will observe and document the contents,
location, and general condition of contaminated soil
stockpiles.
4.1.6.5 Contractor will be prepared to collect and analyze soil
samples from stockpiles, if needed.
4.1.6.6 Contractor will notify the CMMT SME and State’s PMT if
stockpiles are proposed to be located outside the
project’s construction limits and/or in poor condition.
4.1.7 Water Monitoring
4.1.7.1 Contractor will observe and document water
encountered within excavation limits, as necessary.
4.1.7.2 Contractor will identify and document the likely source
of water encountered (e.g. surface, groundwater,
runoff, storm, etc.)
4.1.7.3 Contractor will be prepared to collect and analyze water
samples from an excavation, if needed.
4.1.7.4 Determination of water contamination will be based on

visual and olfactory measures, Phase II data, and/or as
approved by CMMT SME.
4.1.8 Construction Dewatering
4.1.8.1 Contractor will observe and document dewatering
activities, methods, and locations, as necessary.
4.1.8.2 At the request and obtaining approval from the CMMT
SME and State’s PMT, Contractor will be prepared to
collect influent and effluent water sample(s) from
treatment system.
4.1.8.3 Determination of contamination will be based on values
in dewatering permit procured by the construction
contractor, or as approved by the CMMT SME.
4.1.9 Underground Structure Removal
4.1.9.1 Contractor will observe and document, up to one
contingency, underground structure removal within
construction limits.
4.1.9.2 Contractor will be prepared to collect and analyze soil
and groundwater samples from excavation, if needed.
4.1.10 Contractor will coordinate with the construction contractor to track all
manifests for contaminated soil to be hauled off site. As the request of
the PMT and confirmed by the CMMT SME, Contractor will sign
manifests, acting as an Authorized Agent of State; batch signing is not
allowed.
4.2 Construction Monitoring Sampling and Analysis
4.2.1 Contractor will collect up to 10 soil samples, up to 10 groundwater
samples, or as directed by the CMMT SME.
4.2.2 Soil samples will be collected from test pits, stockpiles, excavation
sidewalls, and/or bottoms.
4.2.3 Groundwater samples will be collected from dewatering operations
and/or from open excavations or as directed by CMMT SME.
4.2.4 Contractor will perform all analytical sampling in accordance with the
most current MPCA and/or MDA guidelines available at the time the
work is completed, Minnesota Department of Transportation (MnDOT)
Special Provisions, RAP, RAP Addenda, CCP, any regulatory approval
conditions, and/or as directed by CMMT SME. The CMMT SME may
adjust analytical parameters depending on field conditions.
4.2.5 The samples will be analyzed using the applicable laboratory
certification for the analytical parameters identified in this scope of
work.
4.2.5.1 For MPCA-regulated work, the samples will be analyzed
at a Minnesota Department of Health (MDH) certified

fixed based laboratory, which will include its MDH
certification number on analytical reports.
4.2.5.2 For MDA-regulated work, the samples will be analyzed
at a commercial laboratory that has an approved
Quality Assurance/Quality Control (QA/QC) Plan and
analytical methods on file with the MDA.

Contractor will provide approximately 25% laboratory analytical results
within 10 business days of sample submittal (i.e., standard turnaround)
and 75% of results within five business day (rush) in coordination with
the State PMT.
Spatial Data Collection
4.2.8.1 Contractor will collect Global Positioning System (GPS)
locations for all analytical sample locations.
4.2.8.2 Contractor will collect GPS locations of regulated soil
reused on-site.
4.2.8.3 Contractor will collect GPS locations of soil
contamination left in place.
4.2.8.4 Contractor will collect GPS locations of debris left in
place or used as beneficial reuse material.
4.2.8.5 Contractor will use the coordinate system North
American Datum of 1983 (NAD83) Universal Transverse
Mercator Zone 15 North (UTM15N) (Meters).
4.2.8.6 Contractor will provide an electronic excel spreadsheet
of the GPS data.
