1. Introduction and Summary
The Quinault Indian Nation (the Nation) is soliciting competitive proposals from qualified general
contractors to construct the Quinault Tribal Courthouse in Taholah, Washington. The Project is a
complete, ready-to-occupy courthouse: the building, site development, and utilities, built in
accordance with the Construction Documents. Electronic security and information-technology
equipment will be owner-furnished. The Contractor installs the electronic security systems, with
support from the Nation's security contractor, and provides the pathways, rough-in, and power
connections described in Exhibit A.
The design is complete. This is a construction solicitation, and the selected Contractor will build
the facility as drawn and specified.
The Nation will award by best value, as set out in Section 5.
The full scope of work is provided in Exhibit A and is governed by the Construction Documents.
2. Project Background
2.1 Project Description
The courthouse is a single-story facility on Kla Ook Wa Drive in Taholah, east of the Quinault
Detention Center site, which is currently under construction, with a courtroom, offices, and
support spaces, plus associated site development, utilities, and a security package. The work is
built to the 2024 IBC and the structural design basis stated in the Construction Documents.
2.2 Governing Documents
The Worth Group 100% Construction Documents dated March 24, 2026, as revised by Design
Addendum No. 1 dated July 29, 2026 (the "Construction Documents"), govern the work and
consist of the Drawings and CD Manual V2, each as revised by Design Addendum No. 1 dated
July 29, 2026, and CD Manual V1 and the Geotechnical and Calculations Package dated March
24, 2026, including SSGC Geotechnical Report No. 26005. Where this RFP and the Construction
Documents differ with respect to the technical scope, quality, or content of the Work, the
Construction Documents control, as modified by issued addenda; commercial, procurement,
and contractual terms are governed by the order of precedence stated in the Supplementary
Conditions.
2.3 Budget and Funding
Award of any contract under this RFP is contingent on the authorization and availability of funds,
and the Nation may cancel this solicitation at any time without cost or liability to the Nation.
2.4 Schedule and Site Access
The Contract Time and milestones will be stated in the Agreement. The Nation contemplates a
construction duration of approximately twelve (12) months. Substantial Completion is required
no later than September 30, 2027, which assumes a Notice to Proceed on or about October 8,

2026; if the Notice to Proceed is issued later, the Contract Time established in the Agreement
will preserve an approximately twelve-month duration. The Contract Time will run from the date
of commencement stated in the Nation's Notice to Proceed, and proposers shall plan and price
on the basis of achieving Substantial Completion by that date. Proposers must plan around the
SR 109 corridor constraints described in Exhibit C, including the WSDOT fish-passage work, the
weight-restricted Aberdeen bridges, and winter storm closures.
The Contractor shall also coordinate its work, deliveries, and site activities with other
construction and operations occurring at or near the site during the Contract Time, including the
SR 109 corridor projects in Exhibit C, construction of the neighboring Quinault Detention Center,
which may proceed concurrently with this project, and any other concurrent Nation projects
identified in Exhibit C.
3. Invitation to Submit Proposals
The Nation invites qualified contractors to submit proposals to construct the Quinault Tribal
Courthouse. Proposals are due as stated on the cover of this RFP and shall be submitted as one
sealed hard copy and one emailed PDF copy, as stated in Section 6.2. Proposers may obtain the
complete Solicitation Documents, including the Construction Documents, from the Builders
Exchange of Washington at www.bxwa.com. Proposers must register as plan holders to receive
addenda and the pre-proposal meeting join details; only complete sets will be issued.
Free-of-charge access to project bid documents (plans, specifications, addenda, and Bidders List) is
provided to Prime Bidders, Subcontractors, and Vendors by going to www.bxwa.com and clicking on
"Posted Projects" then "Public Works", and then "Quinault Indian Nation." This online plan room
provides Bidders with fully usable online documents with the ability to: download, view, print, order
full/partial plan sets from numerous reprographic sources, and a free online digitizer/take-off tool. It
is recommended that Bidders "Register" in order to receive automatic e-mail notification of future
addenda and to place themselves on the "Self-Registered Bidders List." Bidders that do not register
will not be automatically notified of addenda and will need to periodically check the on-line plan
room for addenda issued on this project. Contact Builders Exchange of Washington at (425) 258-

