Description

Notification of Intent to Solicit from a Single Source – HVAC Repair, Waterfield Building (803 Front St., Norfolk, VA) – Utilizing FAR 13.106-1(b)





Purpose: This memorandum documents the Contracting Officer’s determination to solicit from a single source, Griffin HVAC Services LLC, for the urgent repair of the Heating, Ventilation, and Air Conditioning (HVAC) system at the U.S. Army Corps of Engineers, Norfolk District’s main office building (commonly referred to as the Waterfield Building) located at 803 Front Street, Norfolk, VA 23510. This action is in accordance with Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), Soliciting from a single source for purchases not exceeding the Simplified Acquisition Threshold:

(i)Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).





Background & Justification: The Waterfield Building’s HVAC system is currently non-mission capable and unable to maintain a safe and productive working environment. This system failure prevents in-office work and has necessitated a district-wide situational telework approval since 29 May 2025. The immediate repair of the HVAC system is critical to ensure compliance with current Executive Orders mandating federal employee presence in the workplace. The lack of a functional HVAC system directly impacts the District’s ability to fulfill its mission requirements.





Market Research and Competition Attempts: Due to the time-sensitive nature of this requirement, diligent market research was conducted to identify potential vendors capable of providing the necessary HVAC repair services. Initial research identified three (3) General Services Administration (GSA) contractors. The identified vendors were contacted via email requesting information regarding availability and capacity. Despite multiple follow-up phone calls, two (2) did not respond. The third (3rd) responded, indicating they currently lack the capacity to accept additional work. Further research on SAM.gov identified two (2) additional vendors. The same outreach efforts were employed. Only Griffin HVAC Services LLC responded positively, confirming their capacity to perform the required HVAC repairs.



Determination: Based on the urgency of the situation, the comprehensive market research conducted, and the limited vendor responses, it is determined that only one source, Griffin HVAC Services LLC, is reasonably available to provide the necessary HVAC repair services in a timely manner. Therefore, it is in the best interest of the Government to proceed with a singlesource solicitation under FAR Part 13, Simplified Acquisition Procedures (SAP), to Griffin HVAC Services LLC. This approach will minimize disruption to District operations and ensure a swift return to full operational capacity.
