The Village of Westmont is the only authorized source of bidding documents/proposal forms.
Bidding documents/proposal forms obtained from any other source may be an incomplete set of
documents. Bidders are advised to contact the Village of Westmont to provide a contact name,
mailing address, phone number and email address to obtain a complete set of bidding
documents and to enable receipt of necessary addenda. Reproduction of these documents
without the express permission of the Village of Westmont is prohibited.
Please note that there is a Bid Worksheet associated with this bid, which is formulated in

DESCRIPTION OF WORK
This work involves removal and replacement of existing sidewalk and curb at various locations
in the Oakwood Subdivision neighborhood that have been identified as in need of repair, as well
as associated restoration.
BID OPENING
The deadline for submitting a bid is MONDAY, AUGUST 24, 2026, at 10:00 a.m. All necessary
documents are available through Demandstar or the Village's website. Any incomplete
submittals may be rejected as non-responsive. For questions regarding bid submittal, contact

BID SECURITY
Bid security in the form of a certified check or cashier's check payable to the Village of
Westmont, or a satisfactory bid bond, in the amount of Ten Percent (10%) of the total bid must
be submitted with the bid response. During the bid review process, the Village may require a
bidder to submit the original bid security to confirm authenticity. Failure to provide original bid
security upon request may result in rejection of bid.
TERMS AND CONDITIONS
The General Terms and Conditions as included in this bid specification.
INSURANCE REQUIREMENT
A Certificate of Insurance and policy endorsements are required before the award of the
contract. The Certificate of Insurance and policy endorsement must be consistent with the
requirements in Section 38 of the Village''s General Terms and Conditions and Instructions.
INSURANCE WITH ADDITIONAL INSURED REQUIREMENT
Section 38 of the Village of Westmont General Terms and Conditions and Instructions to
Bidders is modified as follows:
(E) 1. The Village of Westmont, and their officers, officials, employees and volunteers are to be
covered as additional insureds with respect to liability arising out of automobiles owned, leased,
hired or borrowed by or on behalf of the Contractor; and with respect to liability arising out of
work or operations performed by or on behalf of the Contractor including materials, parts or
equipment furnished in connection with such work or operations. General Liability coverage
shall be provided in the form of an Additional Insured endorsement to the Contractor's
insurance policy, or as a separate owner's policy.
(E) 2. For any claims related to this project, the Contractor's insurance coverage shall be
primary insurance as respects to the Village, and their officers, officials, employees and
volunteers. Any insurance or self-insurance maintained by the Village, Name, their officers,
officials, employees or volunteers shall be excess of the Contractor's insurance and shall not
contribute with it.
The Workers' Compensation policy shall be endorsed with a waiver of subrogation in favor of
the Village and for all work performed by the Contractor, its employees, agents and
subcontractors.
PERFORMANCE AND PAYMENT BONDS
Prior to execution of the contract, the awarded contractor shall be required to obtain
Performance and Payment Bonds as per Section 18 in the General Terms and Conditions.
QUESTIONS DURING THE BID PROCESS
All questions concerning this bid shall be submitted in writing at least five business days prior to
the bid opening to Jeff Bonk, jbonk@westmont.il.gov. The deadline for questions is FRIDAY,
AUGUST 14, 2026 by 12:00 p.m. If required, a written response in the form of an addendum
will be issued. No contact with other Village employees shall be made during the bid process.
Questions asked after the deadline are not guaranteed a Response.
ILLINOIS PREVAILING WAGE ACT
This contract calls for the construction of a "public work" within the meaning of the Illinois
Prevailing Wage Act (820 ILCS 130/1-12 et seq.). Contractors and subcontractors shall comply
with the requirements of the Illinois Prevailing Wage Act including, but not limited to, all wage
requirements and notice and recordkeeping duties including paying laborers, workers and
mechanics performing work under this contract no less than the currently prevailing rate of
wages in the county where the work is performed and filing a certified payroll with the public
body in charge of the project.
The Contractor is advised that the Illinois Department of Labor (IDOL) revises the prevailing
wage rates and the Contractor/subcontractor has an obligation to check the IDOL website for
revisions to prevailing wage rates. For information regarding the current prevailing wage rates,
please refer to the DOL website: www.illinois.gov/idol/Laws-Rules/CONMED/Pages/Rates.aspx.
If IDOL revises the prevailing rates of wage during the term of the contract, the
Contractor/subcontractor is required to pay the then current prevailing rate of rages. Any
increases in costs to the Contractor due to changes in the prevailing rate of wage during
the term of any contract shall be at the expense of the Contractor and not at the expense
