NOTICE TO BIDDERS
(Chapter 103D, HRS)
SEALED BIDS for Job No. HA 22-03 be received at the Department of Land and Natural Resources, Division of Boating and Ocean Recreation, Hawai'i Division, up to June 4, 2026, 2:00 p.m. through the State of Hawaii e-Procurement System (HIePRO).
The AG-008 General Conditions (revised on 4/15/2009) shall be made a part of the contract specifications.
The DLNR Interim General Conditions are a part of the contract specifications.
SCOPE OF WORK
The purpose of this IFB is to solicit bids for a licensed plumbing contractor to diagnose plumbing problems and perform plumbing repairs. Scheduled preventive maintenance is not included unless the Contract Administrator and/or the Chief Engineer determine that is needed for a specific work order.
The Contractor shall diagnose and repair the plumbing systems at seven Hawai'i District harbors and one launch ramps as needed.
The Small Boat Harbors and launch ramp facilities that are included are:
There is one (1) line item in the Bid Proposal for this contract based on the bidder's hourly rate:
Line Item No. 1 is for diagnosis and repair of plumbing.
Line Item No. 2 is a fixed allowance item in the amount of $35,000.00 to cover unforeseen conditions, equipment rental or usage as itemized in Line Item No. 3, additional work, and repair and or additional projects.
The contractor shall be aware that the total amount in the proposal does not obligate the State to expend the funds. The assignment will be given to the contractor and shall be as needed.
The Sum of Line Items 1 and 2 is the base bid that will be used to determine the low bid. The contract will be awarded to the lowest responsive and responsible bidder.
Line item #3 is for the usage Contractor owned equipment. The contractor shall obtain approval for the use of their equipment prior to the commencement of any work.
The Contractor must bid for all line items to be considered for award.
The contractor shall provide a cost breakdown for all repair projects including total hours worked and equipment used. Unless an emergency condition exists, the contractor shall provide a proposal showing the total estimated hours and type of equipment to be used for approval prior to starting work.
Line Item No. 1 is the diagnosis and repair of the plumbing systems at Division facilities. The Contractor shall furnish the labor, equipment and materials to repair the malfunctioning plumbing components on the shore and on the piers.
The Hawai'i district harbors all have roads and plumbing is accessible to vehicles and equipment.
The repairs on the shore include, but are not limited to, the comfort stations, District office building/base yard, pressure regulators, backflow preventors maintenance and repairs, and any repairs to the plumbing systems in the facilities buildings. The repairs to the piers include, but are not limited to, the hose bibs, water lines, and water valves.
There are parts of the plumbing system at some facilities that are located under the piers. The Contractor will not always have access to all the plumbing system from the top of the pier. There are conditions that will require the Contractor to go under the pier to work on the plumbing system. The Contractor may require the use of a small boat and/or raft to access and effect repairs under the piers and must have knowledge of local tidal changes within these facilities and their effect on work.
Line Item No. 3 is the equipment, safety and traffic control items that the Contractor owns. To receive compensation for the Contractor owned equipment the Contractor must submit the cost for Line Item No. 3. If equipment necessary to complete a repair is purchased after the submittal of bids the Contractor shall submit a letter to the State that lists the brand name, model, date acquired, and hourly rate for use of the equipment. The state must approve use of the equipment and its hourly rate prior to use.
If the Contractor does not own equipment necessary to complete repairs, the Contractor may rent the equipment. The contractor must provide the equipment rental use rate to the State. The Contractor shall be responsible to furnish all equipment required to perform repairs. The equipment category includes steel plates, traffic control items and large equipment that are powered by gas, propane or diesel engines, boats, floats and any other equipment necessary to complete a repair. This category does not include items such as hand-held tools or plumbing equipment, which shall be considered incidental to the hourly rates in Line Item No. 1.
MATERIALS
The Contractor shall provide the materials for the repairs. The Contractor provided materials will be furnished as reimbursable expense. The State will allow a ten percent (10%) markup of the materials for overhead and profit for the Contractor supplied material. The Contractor shall submit the original copy of the receipt from the material supplier when submitting the invoice for a project. The receipt from the material supplier shall include only the materials that were used on the project.
CONTRACTOR LICENSE REQUIREMENT
Due to the nature of work contemplated, bidders must possess a valid State Contractor's license, classification C37. A contractor that has had a contract terminated or cancelled within the past five years for non-performance shall not be qualified to bid on this contract.
