REQUEST FOR QUOTATIONS (RFQ)
FOR HARMONY PARK BATHROOM
The City of Newton, Iowa, is seeking competitive quotations for the public improvement
hereafter described. Contractors qualified to perform the work are invited to submit
competitive quotations, pursuant to the requirements of Section 26.14 of the Iowa Code.
1. Description of the Public Improvement Work to be Performed Pursuant to
This Solicitation.
The public improvement work for which the city is seeking competitive quotations is
generally described as follows:
Harmony Park Bathroom Install
The public improvement consists of site preparation for the placement of a pre-
manufactured bathroom. The contractor shall:
• Excavate and dispose of 55 CY of soil
• Provide, place, and compact 55 CY of granular backfill
• Install sewer and water stubs by a licensed professional
• Connect all utilities to the structure once the building is placed, including water,
sewer, and floor drains
• Provide all labor, equipment, tools, and incidentals necessary to complete the
project
The work shall commence upon issuance of the Notice to Proceed, and shall be
completed on or before May 31, 2026.
2. Plans and Specifications.
Plans and specifications for Harmony Park Bathroom are available for inspection in the
office of the Community Development Director, 303 W 4th St N, Suite 501, Newton,
Iowa, or by contacting the Community Development office at 641-792-6622 ext. 2318
3. Site Visit.
Interested contractors are further advised that a site visit may be arranged by contacting
Brandon Schakel, Engineering Tech., at 641-792-6622 ext. 2318.
4. Time, Place and Manner for Filing Competitive Quotations.
Competitive quotations for Harmony Park Bathroom shall be filed in one of the below
manners to the office of the Community Development Director 303 W 4th St N, Suite
501, Newton, Iowa, on or before 10:00 am on March 18th, 2026.
(1) placing them in the United States Mail, appropriately stamped and addressed
to the Community Development Director office at the City of Newton, 303 W 4th
St N, Suite 501, Newton, Iowa 50208;
(2) filing them in person / in hand at the office of the Community Development
Director’s office at the address listed above;
5. Competitive Quotations to be Submitted on Form Provided.
Competitive quotations shall be filed on the Competitive Quotation form provided by the
City and included with this RFQ. Competitive quotations that are filed in any other form
shall be determined to be non-responsive and shall be rejected by the City.
6. Costs to be Included in Competitive Quotations Submitted by Contractors;
Documentation of Certain Costs.
Interested contractors are required to include in their competitive quotations the price for
labor, equipment, and supplies required to perform the work.
7. Quotation and Evidence of Insurance Required.
Each contractor submitting a quotation pursuant to this RFQ shall include with its
quotation a certificate or certificates of insurance, evidencing insurance with coverage in
amounts as required by the City.
8. Project Notes.
- Execution of the City’s standard contract.
- Completion of work May 31, 2026.
- Compliance with all manufacturer installation requirements.
9. Sales Tax.
The City will issue special sales tax exemption certificates to the contractor awarded the
contract to perform the work and to its subcontractors, pursuant to Iowa Code Section
422.42, (15) and (16) and Iowa Code Section 422.47 (5). The contractor awarded the
contract for the work and its subcontractors should present such certificate when
procuring materials and equipment for the project, and should not pay sales tax for such
materials and equipment. Accordingly, the contractor should not include sales tax in its
competitive quotation for the work. The city will not accept contractor claims for
reimbursement of sales tax, will not attempt to obtain a refund of sales taxes paid from
the State of Iowa, and will not reimburse the contractor for any sales taxes mistakenly
paid by it or its subcontractors.
10. Evaluation of Competitive Quotations.
If a quoting contractor does not submit its quotation on the form required by the
governmental entity, or does not provide all information or documentation or make all
commitments required by the governmental entity, or does not cause said form to be
executed as required by the governmental entity, said quotation shall be determined to
be non-responsive and shall be rejected by the governmental entity.

11. Completion Date and Liquidated Damages.
The Contractor hereby agrees to fully complete the project by May 31, 2026, and to pay
liquidated damages for noncompliance with said completion provisions at the rate of Two
Hundred dollars ($200) for each calendar day thereafter that the work remains
incomplete.
12. Execution of Contract Upon Acceptance and Evidence of Insurance.
Upon the City’s determination of which contractor has submitted the lowest responsive,
responsible quotation, the City will take action to award the contract to that contractor,
conditioned upon the contractor’s submission, and the City’s approval, of the contractor’s
evidence of insurance, and further conditioned upon the contractor’s execution of a
contract in the form provided by the City.

THIS CONTRACT, made and entered into at Newton, Iowa this

, by and between the City of Newton by its Mayor, upon order of its City Council
hereinafter called the "Jurisdiction," an
, hereinafter called the "Contractor."
WITNESSETH:
The Contractor hereby agrees to complete the work comprising the below referenced
improvement as specified in the contract documents, which are officially on file with the
Jurisdiction, in the office of the Community Development Director. This contract includes all
contract documents. The work under this contract shall be constructed in accordance with the
2025 Edition of the SUDAS Standard Specifications, the 2025 City of Newton Supplemental
Specifications to said SUDAS Standard Specifications and as further modified by the
supplemental specifications and special provisions included in said contract documents, and the
Contract Attachment - Item 1: General, which is attached hereto. The Contractor further agrees
to complete the work in strict accordance with said contract documents, and to guarantee the
work as required by law, for the time required in said contract documents, after its acceptance
by the Jurisdiction.
This contract is awarded and executed for completion of the work specified in the contract
documents for the bid prices shown on the Contract Attachment - Item 2: Bid Items, Quantities, and
Prices, which were proposed by the Contractor in its proposal submitted in accordance with the
Notice to Bidders and Notice of Public Hearing for the following described improvements:

1. All Contractors: The Contractor shall enter its Public Registration Number __ __ __ __ __ - __ __
issued by the Iowa Commissioner of Labor pursuant to Section 91C.5 of the Iowa Code.
2. Out-of-State Contractors:
A. Pursuant to Section 91C.7 of the Iowa Code, an out-of-state contractor, before commencing
a contract in excess of five thousand dollars in value in Iowa, shall file a bond with the division
of labor services of the department of workforce development. It is the contractor’s
responsibility to comply with said Section 91C.7 before commencing this work.
B. Prior to entering into contract, the designated low bidder, if it is a corporation organized under
the laws of a state other than Iowa, shall file with the Engineer a certificate from the Secretary
of the State of Iowa showing that it has complied with all the provisions of Chapter 490 of the
Iowa Code, or as amended, governing foreign corporations.