of the Owner.
The Contractor shall defend and hold harmless the Village, for any claim, suit or action,
including costs of defense, expert witness and attorney fees, either at law, equity or in an
administrative proceeding, arising from any alleged violation of the Prevailing Wage Act.
The requirements of this Section shall survive the termination of the Agreement formed
hereunder.
SUBSTANCE ABUSE PREVENTION ON PUBLIC WORKS PROJECTS ACT
The successful bidder must be in compliance with State of Illinois HB-1855 (Public Act
095-0635), which amends the Prevailing Wage Act. Before an employer commences work on a
public works project, the employer shall have in place a written program which meets or
exceeds the program requirements in this Act, to be filed with the public body engaged in the
construction of the public works and made available to the general public, for the prevention of
substance abuse among its employees. The testing must be performed by a laboratory that is
certified for Federal Workplace Drug Testing Programs by the Substance Abuse and Mental
Health Service Administration of the U.S. Department of Health and Human Services.
BASIS OF AWARD
The Village of Westmont intends to award a contract to the responsible bidder submitting the
lowest responsive bid. Lowest price shall be determined using the Total Base Bid amount listed
on the Bid Worksheet. The Village will review and make adjustments associated with arithmetic
errors to ascertain whether the order of bids is correct. In the event of arithmetic errors in any of
the line items, the unit price will be the controlling factor to correct the arithmetic error. The
Village will not assume that the error exists in the unit price.
The Village reserves the right to reject any and all bids or to waive any non-conformity in bids
received whenever such rejection or waiver is in the best interests of the Village. The Village
also reserves the right to reject the bid of a bidder who has previously failed to satisfactorily
perform a contract, has not completed contracts on time, or whom investigation shows is not in
a position to perform the contract. The Village of Westmont reserves the right to award
individual bids to more than one vendor if it is deemed to be in the best interest of the Village.
The Village reserves the right to increase or decrease the contract quantity without penalty from
the contractor to the Village.
BID WITHDRAWAL: No Bid shall be withdrawn for a period of 90 days after the opening of Bids
without consent of OWNER.
CONTRACTOR SAFETY PROGRAM
Prior to the start of any work, the Contractor will be required to submit a copy of Contractor's
written safety program if requested by the Village.
FREEDOM OF INFORMATION ACT
Contractor acknowledges that the Freedom of Information Act, 5 ILCS 140/1 et seq. (the "ACT")
places an obligation on the Village to produce certain records that may be in possession of the
Contractor. Contractor shall comply with the retention and documentation requirements of the
Local Records Retention Act 50 ILCS 205/1 et seq. and the Act and shall maintain all records
relating to this Agreement in compliance with the Local Records Retention Act (complying in all
respects as if the Contractor was,in fact, the Village). Upon notice from the Village, Contractor
shall review its records promptly and produce to the Village within two business days of said
notice from the Village the required documents which are responsive to a request under the Act.
If additional time is necessary to comply with the request, the Contractor may request the
Village to extend the time to do so, and the Village will, if time and a basis for extension under
the Act permits, consider such extensions. In the event Contractor fails to produce the
requested records or fails to produce the requested records within the time period required
above and the Village is assessed a fine, fee or penalty for failure to timely comply with Act do
to Contractor's actions, Contractor shall reimburse Village for all fines, fee or penalties, including
reasonable attorney's fees, paid by the Village.
DEPARTMENT OF COMMERCE AND ECONOMIC OPPORTUNITY GRANT PROGRAM
The following paragraphs and Appendix C describe the requirements of the DCEO grant to fund
this project, the following State and Federal Compliance Areas apply. Discrepancies between
the following paragraphs and Appendix C shall be resolved in favor of Appendix C.
A. Illinois Prevailing Wage Act (820 ILCS 130/) requires the payment of prevailing wages for all
construction funded in whole or in part with state funds, including funds passed through to
private firms. Contractors that are awarded contracts shall comply with all requirements of the
Prevailing Wage Act, including but not limited to, inserting into all contracts for construction a
stipulation to the effect that not less than the prevailing rate of wages as applicable to the project
shall be paid to all laborers, workers, and mechanics performing work under the award and
requiring all bonds of contractors to include a provision as will guarantee the faithful
performance of such prevailing wage clause as provided by contract. Contractors will be
required to report on Prevailing Wage Act compliance. If your project involves construction