bxwa.com is our property or the property of our licensors and is protected by copyright and other
intellectual property laws. Access to project documents is intended for use by bidders (general
contractors/prime bidders, subcontractors and suppliers), agency personnel and agency's
consultants, as well as for personal, noncommercial, use by the public. You may display or print the
content available for these uses only. "Harvesting" (downloading, copying, and transmitting) of any
project information and/or project documents for purposes of reselling and/or redistributing
information by any other party is not allowed by BXWA.
A pre-proposal meeting will be held via Microsoft Teams on Thursday, August 27, 2026, at 11:00
a.m. Pacific Time; join details will be provided to registered plan holders. A site walkthrough will
be held at the Project site on Tuesday, September 1, 2026, beginning at 11:00 a.m. Pacific Time;
attendees shall check in at the Quinault Tribal Center, 1214 Aalis Drive, Taholah. Attendance at

both is optional but strongly recommended. Proposers are responsible for the information
available from the meeting and walkthrough whether or not they attend.
The Nation encourages participation by Indian-owned, minority-owned, woman-owned, and
veteran-owned firms and subcontractors, and applies Quinault Indian preference as described in
Section 5.4.
The Nation reserves the right to reject any and all proposals, to waive informalities and
irregularities, and to make the award it determines is in the best interest of the Nation.
4. Instructions to Proposers
4.1 Proposal Procedures
Proposals shall be prepared and submitted in accordance with this RFP, which together with its
Exhibits, the Construction Documents defined in Section 2.2, and all addenda constitutes the
Solicitation Documents. Requests for interpretation of the Solicitation Documents and any
substitution requests must be submitted in writing to the contacts stated on the cover of this
RFP no later than the questions deadline stated on the cover. Interpretations, corrections, and
changes will be made only by written addendum issued to registered plan holders, and no other
source is authorized to bind the Nation. The amount and forms of proposal security are stated
on the Proposal Form (Exhibit B).
All communications regarding this procurement shall be directed exclusively to the contacts
stated on the cover of this RFP. Proposers shall not communicate about this procurement with
other members of the Nation's government, the project team, or their representatives, and
unauthorized contact may result in disqualification. This restriction does not apply to obtaining
the Solicitation Documents from the sources stated in Section 3, or to coordinating with the
Quinault TERO Office as required by Section 8.2.
4.2 Taxes
Because the construction Contract will be directly between the Quinault Indian Nation and the
Contractor, Washington State retail sales tax and business and occupation (B&O) tax do not
apply to the Work performed under this Contract. This preemption arises from the Nation's
status as the purchaser of the Work and does not extend to all transactions occurring within the
boundaries of the Quinault Reservation. Proposers shall exclude the preempted taxes from the
base proposal price and shall include any other applicable taxes and fees that are the
Contractor's obligation. The Contractor may purchase materials and supplies for the Work using
a reseller permit. The Nation will make a Tribal representative available to complete the Buyers'
Retail Sales Tax Exemption Certificate to substantiate the tax-exempt status of the construction
activity within Indian country. Guidance on the applicability of Washington taxes within Indian
country is available in the Washington State Department of Revenue Indian Tax Guide. Permits
and fees: the Nation will obtain the Site Development permits, and the Contractor shall obtain

all other permits required for the Work. Because this is a Quinault Indian Nation project, plan-
review and permit fees are waived, and proposers shall exclude those fees from the base
proposal price. The waiver applies to fees only. Building permit and plan review are still
required, and the permitting process is unchanged.
5. Evaluation and Award
5.1 Selection Process
The Nation will evaluate proposals by best value. The process includes an initial screening for
compliance with the submission requirements, scoring of responsive proposals against the
criteria below, optional interviews or requests for clarification, reference and responsibility
checks, and final selection and award. The Nation may request clarification or additional
information from any proposer.
5.2 Evaluation Criteria and Weightings

Price is evaluated on the base proposal price and any accepted alternates. The proposer's plan
for the SR 109 constraints described in Exhibit C is evaluated as part of Project Approach and
Methodology.
5.3 Rating Scale
Each criterion is scored on the following scale. A proposal's total score is the sum of each
criterion's weight multiplied by its rating divided by five, so a maximum rating on every criterion
yields a total score of 100 points:

5.4 Quinault Indian Preference
Quinault Indian preference applies in accordance with Quinault Indian Nation policy. The
preference applies to a business at least fifty-one percent (51%) owned by the Quinault Indian
Nation, an enrolled Quinault member, or another federally recognized Indian tribe or tribal
member. A proposer claiming preference shall substantiate ownership of fifty-one percent
(51%) or greater with its proposal.
5.5 Basis of Award
The Nation intends to award to the responsible proposer whose proposal is most advantageous
to the Nation, price and the other factors considered, and subject to confirmation of funding
under Section 2.3. The Nation reserves the right to reject any and all proposals, to waive
informalities and irregularities, to request clarification or additional information, to negotiate
with one or more proposers, and to cancel or amend this solicitation. In determining the most
advantageous proposal, the Nation may consider any exceptions a proposer takes under Tab 7
(Section 6.1), including their effect on the Nation's risk, cost, and schedule, and may treat
extensive or material exceptions as reducing a proposal's overall value.
The Nation's decision to award, or not award, this contract to any proposer shall be final and not
subject to challenge in any court or judicial forum. The Nation does not, through issuing this
Request for Proposals, waive its sovereign immunity in any court or judicial forum.
6. Submission Requirements
6.1 Proposal Contents
Proposals shall be organized in the following tabs, in this order. Page limits are per tab, on 8.5-
by-11-inch pages in 11-point type or larger. The Proposal Form, proposal security, resumes,
required forms, tab dividers, and a cover letter do not count against page limits; an 11-by-17-
inch schedule sheet counts as one page.
Tab 1, Price (no page limit): the Proposal Form (Exhibit B), completed and signed, with the base
proposal price, any alternates, proposal security, and acknowledgment of all addenda.

Tab 2, Relevant Experience (maximum 6 pages): at least three comparable projects, such as
justice, government, or tribal facilities of similar size and complexity, completed within the last
five years, with client references.
Tab 3, Key Personnel and Project Team (maximum 4 pages, excluding resumes): the proposed
project manager and superintendent and the project organization, with resumes provided as
attachments.
Tab 4, Project Approach and Methodology (maximum 8 pages): project approach, schedule, and
a preliminary critical path method (CPM) schedule covering the full construction period,
including mobilization and the SR 109 corridor logistics approach addressing the constraints in
Exhibit C.
Tab 5, Safety and Quality Record (maximum 3 pages): the firm's experience modification rate
and safety record and its quality-control approach.
Tab 6, Forms and Administrative (no page limit): firm identification and licensing, including legal
name, Washington contractor registration number, and Washington business license; a Quinault
Indian Nation Business License, or evidence of application for one (a QIN Business License is
required before commencing work on the Reservation); the Quinault TERO Compliance Form; a
non-collusion certification; a conflict-of-interest disclosure; copies of required licenses; and
ownership substantiation if Quinault Indian preference is claimed.
Tab 7, Exceptions (no page limit): a statement of any exceptions, deviations, or points to be
negotiated with respect to the contract documents and the conditions identified in Section 10.1,
each keyed to the specific document, section, and provision. A proposer taking no exceptions
shall affirmatively state that it takes none. Exceptions not disclosed in this tab are waived and
will not be negotiated later, consistent with Section 10.1.
6.2 Submission Instructions
Proposals must be submitted by the method, date, and time stated on the cover of this RFP.
Proposals shall be submitted by both of the following methods: (1) one sealed hard copy
delivered by mail or in person to Procurement Administration, Quinault Indian Nation, PO Box
70, 1214 Aalis Drive, Taholah, WA 98587; and (2) one PDF copy emailed to bids@quinault.org
and the contacts stated on the cover of this RFP. The hard copy shall be enclosed in a sealed
opaque envelope or package marked with the proposer's name and address, the Project name,
"Tribal Court," and "Sealed Proposal, Do Not Open." Faxed or otherwise unsealed hard copies
will not be accepted. If the emailed PDF and the sealed hard copy differ, the sealed hard copy
governs. Late submissions will not be accepted, and each proposer is responsible for timely
delivery of both copies.
7. Bonds, Insurance, and Trench Safety
7.1 Performance and Payment Bonds
The selected Contractor shall furnish a performance bond and a payment bond, each in the
amount of one hundred percent (100%) of the Contract Sum, on AIA Document A312, or forms
identical in substance, from a surety lawfully authorized to do business in Washington. Bonds
