NOTICE TO BIDDERS
Sealed bids submitted in duplicate, in a sealed envelope addressed to Ms. Alex Voigt, City Administrator,
City of Geneva with the words "REVERSE OSMOSIS MEMBRANE FILTERS" clearly marked on it, will be
received by the City of Geneva, Illinois until 10:00 a.m. on Monday, August 10, 2026 at the office of the
City Administrator located at 22 South First Street, Geneva, IL 60134, at which time they will be publicly
opened and read aloud for the purchase of 252 Filmtec XLE-440i Reverse Osmosis Membrane Filters
Instructions and specifications are available on the City of Geneva web site. www.geneva.il.us
Bidders shall submit along with their bids, a guaranty equaling 5% of their bid amount. This guaranty must
be in the form of a Bid Bond, Company Check, or Cashier's Check made out to the City of Geneva,
Illinois.
All persons working on this project shall be paid no less than current prevailing wages stipulated by the
Illinois Department of Labor in the County of Kane and/or as determined by a Court of Law having
jurisdiction.
The City of Geneva, Illinois reserves the right to reject any or all bids and waive technicalities.
Bidders may withdraw their proposal if a request is made in writing or in person before the date and time
specified for the opening of the proposals.

INSTRUCTIONS TO BIDDERS
If any Bidder is in doubt as to the true meaning of any part of the specifications, or other contract
documents, Bidder may submit to the Superintendent of Water and Wastewater & Supervisor Water
Supply and Treatment a written request for an interpretation. An interpretation of the matter in question by
issuing an "Addenda". No response to written requests for interpretation will be given that are received
less than 5 business days before the bid opening.

Bids, which are not signed by individuals making them, should have attached thereto a power of attorney
evidencing authority to sign the bid on behalf of the person for whom it is signed.
Bids which are signed for a partnership should be signed by all of the partners or by an attorney-in-fact. If
signed by an attorney-in-fact, there should be attached to the bid a power of attorney evidencing authority
to sign the bid, executed by the partners.
Bids which are signed for a corporation should give the correct corporate name thereof and the signature
of the president or other authorized officer of the corporation manually written below the corporate name
following the word "By________________". If such a bid is manually signed by an official other than the
president of the corporation, a certified copy of a resolution of the board of directors evidencing the
authority of such official to sign the bid should be attached to it. Such a bid should also bear the attesting
signature of the secretary of the corporation and the impression of the corporate seal.
The bidder will be responsible for all errors in the proposal resulting from failure or neglect to conduct an in
depth examination. The City will, not be responsible for any additional cost, expenses, losses or changes
in anticipated profits resulting from such failure or neglect of the bidder.
Bidders shall not take advantage of any errors or omissions in the proposal and advertised contract.
Any errors discovered in the bids received shall be corrected using the unit price submitted. The contract
will be awarded after these adjustments are made.

General Description
The membrane filter elements shall be genuine new, unused, standard 8-inch diameter by 40-inch long,
thin-film composite, spiral-wound type FilmTec XLE-440i, without exception. Specifications to meet
Product Data Sheet.
Elements shall have a reinforced fiberglass outer wrap, and the element's serial number, model number,
and a flow direction arrow shall be clearly marked on each. The membrane shall be a composite material
fabricated of a polyamide type membrane layer on a polysulfone support. Each element shall be iLEC(TM)
interlocking type with O-rings, element-to-vessel connectors with O-rings, and reject seals.
O-rings and reject seals shall be EPDM and shall be standard products available from vendors other that
the element manufacturer.
BONDS
Bid Bond: A 5% Bid Bond, Company Check, or Cashier's Check is required.
TAXES
The City of Geneva is Tax Exempt. Tax Exempt Certificate available upon request.
PREVAILING WAGES
To the extent as required by law, contractors shall comply with the Illinois Prevailing Wage Act, 820 ILCS
130/.01 (the "Act") with rates to be paid, in effect at the time work is performed in the County where the work
is performed. The successful bidder is responsible for posting and issuing current rates to its employees and
subcontractors. For information regarding current prevailing wage rates, please refer to the Illinois
Department of Labor's website at: http://www.state.il.us/Agency/IDOL/rates/Rates.htm . All contractors
and subcontractors rendering services under this contract must comply with all requirements of the Act,
including but not limited to, all wage, notice and record keeping duties.
FREEDOM OF INFORMATION ACT
Contractor acknowledges that the Freedom of Information Act, 5 ILCS 140/1 et seq. (the "Act") places an
obligation on the City of Geneva to produce certain records that may be in the possession of the
Contractor. Contractor shall comply with the record retention and documentation requirements of the
Local Records Retention Act 5 ILCS 160/1 et seq. and the Act and shall maintain all records relating to
this Contract in compliance with the Local Records Retention Act and the Freedom of Information Act
(complying in all respects as if the Contractor was, in fact, the City). Upon notice from the City, Contractor
shall review its records promptly and produce to the City within two business days of said notice from the
City the required documents which are responsive to a request under the Act. If additional time is
necessary to comply with the request, the Contractor may request the City to extend the time to do so, and
the City will, if time and a basis for extension under the Act permits, consider such extensions. In the event
Contractor fails to produce the requested records or fails to produce the requested records within the time
period required above and the City is assessed a fine, fee or penalty for failure to timely comply with the
Act do to Contractor's actions, Contractor shall reimburse City for all fines, fee or penalties, including
reasonable attorney's fees, paid by the City.
WARRANTY
Contractor will supply City Staff with manufacturer's warranty and all associated product manuals.

DELIVERY SCHEDULE
Bidders shall state the date or number of days the delivery of membrane elements will be made after
receiving the signed purchase order.
DELIVERY
Delivery of membrane elements will be made to the Geneva Water Treatment Facility. 4000 Keslinger Rd.
Geneva, IL 60134 between the hours of 7:00 AM to 2:30 PM Monday-Friday except for holidays.