B. Illinois Works Jobs Program Act. Contractors must comply with requirements in the Illinois
Works Jobs Program Act (30 ILCS 559/). For contracts with an estimated total project cost of
$500,000 or more, the Contractor will be required to comply with the Illinois Works
Apprenticeship Initiative (30 ILCS 559/20-20 to 20-25) and all applicable administrative rules.
The "estimated total project cost" is a good faith approximation at the time an applicant submits
to the Department a grant application of the costs of an entire project being paid for in whole or
in part by appropriated capital funds to construct a public work. The goal of the Illinois
Apprenticeship Initiative is that apprentices will perform either 10% of the total labor hours
actually worked in each prevailing wage classification or 10% of the estimated labor hours in
each prevailing wage classification, whichever is less. Contractors will be permitted to seek from
the Department a waiver or reduction of this goal in certain circumstances pursuant to 30 ILCS
559/20-20(b). The contractor must ensure compliance for the life of the entire project, including
during the term of the grant and after the term ends, if applicable, and will be required to report
on and certify its compliance.
1) Waivers from the Requirements: If goals cannot be met, the State has the discretion
to grant waivers, grant reductions, or to hold public hearings on the issue. Factors to be
considered include the scale of the Project and whether the Contractor or subcontractor
seeking the action has previously requested reductions or waivers. A waiver form is
available on the IL Department of Commerce & Economic Development (DCEO), Illinois
Works Jobs Program Act website at:

2) Reporting: An example quarterly reporting form is attached. A fillable version is
available on the DCEO website. Contractors should coordinate with the loan applicant
and their consultant for further instructions regarding these forms. Loan applicants are
ultimately responsible for reporting quarterly labor hours to the State, but coordination
with the Contractor is essential.

C. Business Enterprise Program. For contract awards of $250,000 or more, the Contractor will
be required to comply with the Business Enterprise Program for Minorities, Females, and
Persons with Disabilities Act (30 ILCS 575/0.01 et seq.), which establishes a goal for contracting
with businesses that have been certified as owned and controlled by persons who are minority,
women, or who have disabilities. The Department and the Capital Development Board will work
with the Grantee and Contractor to ensure compliance prior to the establishment of the contract
and grant agreement as well as through the life of the contract and grant.

THE GENERAL TERMS AND CONDITIONS WHICH FOLLOW APPLY TO ALL PURCHASES
AND BECOME A DEFINITE PART OF EACH FORMAL INVITATION TO BID, PURCHASE
ORDER, OR CONTRACT ISSUED BY THE VILLAGE OF WESTMONT, UNLESS OTHERWISE
SPECIFIED. BY SUBMITTING A BID, THE BIDDER AGREES TO BE BOUND BY THESE
TERMS AND CONDITIONS. BIDDERS OR THEIR AUTHORIZED REPRESENTATIVES ARE

BIDDING PROCEDURES
The first three items must be performed by the bidder in order for the bid submittal to qualify for
consideration by the Village. A place to check off each item as you complete it has been
provided for your convenience.
______ 1. BIDDING FORMS: Bids must be accompanied by a fully executed Offer to Contract
Form, bid worksheet and Affidavit of Compliance, provided in this package, and shall be
submitted on the forms provided or in an identical format typed by the bidder, properly signed in
the appropriate places, and submitted in hard copy format in a sealed envelope.
______2. BID DEPOSIT: When a bid deposit is required as indicated on the Invitation to Bid,
each bid must be accompanied by either a bid bond signed by a surety company authorized to
do business in Illinois, a cashier's check or a certified check. For construction projects the bid
deposit shall be in an amount equal to at least 10% of the amount of the bid. Any bid deposit
shall be in an amount equal as indicated in the Invitation to Bid. When bids are awarded, the
Village will return all checks except those of the successful bidder(s). The check(s) of the
successful bidder will be returned upon the submission within ten (10) days of a properly
executed performance bond. If no performance bond is required, the certified check will be
returned.
______ 3. SUBMISSION OF BIDS: All bids submitted must be received by the Village before
the time specified for opening the bid. Bids will be accepted in paper format in a sealed
envelope.
Any incomplete submittals may be rejected as non-responsive.
The Village's representative will decide when the specified time for the bid opening has arrived,
and bids will be opened precisely at the assigned time. Formal sealed bids, amendments
thereto, or requests for withdrawal of bids after the time specified for the bid opening will not be
considered.
