PUBLIC NOTICE is hereby given that the following Ordinance was submitted in writing, introduced, read by title and passed on first reading at a meeting of the Township Committee of the Township of Millburn, in the County of Essex on Tuesday, June 2, 2026. The ordinance will be considered for final passage and adoption at the public hearing held at a Township Committee meeting beginning at 7:00 p.m. on Tuesday, July 14, 2026 at the Millburn Education Center, 434 Millburn Avenue, Millburn, New Jersey when and where or at such time and place to which said meeting may be adjourned, all persons interested will be given an opportunity to be heard concerning said ordinance. The Millburn Education Center will open for this meeting beginning at 6:45PM and details on the meeting and agenda may be located at town hall, on our website

ORDINANCE NO. 2755-26
ORDINANCE DESIGNATING "BRIDGES ASSOCIATED WITH THE MORRIS & ESSEX/OLD MAIN DELAWARE, LACKAWANNA AND WESTERN RAILROAD” AS A THEMATIC HISTORIC DISTRICT PURSUANT TO THE HISTORIC PRESERVATION ORDINANCE OF THE TOWNSHIP OF MILLBURN
WHEREAS, to avoid the loss of integrity and to preserve the historic character of Township of Millburn’s numerous train bridges, the Township Committee wishes to designate these landmarks as a thematic historic district in accordance with 40:55D-65i. and 65.1 of the Municipal Land Use Law; and,
WHEREAS, the said thematic historic district includes eleven (11) train bridges or structures along the current Morris and Essex train line that runs through the Township of Millburn and are indicated on the map provided as appendix A of this ordinance; and
WHEREAS, there are eleven (11) locations within this district, with ten (10) designated as contributing and one (1) being designated as a key contributing structure, and all locations and descriptions identified in Schedule A below; and
WHEREAS, the said Thematic Historic District nomination was proposed by the Historic Preservation Commission with a vote for recommendation to the Township Committee taken on April 9, 2026 in accordance with the provisions outlined in Article 8 of the Township’s Development Regulations for Zoning; and
WHEREAS, such recommendation was approved by the Historic Preservation Commission to be referred to the Township Committee to propose an ordinance for the designation of the thematic historic district entitled “BRIDGES ASSOCIATED WITH THE MORRIS & ESSEX/OLD MAIN DELAWARE, LACKAWANNA AND WESTERN RAILROAD”; and
WHEREAS, regulatory requirements are necessary to preserve the integrity of the Township’s railroad bridges and their materials and historic character-defining features, and to convey the district’s historical significance, and, where the buildings and structures within the district require extensive repair, or if alterations or a new work is necessary regulatory requirements will assist the owners and applicants to rehabilitate, restore or replace or to add onto such character-defining elements, materials and features of the structures with the most appropriate design and treatment to avoid loss of historic character or integrity;
WHERAS, the following properties shall be included in the thematic historic district BRIDGES ASSOCIATED WITH THE MORRIS & ESSEX/OLD MAIN DELAWARE, LACKAWANNA AND WESTERN RAILROAD designation;

NOW THEREFORE BE IT ORDAINED by the Township Committee of the Township of Millburn, in the County of Essex, as follows:
SECTION 1 The following thematic historic district and identified properties be and are hereby designated as a historic district in accordance with 40:55D-65.1 of the Municipal Land Use Law and the official Township Zoning Map is hereby amended to reflect said historic district designation:

SECTION 2 Consistent with 40:55D-111 of the Municipal Land Use Law, prior to the issuance by the Township of any permit for demolition, destruction, removal, alteration, construction, building, grading, addition(s) or any other changes to the land or to the exterior of the properties, buildings, structures and objects within the aforementioned BRIDGES ASSOCIATED WITH THE MORRIS & ESSEX/OLD MAIN DELAWARE, LACKAWANNA AND WESTERN RAILROAD historic district, except for ordinary maintenance, applications to make such changes shall be referred to the Historic Preservation Commission which shall determine whether the application is minor, in which case it may be considered and acted upon by the Commission’s Minor Work Review Committee in place of the full Commission, and if not minor, the Commission shall consider the application and hold a hearing on it after notice has been provided by the applicant of the hearing on the application pursuant to 40:55D-12 of the Municipal Land Use Law if such notice is required, and the Commission shall submit its report to the administrative officer within 45 days of referral of the application to the Commission.
SECTION 3 This Ordinance shall take effect upon final adoption and publication in accordance with law.
