It is understood and agreed that the drawings released pursuant to this agreement and in machine
readable form are instruments of professional service intended for one-time use in the construction of
the project for which civil drawings were prepared. The recipient understands that these are civil design
drawings. They are not as-built drawings and inaccuracies between these drawings and the actual field
conditions may exist.
Also because of the possibility that information delivered in machine readable format may be altered,
whether inadvertently or otherwise, the recipient agrees to assume all risks associated therewith and to
hold harmless and indemnify JLA from and against all claims, liabilities, losses, damages, and costs,
including attorney's fees, arising therefrom or in connection therewith. The foregoing indemnification
applies, without limitation, to any use of the provided information.
