TITLE: TREE REMOVAL PROJECT

The City of Saginaw is soliciting Sealed Bid Proposals for Tree Removal Project with specifications as shown

in bid document. Bids must be received in the Purchasing Office prior to 3:00 PM on the due date to be

considered.

This bid will be considered All or None and No Substitutions will be accepted.

The City of Saginaw does not accept sealed bid proposals via fax or email. Bid documents are available for

download on the City of Saginaw’s web site, www.saginaw-mi.com, under the ‘Commercial Bids’ tab.

‘All or None’ means bidders are required to submit pricing for all years and/or all items requested. Any

proposal submitted that does not meet this requirement may be disqualified. If said bid is not listed as ‘All or

None’, the City reserves the right to split said bid to our best benefit.

‘No Substitutions’ means bidders are required to submit pricing for goods/materials as noted in specifications.

If the bid does not include no substitutions language, the respective bidder can submit pricing for a substitution

and/or alternate. You must identify the brand, model, part number, etc., method or process. Bidders may

include supporting documents. The City reserves the right to determine equivalent.

SPECIFICATIONS:

ALL WORK IS TO BE COMPLETED PER MICHIGAN DEPARTMENT OF TRANSPORTATION 2020

STANDARD SPECIFICATIONS FOR CONSTRUCTION SECTION 201 & 202.

1. All work is to be completed on or by June 30, 2027.

2. All work will be inspected by the City of Saginaw Department of Public Services – Street Division.

3. All locations to be provided by the City of Saginaw Engineering Division.

4. Services include furnishing all labor and equipment necessary for removal work. The contractor shall also be

responsible for the removal/disposal of all chippings, logs and other related debris. Areas of work may include

City rights-of-way adjacent to residential neighborhoods, parks, cemeteries, City- operated buildings, and

County or State rights-of-way located within the City of Saginaw. All work shall be done through the direction of

the Department of Public Services.

5. The Contractor and their employees are expected to respond to the public in a respectable and courteous

manner and may refer citizens to the Department of Public Services and/or Mr. Ronald Rangel, Assistant City

Engineer at (989) 759 -1410 should any issues arise.

6. Work hours shall be 7:00 a.m. to 3:00 p.m., Monday through Friday, or as otherwise approved by the

Department of Public Services. Work on Saturdays, Sundays, or City holidays shall be prohibited unless

specifically approved in advance by the Department of Public Services.

7. Work sites shall be left clean and free of debris at the end of each working day UNLESS permission is given

by the City for extenuating circumstances. Cleanup and disposal of all debris generated from this process shall

be the responsibility of the contractor. Access to residential driveways must be always maintained.

8. Trees removed without the City’s authorization or knowledge will not be paid for and shall be replaced by a

tree of an agreed- upon size and species at Contractor’s expense.

9. Contractor shall coordinate their activities to not interrupt the City of Saginaw’s day to day operations.

10. Contractor is responsible for security of their own tools, equipment, materials, etc. to guard against fire,

theft, vandalism, and/or weather damage.

11. Contractor shall provide barricading to separate work areas from areas open to public.

12. Before starting work, the contractor will give the owner a certificate of insurance completed by a duly

authorized representative of their insurer certifying that at least the minimum coverages required here are in

effect and specifying that the liability coverages are written on an occurrence form and that the coverages will

not be canceled, non-renewed, or materially changed by endorsement or through issuance of other policy(ies)

of insurance without 60 days advance written notice.

13. Where work is carried out on or near local streets or other public thoroughfares, the Contractor shall

schedule work so it causes as little interference as possible with general public traffic, both vehicular and

pedestrian. Street surfaces shall be maintained and kept clean. All signage (including that of a flag person)

shall be in accordance with the Michigan Manual of Uniform Traffic Control Devices in effect at the time of the

work is performed. The Contractor shall take all responsibility for the work and shall provide barricades, traffic

cones, flag person, lights, etc, and take all precautions for preventing injuries to persons and property on or

about the work site. Closing of local street shall not be permitted unless prior arrangements have been made

with the City and coordinated with the proper departments. Traffic control is the responsibility of the contractor,

however, when needed the City may provide additional traffic control support on Major Streets as identified by

the City.

