Governing Minnesota Nursery Law (Chapter 18H)
•        Vendors must hold a valid Minnesota Nursery Certificate issued by the Commissioner of Agriculture.
•        Certificates must be current through December 31, 2026, for Year One procurement (September 2026 – June 2027).
•        All nursery stock must comply with the American Standard for Nursery Stock (ANSI Z60.1). Trees must be measured and specified according to the standard’s requirements for caliper, height, branching, and container size. Stock must be correctly identified by genus, species, and cultivar, and substantially free of damaging insects and diseases.
•        Out of state suppliers must provide an official certificate of inspection from the originating state or federal agency.
•        Certificates must be available for inspection and included with bid documentation.

Project Summary: The City of Monticello is purchasing 423 trees under the MNDNR ReLeaf

Year One Scope (September 2026 - June 2027)
* Supply of 423 trees
* 1-2" caliper stock in 20-gallon containers
* Must meet ANSI Z60.1 nursery standards
* Delivered with one-year warranty and phytosanitary certification
* Delivery Schedule: Multiple deliveries will be required during Year One to align with
planting windows and site readiness. Deliveries will be made to the Parks Maintenance
Shop at 303 West 6th Street in Monticello, MN. Delivery dates will be scheduled by the
Parks Superintendent.

* End Date Requirement: All Year One tree deliveries must be completed by June 1, 2027.
There are no completion date requirements for subsequent year tree deliveries.
Species Diversity
The City of Monticello will require a mix of overstory shade trees and understory ornamental
trees to support canopy resilience, site-specific diversity, and ReLeaf Program goals.
* Overstory species provide long-term structure, shade, and stormwater benefits.
Approved species include oaks, lindens, elms (disease-resistant cultivars), hackberry,
ginkgo, honeylocust, coffeetree, Shagbark Hickory, and Catalpa.
* Understory species are needed for boulevards, residential areas, and sites with
overhead utilities or limited space. Approved species include chokecherry, serviceberry,
ironwood, pagoda dogwood, and hawthorn.
Ultimately, all tree selections, substitutions, and species placement will be guided by the City of
Monticello Tree Manual and must receive approval from the Minnesota Department of Natural
Resources (MNDNR) under the ReLeaf Program.
All stock must be correctly identified by genus, species, and cultivar, and must comply with
ANSI Z60.1 nursery standards.

Contract Term (Three-Year Agreement)
* Contract duration, August 25, 2026 - August 25, 2029.
* After Year One procurement, contractor remains available under the extended contract
to provide additional trees for Monticello's ongoing EAB replacement projects.
* This ensures continuity of supply and sustained investment in the community's green
infrastructure.

Consideration of Bids
1) The City reserves the right to accept or reject any or all bids or any part of any bid,
to waive minor defects or technicalities, or to advertise for new bids, as it may deem
best for its interest.
2) The bid shall be in ink or typed.
3) In case of difference between written words and figures in a bid, the amount stated
in written words shall govern.

4) In case of unit price difference from an extended figure, the unit price shall govern.
5) Alterations or erasures must be crossed out and the corrections thereof printed in
ink or typewritten adjacent thereto. The corrections must be initialed in ink by each
person signing the Bid.
6) Changes to the bid form may cause rejection of said bid.
7) All bids must comply with and not deviate from the provisions of the specifications
and/or other bid or contract documents, if any.
8) If any questions or interpretations, discrepancies, omissions or conflicts occur
during the examination of contract documents, the Contractor shall submit a
request for interpretation not less than seven (7) working days prior to the due date
for bids. Any interpretation or changes of the documents will be made only by
addendum. The City will not be responsible for any oral instructions or
interpretations.
9) Revisions or interpretations made by the City shall be issued by addendum before
the due date set for bids.
Withdrawal/Modification of Bids
1) Delivered bids may be withdrawn by written request dispatched by the Contractor
and received in the normal course of business prior to the time fixed for opening.
2) Delivered bids may be modified by written request dispatched by the Contractor in
time for delivery in the normal course of business prior to the time fixed for opening
provided it is received prior to the time set for bid opening.
3) Any written request for withdrawal or modification must be signed in the same
manner by the same person who signed the bid.
4) All bids once opened shall be held firm until the award has been made. No bid may
be withdrawn for a period of ninety (90) days from the official opening thereof.
5) Contractors are cautioned that emailed, telegraphic and faxed modifications of bids
are prohibited.
Incorporation Into Contract
The City reserves the right to incorporate this Request for Bids and the Contractor's response
(or portions of either) into subsequent contract by reference or otherwise.
Contract and Termination
* The City will award the contract to the lowest responsible bidder based on qualifications,
experience with similar municipal or grant-funded projects, schedule, compliance, cost,
references and performance history, and responsiveness to RFB.