INVOICING
Invoices shall be payable upon certification by the Construction & Maintenance Superintendent that the Contractor has satisfactorily completed the installation. The Construction & Maintenance Superintendent will issue process the invoice that references IFB-HA 22-03.

A "Certificate of Vendor Compliance," issued through the Hawaii Compliance Express system is required for payment or the individual certification of compliance from the corresponding agencies. The Bidder must be compliant for entire duration of the contract to receive payment.

CONTRACT ADMINISTRATOR

HAWAII PRODUCTS PREFERENCE
The Contract is subject to preference for Hawaii Products established by Section 103D, Hawaii Revised Statutes. The Hawaii Product List may be examined at the State Procurement Office.
APPRENTICESHIP AGREEMENT PROGRAM PARTICIPATION PREFERENCE
This Contract is subject to the Apprenticeship Agreement Participation Preference. If applicable to this project, any bidder seeking the preference must be a party to an apprenticeship agreement registered with the State Department of Labor and Industrial Relations (DLIR) at the time the bid is submitted for each apprenticeable trade the bidder will employ to construct the project. "Employ" means the employment of a person in an employer-employee relationship.
AWARD
The State shall award the contract to the lowest responsive and responsible Bidder upon the submittal of all the contract documents. The Apparent Low Bidder has 10 days to furnish the State with the required submittals including Certificate of General Liability Insurance and Performance and Labor & Material Payment Bonds (if applicable). The award of the contract will be subject to the availability of funds. A contractor that has had a contract terminated or cancelled within the past five years for non-performance shall not be qualified to bid on this contract.
The fully executed contract may be delayed up to a year.
BONDING
The bidder must provide a Bid Bond when submitting the Bid in HIePro. The Bid Bond shall be as specified in Hawaii Revised Statutes 103D-323 and the Procurement Rules under Subchapter 24.
The successful bidder must enter into and execute a contract with the Board of Land and Natural Resources and furnish a Performance and Payment Bond, as required. These bonds shall conform to provisions of Section 103D-324 and 325, Hawaii Revised Statutes and any law applicable hereto.
TERM OF CONTRACT
Contractor shall enter into a contract for furnishing Plumbing Repair Services for the twelve-month period commencing on official commencement date on the Notice to Proceed.
Unless terminated, contract shall be extended for not more than two (2) additional twelve-month periods or portions thereof without the necessity of re-bidding upon mutual agreement in writing, at least sixty (60) days prior to expiration provided that the contract price for the extended periods shall remain the same or lower than the initial bid price.
The Contractor or the State may terminate the extended period of the contract at any time upon sixty (60) days prior written notice.
LIABILITY INSURANCE
The Contractor shall maintain in full force and effect during the life of this contract, liability and property damage insurance to protect the Contractor, subcontractors, and the State of Hawaii, DLNR-DBOR from claims for damages for personal injury, accidental death and property damage which may arise from operations under this contract, whether such operations be by
himself or by a subcontractor or anyone directly or indirectly employed by either of them. If any subcontractor is involved in the performance of the contract, the insurance policy or policies shall name the subcontractor as additional insured.
As an alternative to the Contractor providing insurance to cover operations performed by a subcontractor and naming the subcontractor as additional insured, Contractor may require subcontractor to provide its own insurance which meets the requirements herein. It is understood that a subcontractor's insurance policy or policies are in addition to the Contractor's own policy or policies.
Upon execution of the Plumbing Repair Services Contract, the Contractor assumes all responsibility regarding all plumbing systems named in the contract. The contractor also agrees to hold harmless the State of Hawaii, DLNR-DBOR in the event that an plumbing system fails during the term of this contract.
The following minimum insurance coverage(s) and limit(s) shall be provided by the Contractor, including its subcontractor(s) where appropriate.
Coverage Limits
Commercial General Liability $1,000,000 combined single (occurrence form) limit per occurrence for bodily
injury and property damage
Each insurance policy required by this contract, including a subcontractor's policy, shall contain the following clauses:
"This insurance shall not be canceled, limited in scope of coverage or non- renewed until after 30 days' written notice has been given to the State of Hawaii, Department of Accounting and General Services, State Procurement Office, P. O. Box 119, Honolulu, Hawaii 96810-0119."
"The State of Hawaii is added as an additional insured as respects to operations performed for the State of Hawaii."
"It is agreed that any insurance maintained by the State of Hawaii will apply in excess of, and not contribute with, insurance provided by this policy."
The minimum insurance required shall be in full compliance with the Hawaii Insurance Code throughout the entire term of the contract, including supplemental agreements.
