Description

The National Institute of Standards and Technology (NIST) Acquisition Management Division intends to negotiate a firm fixed price contract on a sole source basis with Burdette Koehler Murphy Associates Inc. (BKM) for the procurement of Post Construction Award Services (PCAS) for the building 215 Clean Room HEPA Filter Replacement Construction Project. The statutory authority for this sole source acquisition is 41 U.S.C. 3304(a)(1), as implemented in Federal Acquisition Regulation Subpart 6.302-1.



The purpose of this contract is to provide follow-on A/E PCAS services during construction of the Building 215 Clean Room HEPA Filter Replacement Project. Services shall include contract administration and some quality assurance inspection.



In 2019, NIST solicited proposals from all NANO-FAB Architect-Engineer (A-E) Indefinite Delivery, Indefinite Quantity (IDIQ) Contract awardees, the scope of which included providing specialized Nano-facility and tool installation design. Technical evaluations and award recommendations were made based upon the entire scope of work which did not include optional PCAS services.



As a result of that competition, a NIST Contracting Officer awarded Task Order SB1341-14-CQ-0013/1333ND19FNB195371 to Burdette Koehler Murphy Associates Inc. (BKM), UEI# GKK6JE2LNQK5. Through that task order, the Contractor performed A-E design services and prepared plans and specifications to be utilized by a construction contractor however, due to funding limitations, NIST did not award a construction contract.



Now that funds have become available, the OFPM requires an A-E firm to provide PCAS during construction that will rely on the design prepared by Burdette Koehler Murphy Associates Inc. and provided to NIST under Task Order No. SB1341-14-CQ-0013/1333ND19FNB195371.



The State of Maryland requires Professional Engineers to stamp/seal and sign drawings, and because Burdette Koehler Murphy Associates Inc. is the designer of record, NIST seeks to contract with them on a single source basis to provide the required Post Construction Award Services (PCAS).



The PCAS Contractor shall provide all personnel, equipment, supplies, transportation, tools, materials and expertise needed to perform the required services which includes:



1. On-site construction observation and inspection.



2. Resolving design issues that may arise during construction.



3. Attending bi-weekly construction progress meetings.



4. Reviewing submittals, shop drawings, material samples, test reports and manufacturer certifications.



5. Providing consultation (Field and In-Office) to the appointed Contracting Officer’s Representative (COR).



6. Providing draft responses related to construction Requests for Information (RFI’s), along with cost estimates as may be requested by NIST.



7. Preparing drawings and specifications related to possible contract modifications.



8. Traveling associated with the field visits to the construction site.



9. Performing field inspections and submitting reports.



10. Performing inspection services and preparing punch lists as necessary.



11. Supporting and coordinating the commissioning of steam boilers.



12. Preparing and submitting as-built record drawings.



The North American Industry Classification System (NAICS) code for this acquisition is 541330 and the size standard is $25.5 Million.



No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, all responsible sources interested may identify their interest and capability to respond to this requirement. The Government will consider responses received by established due date/time set forth in this notice. Inquiries will only be accepted via email to tamela.lewis@nist.gov. No telephone requests will be honored.



A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for determining whether to conduct a competitive procurement in the future.
