MILLBURN TOWNSHIP

MILLBURN CHARTER STUDY COMMISSION

On April 15, 2026, the Millburn Charter Study Commission (the “Commission”) adopted its final report. A copy of the report is available for download in the “Charter Study Commission” section of the Township’s website, www.twp.millburn.nj.us , Charter Study Commission page direct link, https://www.twp.millburn.nj.us/813/Charter-Study-Commission , and is on file at the Township Clerk’s Office located at 22 East Willow Street, Millburn during regular business hours.

Pursuant to the Report, the Commission has recommended and directed that a public question should be placed before the voters at a special election to be held on June 16, 2026, asking whether Millburn should adopt the Council-Manager Form of Government upon the terms set forth in the proposed public question.

The public question reads specifically as follows:

Shall the COUNCIL-MANAGER PLAN of the Optional Municipal Charter Law, with SEVEN (7) council members to be ELECTED AT-LARGE for STAGGERED terms at NON-PARTISAN elections held in NOVEMBER, with the MAYOR ELECTED BY THE COUNCIL FROM AMONG ITS MEMBERS, be adopted by the Township of Millburn?

The explanatory statement provides as follows:

The voters of Millburn are asked whether to approve a change in Millburn’s form of government from the Township Form to the Council-Manager form under NJ’s Optional Municipal Charter Law (Faulkner Act).

If approved, Millburn will be governed by a Council of seven (7) members elected at-large to staggered four (4) year terms through non-partisan elections held every other November, beginning on November 3, 2026.

The Council as a body shall possess the Township’s legislative powers and shall determine all matters of policy for Millburn. The Council shall appoint a professional Municipal Manager, who will exercise all executive and administrative powers. The Municipal Manager shall serve at the will of the Council. Currently, executive authority is exercised in part by a Business Administrator appointed under local ordinance.

Similar to the current Township Form, the Mayor will be selected from among the Council by a majority of its members. Beyond possessing certain appointment powers and serving as the Chair of the Council, the Mayor is an equal voting member of the Council.

If a change of government is approved by the voters, the first municipal election will be held for all seven (7) Council members at the General Election on November 3, 2026, and the new Council will be installed on January 1, 2027. After the initial election, there will be either four (4) or three (3) Council seats up for election every other November.