Upon Contractor's execution of the contract, the Contractor agrees to deposit with the State of Hawaii certificate(s) of insurance necessary to satisfy the State that the insurance provisions of this contract have been complied with and to keep such insurance in effect and the certificate(s) therefore on deposit with the State during the entire term of this contract, including those of its subcontractor(s), where appropriate. Upon request by the State, Contractor shall be responsible for furnishing a copy of the policy or policies.
Failure of the Contractor to provide and keep in force such insurance shall be regarded as material default under this contract, entitling the State to exercise any or all of the remedies provided in this contract for a default of the Contractor.
Cancellation of Solicitations and Rejection of Offers. The solicitation may be cancelled, or the offers may be rejected, in whole or in part, when in the best interest of the purchasing agency, as provided in 3-122-95 through 3-122-97, HAR.
Confidentiality of Material. All material given to or made available to the Contractor by virtue of this contract, which is identified as proprietary or confidential information, will be safeguarded by the CONTRACTOR and shall not be disclosed to any individual or organization without the prior written approval of the STATE.
All information, data, or other material provided by the Offeror or the Contractor to the State shall be subject to the Uniform Information Practices Act, chapter 92F, HRS. The Offeror shall designate in writing to the Procurement Officer those portions of its unpriced offer or any subsequent submittal that are trade secrets or other proprietary data that the Offeror desires to remain confidential, subject to 3-122-58, HAR, in the case of an RFP, or 3-122-30, HAR, in the case of an IFB. The Offeror shall state in its written communication to the Procurement Officer, the reason(s) for designating the material as confidential, for example, trade secrets. The Offeror shall submit the material designated as confidential in such manner that the material is readily separable from the offer in order to facilitate inspection of the non- confidential portion of the offer.
Price is not confidential and will not be withheld. In addition, in the case of an IFB, makes and models, catalogue numbers of items offered, deliveries, and terms of payment shall be publicly available at the time of opening regardless of any designation to the contrary.
If a request is made to inspect the confidential material, the inspection shall be subject to written determination by the Office of the Attorney General in accordance with chapter 92F, HRS. If it is determined that the material designated as confidential is subject to disclosure, the material shall be open to public inspection, unless the Offeror protests under chapter 3-126, HAR. If the request to inspect the confidential material is denied, the decision may be appealed to the Office of Information Practices in accordance with 92F-15.5, HRS.
Nondiscrimination. No person performing work under this Agreement, including any subcontractor, employee, or agency of the Contractor, shall engage in any discrimination that is prohibited by any applicable federal, state, or county law.
Records Retention. The Contractor and any subcontractors shall maintain the books and records that relate to the Agreement and any cost or pricing data for three (3) years from the date of final payment under the Agreement.
Correctional Industries. Goods and services available through Correctional Industries (CI) programs may be the same or similar to those awarded by competitive sealed bids or proposals. Agencies participating in SPO requirements (price list) contracts may also procure directly from CI and shall not be considered in violation of the terms and conditions of any State of Hawaii contract.

PROJECT LOCATION AND SCOPE OF WORK: The project location and scope of work shall be as generally described in the Notice to Bidders.
SEALED PROPOSALS Bidders shall submit their "Sealed Bid" through the Hawaii Electronic Procurement System (HIePRO). The web address for the home page of the HIePRO site is
GENERAL CONDITIONS: The AG-008 shall become part of these contract specifications and are referred to hereafter as the General Conditions.
The Department of Land and Natural Resources (DNLR) Interim General Conditions (attached on HIePRO) are a part of the contract specifications. The following are the sections of the DLNR Interim General Conditions that are modified for this contract:
Section 3.3, Award of Contract. A fully executed contract may take longer than the sixty (60) days that is called for. The other provisions of section 3.3 that include 103D-702, Chapter 104 and Chapter 444 are applicable to the contract.
Section 6.23 Termination of Contract. The Contract may be terminated for breach by the Chairperson of the DLNR.
PROPOSAL FORM: The Bidders shall download the proposal form from the electronic file on the HIePRO website. The Bidders shall fill in, sign and date the Proposal form and upload it to the HIePRO website when the bid is submitted.
OMISSIONS OR ERASURES: Any proposal which contains any omission or erasure or alteration not properly initialed, or conditional bid, or other irregularity may be rejected by the Board of Land and Natural Resources (Board).
