Notice Inviting Bids

1.       Bid Acceptance and Opening. The City of Tracy (“City”) will accept sealed bids for its CIP 73193 Tracy Boulevard Pavement Rehabilitation Project FY 23/24 (“Project”), by or        before Tuesday, August 26, 2025, at 2:00 p.m., at the City Clerk’s Office, 2 nd Floor, 333 Civic Center Plaza, Tracy, California, 95376. Bids will be publicly opened immediately thereafter.

2.      Location and Description. The Project is located at Tracy Boulevard between Lowell Avenue and Grant Line Road. Work includes Pavement repair, Pavement grinding and overlay, Pavement striping, Pavement markings, curb and gutter repair, concrete sidewalk repair, ADA curb ramp installation, driveway installation and modification, utility frames and covers adjustment to grade, APS Push button installation, and relocation of existing Push Button.

3.       Time for Completion. The planned timeframe for work is between September 2025 and October 2025. Contract time to be forty-five (45) calendar days.

4.       License. In accordance with the California Public Contract Code 20103.5 when federal funds are involved in local agency contracts, no bid shall be invalidated by the failure of the bidder to be licensed in California at the time of bid opening. However, at the time of award, the selected contractor shall be properly licensed in accordance with the laws of the State and the City of Tracy. Contractor shall possess a valid Class A, General Engineering Contractor license prior to award of Contract or other license qualifying the bidder to bid as a prime Contractor, prior to award of Contract, as approved by the Council. The said license shall be maintained during the contract period. It is the Bidder’s and Contractor’s responsibility to obtain the correct Contractor’s licenses. Bidders shall be skilled and regularly engage in the general class or type of work called for under this contract.

5.       DIR Registration. Contractor must submit proof of DIR Registration with a Bid Proposal.

6.       Contract Documents. Bids are required for the entire project work and shall be made upon the Bid Forms in accordance with the Instructions to Bidders. Bid Documents and Addenda can be viewed, downloaded, and printed for submittal from QuestCDN - Construction DataNetwork: 9788097

7.        Prevailing Wage Requirements. The work is to be done in San Joaquin County. Pursuant to California Labor Code Section 1773, the City has ascertained the General Prevailing Rate of Wages in the County in which the work is to be done to be as determined by the Director of Industrial Relations of the State of California. The Contractor is hereby made aware that information regarding prevailing wage rates may be obtained from the State Department of Industrial Relations and/or the following website address: http://www.dir.ca.gov/dlsr/DPreWageDetermination.htm . The Contractor is required to post a copy of the applicable wage rates at the job site. Attention is directed to Section 7 “Legal Relations and Responsibility” of the Standard Construction Specifications.

8.       Bonds. The successful bidder will be required to provide performance and payment bonds, each for 100% of the maximum Contract Price, and a warranty bond for 10% of the maximum Contract Price.

9.       Substitution of Securities. Substitution of appropriate securities in lieu of retention amounts from progress payments is permitted under Public Contract Code section 22300.

10.      Subcontractor List. A completed Subcontractor List form must be submitted with the Bid Proposal in accordance with the Instructions to Bidders.

11.      DBE. The Disadvantaged Business Enterprise (DBE) goal is 54%.

12.      Non-Discrimination.The City will affirmatively ensure non-discrimination on the basis of one or more of the following: race, religious creed, color, national origin, ancestry, physical disability, mental disability, medical condition, genetic information, marital status, sex, age, sexual orientation, or military and veteran status in the award and administration of contracts that it awards.

13.      Buy America. Buy America Requirements will be applicable to this project.

14.      Bid Rigging.The U.S. Department of Transportation (DOT) provides a toll-free “hotline” service to report bid rigging activities. Bid rigging activities can be reported Mondays through Fridays, between 8:00 a.m. and 5:00 p.m., Eastern Time, Telephone No. 1-800-424-9071. Anyone with knowledge of possible bid rigging, bidder collusion, or other fraudulent activities should use the “hotline” to report these activities. The “hotline” is part of the DOT’s continuing effort to identify and investigate highway construction contract fraud and abuse and is operated under the direction of the DOT Inspector General. All information will be treated confidentially, and caller anonymity will be respected.