* The City retains the right to terminate the contract with seven (7) days' notice for non
delivery, non-compliance with statutory requirements or contract, or if DNR grant funding
is terminated. Failure to maintain necessary licenses and/or insurance coverage is
grounds for termination of the Contract. The contract could be terminated upon mutual
agreement between the Owner and the Contractor, provided that at least 30 days' notice
is given by either party prior to termination.
Insurance & Legal Requirements
* Contractors must maintain statutory worker's compensation and liability
insurance as required under Minnesota law.
* Commercial General Liability
Bodily Injury: $2,000,000 per occurrence
$2,000,000 aggregate
Property Damage: $2,000,000 per occurrence
$2,000,000 aggregate
* Comprehensive Automobile Liability (Including Owned, Hired & Non-Owned
Automobiles.
Bodily Injury: $1,000,000.00 each person
$1,000,000.00 each accident
* Property Damage: $1,000,000.00 each occurrence
Contractor's insurance must be "Primary and Non-Contributory"
* All insurance policies (or riders) shall be (i) taken out by and maintained with
responsible insurance companies organized under the laws of one of the states
of the United States and qualified to do business in the State of Minnesota, (ii)
shall name the City, its employees and agents as additional insureds (CGL and
umbrella only) by endorsement which shall be filed with the City. A copy of the
endorsement must be submitted with the certificate of insurance.
* Policies and Certificate of Insurance shall contain a provision that coverage
afforded under the policies shall not be cancelled without at least thirty (30)
days' advanced written notice to the City, or ten (10) days' notice for non-
payment of premium.
* An Umbrella or Excess Liability insurance policy may be used to supplement
policy limits on a follow-form basis to satisfy the full policy limits

* Contractor must comply with all applicable local and state laws, rules, and
regulations.
Contract Execution & Payment
The contract will be executed upon City Council award and runs through August 25, 2029. Year
One will require multiple deliveries to align with planting windows and site readiness. Delivery
schedules will be coordinated by the Parks Superintendent based on project needs. All Year One
deliveries must be completed by June 1, 2027.
The Contractor shall invoice the City within 30 days after completion of the delivery at the rates
agreed to in the contract. The City shall make payment within 35 days after receipt of a
complete, itemized invoice unless other terms are outlined in the contract. City Council
meetings are held on the second and fourth Mondays of each month, and final invoices must be
submitted at least one week before a City Council meeting.
DISCRIMINATION PROHIBITED
State law provides that: "Every contract for or on behalf of the state of Minnesota, or any
county, city, town, township, school, school district, or any other district in the state, for
materials, supplies, or construction shall contain provisions by which the Contractor agrees":
1) That, in the hiring of common or skilled labor for the performance of any work under any
contract, or any subcontract, no contractor, material supplier, or vendor, shall, by reason of race,
creed, or color, discriminate against the person or persons who are citizens of the United States
or resident aliens who are qualified and available to perform the work to which the
employment relates;
2) That no contractor, material supplier, or vendor, shall, in any manner, discriminate against, or
intimidate, or prevent the employment of any person or persons identified in clause (1) of this
section, or on being hired, prevent, or conspire to prevent, the person or persons from the
performance of work under any contract on account of race, creed, or color;
3) That a violation of this section is a misdemeanor; and
4) That this contract may be canceled or terminated by the state, county, city, town, school
board, or any other person authorized to grant the contracts for employment, and all money
due, or to become due under the contract, may be forfeited for a second or any subsequent
violation of the terms or conditions of this contract. (Section 181.59 Minnesota Statute)

1. The undersigned Contractor proposes and agrees, if this Bid is accepted, to enter into an
Agreement with the City of Monticello in the form included in the Request for Bid documents,
and to perform all work as specified or indicated in the Request for Bid documents for the prices
and within the times indicated in this Bid and in accordance with the other terms and
conditions of the Bid documents.
2. Contractor accepts all terms and conditions of the Request for Bid. This Bid will remain
subject to acceptance for 90 days after the Bid opening.
3. In submitting this Bid, the Contractor represents that:
a. Contractor has examined and carefully studied the Request for Bid documents, and any
data and reference items identified in the Request for Bid documents, and hereby
acknowledges receipt of the following addenda:

b. Contractor is familiar with and is satisfied as to all laws and regulations that may affect
cost, progress, and performance of the work.
c. Request for Bid documents are generally sufficient to indicate and convey understanding

that the Contractor has complied with all of the requirements of this paragraph, and that
without exception the Bid and all prices in the Bid are premised upon performing and
furnishing the work required by the Request for Bid documents.
4. The Contractor certifies that:
a. This Bid is genuine and not made in the interest of or on behalf of any undisclosed
individual or entity and is not submitted in conformity with any agreement or rules or
any group, association, organizations, or corporation,
b. Contractor has not directly or indirectly induced or solicited any other Contractor to
submit a false or sham Bid;

c. Contractor has not solicited or induced any individual or entity to refrain from
submitting a Bid; and
d. Contractor has not engaged in corrupt, fraudulent, collusive, or coercive practices in
competing for the contract. For the purposes of this paragraph:
i. "corrupt practice" means the offering, giving, receiving, or soliciting of anything
of value likely to influence the action of a public official in the Bid process;
ii. "fraudulent practice" means an intentional misrepresentation of facts made (a)
to influence the Bid process to the detriment of the LMRWMO, (b) to establish
Bid prices at artificial non-competitive levels, or (c) to deprive the LMRWMO of
the benefits of free and open competition;
iii. "collusive practice" means a scheme or arrangement between two or more
Contractors, with or without the knowledge of the City, a purpose of which is to
establish Bid prices at artificial non-competitive levels; and
iv. "Coercive practice" means harming or threatening to harm, directly or indirectly,
persons or their property to influence their participation in the Bid process or
affect the execution of the Contract.