NOTICE OF INTENT TO BID AND QUESTIONNAIRE: A Notice of Intent to Bid is not required for this project. In compliance with HRS Section 103D-310, the lowest responsive and responsible bidder may be required to complete a standard questionnaire. When required, the completed questionnaire shall be submitted to the Contract Administrator for evaluation. Failure to furnish the requested information within the time allowed may be grounds for a determination of non-responsibility, in accordance with HRS Section 103D- 310 and HAR Section 3-122-108.
BID SECURITY: Bid security is required.
CONTRACTOR'S LICENSE REQUIRED: The Board will reject all bids received from contractors who have not been licensed by the State Contractors License Board in accordance with Chapter 444, HRS; Title 16, Chapter 77, Hawaii Administrative Rules; and statutes amendatory thereto. Due to the scope of work anticipated for this contract, the contractor will be required to possess a Specialty Contractor's C-37 plumbing license.
IRREGULAR BIDS: No irregular bids or propositions for doing the work will be considered by the Board.
WITHDRAWAL OF BIDS: No bidder may withdraw his bid between the time of the opening thereof and the award of contract.
SUCCESSFUL BIDDER TO FILE PERFORMANCE AND PAYMENT BONDS: The successful bidder will be required to file performance and payment bonds each; in the amount equal to the total contract price, including amounts estimated to be required for extra work.
NUMBER OF EXECUTED ORIGINAL COUNTERPARTS OF CONTRACT DOCUMENTS: The Contractor shall furnish five (5) original copies of the Contract, the Proposal and performance and payment bonds shall be executed.
CHANGE ORDERS: No work of any kind in connection with the work covered by the plans and/or specifications shall be considered as change order work, or entitle the Contractor to extra compensation, except when the work has been ordered in writing by the Contract Administrator and in accordance with sub-section 4.2 of the General Conditions.
The Contractor shall clearly identify and inform the Contract Administrator in writing of any deviations from the contract documents at the time of submission and shall obtain the Contract Administrator's written approval to the specified deviation prior to proceeding with any work.
WAGES AND HOURS: In accordance with sub-sections 7.3 to 7.9 of the General Conditions relative to hours of labor, minimum wages and overtime pay, the current minimum wage rates promulgated by the Department of Labor and Industrial Relations (DLIR) shall be paid to the various classes of laborers and mechanics engaged in the performance of this contract on the job site. The minimum wages shall be increased during the performance of the contract in an amount equal to the increase in the prevailing wages for those kinds of work as periodically determined by the DLIR.
The Department of Land and Natural Resources will not recognize any claim for additional compensation because of the payment by the Contractor of any wage rate in excess of the said minimum wage rates. The possibility of wage increase is one of the elements to be considered by the Contractor in determining his bid, and will not, under any circumstances, be considered as the basis of a claim against the Department under this Contract.
No work shall be done on Saturdays, Sundays, legal State holidays, and/or more than eight
(8) hours each day without the written consent of the Contract Administrator. The Contractor shall pay for all administrative costs for inspections. No work shall be done at night unless authorized by the Contract Administrator.
PERMITS: The State will process permit applications whenever possible, and the Contractor shall procure the pre-processed permits and pay the required fees. If permit applications are not processed by the State, the Contractor shall process the permit applications, permits and licenses, and pay all charges and fees. In all cases, the Contractor shall give all notices necessary and incident to the due and lawful prosecution of the work.
PROPERTY DAMAGE: It shall be the responsibility of the contractor to respect State property and to prevent damage to existing improvements. The Contractor will be responsible for damages resulting from construction operations. Immediately upon discovery, the Contractor shall repair such damage to the satisfaction of the Contract Administrator.
All trees and shrubbery outside the excavation, embankment or construction limits shall be fully protected from injury.
TIME: The time of completion is specified in the Proposal. It is the Board's intention to insist the Contractor diligently prosecute the work to completion within the specified time.
Prospective bidders are reminded that the State has the option to proceed with or abandon a project depending on whether the project can be completed for occupancy in the specified time.
It is the bidder's responsibility to check the availability of all materials before bidding. The bidder shall select sub-contractors and suppliers who can warrant availability and delivery of all specified or qualified materials to assure project completion within the specified time.
The successful bidder must assume all risks for completing the project by the specified date. There shall be no extension of time for any reason except for delays caused by acts of God, labor disputes involving unions, or actions of the State. If for any reason the project falls behind schedule, the Contractor shall at its own cost, take necessary remedial measures to get the project back on schedule, i.e., working overtime, air freighting all materials, etc. In addition, if the Contractor fails to fully complete the project by the completion date, Contractor will be required to make the facility usable at its own cost.
