Legal Representation Concerning the Freedom of Information Law

The New York State Gaming Commission (the "Commission"), on its own behalf and on behalf of the New York Gaming Facility Lacation Board (the "Board"), issues this Request for Proposals ("RFP) to solicit Proposals from Bidders seeking the award of a Contract to provide legal advice and services on the application of the New York Freedom of Information Law ("FOIL") codified in Article 6 of the Public Officers Law, in relation to the applications received to proceed for licensure consideration to develop and operate a casino in New York State pursuant to Racing, Pari-Mutuel Wagering and Breeding Law ("Racing Law") Article 13, Title 2-A.

The gaming faciliy applications received are subject to FOIL. Following receipt of full and redacted proposals, submitted, the Commission must then evaluate each applican'ts proposed redactions and make determinatoin of whether each FOIL exemptio asserted by an applicant has been justified, and then engage with the applicant in the interactive process set forth in FOIL to reach a final agency determination of hte limites of which any such material in the application is exempt from public disclosure.

The Successful Bidder chosen as a result of this RFP, will be expeced to represent the Commission and the Board in all matters pertaining to the applicability of FOIL to the gaming facility applications and records relating thereto as set forth in the Scope of Work of the RFP, Section 2.1.