14. The Contractor shall be responsible for initiating, maintaining and supervising all safety precautions in

connection with its services, and shall take all necessary protection to prevent direct or indirect damage, injury

or loss to all persons, property, equipment or materials on the worksite or any who may be affected by the

services performed. In cases of property damage, property shall be restored to its original condition at the

expense of the Contractor and to the satisfaction of the City.

All work being performed must be in full compliance with the most current revisions of the American National

Standards Institute Z-133.1 (ANSI Z-133.1) Standard regarding Tree Care Operations for Pruning, Triming,

Repairing, Maintaining, and Removing Tree and Brush Safety Requirements. The ANSI Z-133.1 standards are

made part of the contract by this reference.

All equipment being used must be in full compliance with the most current revisions of the American National

Standards Institute Z-133.1 (ANSI Z-133.1) Standard regarding Tree Care Operations for Pruning, Triming,

Repairing, Maintaining, and Removing Tree and Brush Safety Requirements. The ANSI Z-133.1 standards are

made part of the contract by this reference.

The contractor shall abide by all MIOSHA rules and regulations.

SHIPPING/HANDLING

All shipping and handling charges and all costs associated with the delivery, installation and/or completion of the

product or service requested must be included in your bid, including but not limited to any titles, fees, and transfer

cost.

VENDOR COMPLIANCE

The City of Saginaw requires bidders to submit documentation furnished by the Purchasing Office indicating

compliance with the Ordinance §14.33. Vendor Compliance Forms must be on file with City of Saginaw

Purchasing Office, 1315 S. Washington Ave, Room #105, Saginaw, Michigan 48601. Forms are available for

EVIDENCE OF BIDDER’S QUALIFICATIONS

Bidders may be required to submit a Statement of Qualification and/or provide satisfactory evidence that they

have been regularly engaged in the business and are reasonably familiar therewith, and that they are fully

prepared with the necessary capital, materials, and machinery to complete the work or to furnish the materials

contracted for to the satisfaction of the City.

CONTRACT ASSIGNMENTS OR TRANSFERS PROHIBITED

The assignment or transfer of a contract, or of interests in the contract, are prohibited unless approved by the

City of Saginaw Purchasing Office, respective City department and City Council.

THIRD PARTY

In the event the awarded bidder uses a third-party company to provide the goods and/or services requested, the

bidder must notify the Purchasing Office before said goods are shipped and/or services provided. At that time,

the City reserves the right to accept or reject the use of a third party. The awarded bidder shall be solely

responsible for payment to the third-party company.

AS NEEDED BASIS

The City reserves the right to request items on an ‘as needed’ basis.

CONTRACTOR COMPLIANCE

Early termination of this Agreement, with or without cause, may be made by the City with thirty (30) days

written notice to the Contractor. Upon any such early termination, Contractor shall tender to the City any work

in progress and submit an invoice to City for any fees for work performed up to the date of termination.

It is expressly understood and agreed that Contractor, and its employees and agents, are independent

contractors. Contractor, and its employees and agents, shall in no way be deemed to be and shall not hold

themselves out as the employees, servants or agents of the City. Contractor, and its employees and agents,

shall not be entitled to any fringe benefits of the City. Contractor shall be responsible for the withholding and

payment of all applicable taxes for its employees and agents, including, but not limited to, income and Social

Security taxes, to the proper Federal, state and local governments. Contractor shall carry workers’

compensation coverage for its employees, to the extent required by law, and shall provide the City with proof of

said coverage, if requested.

Contractor shall provide all services to be performed under this Contract in complete compliance with all

applicable federal, state and local laws, ordinances, rules and regulations, including those laws prohibiting

discrimination of any protected class. The laws of the State of Michigan shall control the provisions of this

Contract, and any dispute hereunder shall be in the jurisdiction of the Michigan courts.
