The Naval Air Systems Command (NAVAIR), NAS Patuxent River, MD, intends to issue a Delivery Order (DO) on a sole source basis to BAE Systems Information and Electronic Systems Integration (BAE), Hudson, NH under Basic Ordering Agreement (BOA) N0001921G0003. The purpose of this effort is to procure all non-recurring engineering products and support for step one of a two step Engineering Change Proposal, required to incorporate the current Air to Air software into the existing Single Variant Block Upgrades (SVBU) Advance Precision Kill Weapon System (APKWS) production line, exportability of SVBU Air to Air variant, and exportability of Legacy Air to Air variant. This action is anticipated to be awarded in FY 2025.
This requirement will be procured in accordance with the statutory authority permitting other than full and open competition under 10 U.S.C. 3204(a)(1), as implemented by FAR 6.302-1, “Only one responsible source and no other supplies or services will satisfy agency requirements.”
As the sole designer, developer, manufacturer, and integrator of the Advance Precision Kill Weapon System (APKWS), BAE is the only source that possesses the engineering data, technical skills, and requisite knowledge of the design, fabrication, performance, and operational characteristics of the APKWS required to perform the necessary production efforts within the required timeframes and without substantial duplication of costs. No other source has the technical qualifications and necessary resources to perform the work described herein, nor will any other supplies or services satisfy the Government’s requirements.