BIDDER'S RESPONSIBILITY TO PROVIDE PROPER SUPERINTENDENCE: The successful low bidder shall designate in writing to the Contract Administrator the name of its authorized superintendent (Superintendent), who will be present at the job site whenever any work is in progress. The Superintendent shall be responsible for all work, receiving and implementing instructions from the Contract Administrator in a timely manner. The cost for superintendence shall be considered incidental to the project.
If the Superintendent is not present at the site of work, the Contract Administrator shall have the right to suspend the work as described under sub-section 5.5 c. and 7.20 - Suspension of Work of the General Conditions.
LIQUIDATED DAMAGES: Liquidated damages in the amount specified in the Proposal will be assessed for each and every calendar day from and after the expiration of the time period stated in the Contract for the completion of the project.
HIRING OF LOCAL LABOR: The Contractor shall hire local labor whenever practicable.
WATER AND ELECTRICITY: The Contractor shall make all necessary arrangements and pay all expenses for water and electricity used in the construction of this project.
PUBLIC CONVENIENCE AND SAFETY: The Contractor shall conduct construction operations with due regard to the convenience and safety of the public at all times. No materials or equipment shall be stored where it will interfere with the safe passage of public traffic. The Contractor shall provide, install, and maintain in satisfactory condition, all necessary signs, flares and other protective facilities and shall take all necessary precautions for the protection of the work and the convenience and safety of the public. The Contract Administrator shall have the right to suspend the performance of the work in accordance with sub-section 7.20 - Suspension of Work of the General Conditions.
WORK TO BE DONE WITHOUT DIRECT PAYMENT: Whenever the contract that the Contractor is to perform work or furnish materials of any kind for which no price is fixed in the contract, it shall be understood that the Contractor shall perform such work or furnish said materials without extra charge or allowance or direct payment of any sort. The cost of performing such work or furnishing said material is to be included by the Contractor in a unit price for the appropriate item unless it is expressly specified that such work or material is to
be paid for as extra work.
AS-BUILT DRAWINGS: As-built drawings, the intent of which is to record the actual in- place construction so that any future renovations or tie-ins can be anticipated accurately, shall be required. All authorizations given by the Contract Administrator to deviate from the plans shall be drawn on the job site plans. All deviations from alignments, elevations and dimensions which are stipulated on the plans shall be recorded on the as- built drawings. Final as-built drawings shall be submitted to the Contract Administrator by the Contractor at the end of the project in both hard copy and electronic copy in Adobe PDF format on CD ROM.
ASBESTOS CONTAINING MATERIALS: The use of asbestos containing materials or equipment is prohibited. The Contractor shall insure that all materials and equipment incorporated in the project are asbestos-free
Z. WORKER SAFETY: The Contractor shall provide, install and maintain in satisfactory condition all necessary protective facilities and shall take all necessary precautions for the protection and safety of its workers in accordance with the Occupational Safety and Health Standards for the State of Hawaii. The Contract Administrator shall have the right to suspend the performance of the work in accordance with sub-section 7.20 - Suspension of Work of the General Conditions.
AA. TOILET FACILITIES: All toilet facilities constructed at the project site shall be in accordance with the Public Health Regulations of the State Department of Health (DOH). All necessary precautions shall be observed at the project site. The use of sanitary facilities shall be strictly enforced and workers violating these provisions shall be promptly discharged.
BB. SIGNS: Whenever the project involves closing or obstructing any public thoroughfare, the Contractor shall provide traffic signs conforming to the applicable provisions of the current edition of the "Manual on Uniform Traffic Control Devices for Streets and Highways", published by the Federal Highway Administration as directed by the Contract Administrator for the purpose of diverting or warning traffic prior to the construction area. All traffic signs shall bear proper wording stating thereon the necessary information as to diverting or warning traffic.
All signs shall be kept neat and clean, and properly erected at all times.
CC. FIELD OFFICE AREA FOR DEPARTMENT: The Contractor is not required to provide a field office for the State Contract Administrator.
DD. QUANTITIES: All bids will be compared based on quantities of work to be done as shown in the Proposal; the quantities shown in the Unit Price items are estimated, being given as a basis for comparison of bids. The Board reserves the right to increase or decrease the quantities given under the items or delete items entirely as may be required during the progress of the work.
EE. OTHER HEALTH MEASURES: Forms of work site exposure or conditions which may be detrimental to the health or welfare of workers or of the public shall be eliminated or reduced to safe levels as required by the DOH codes, standards, and regulations. Suitable first aid kits and a person qualified to render first aid, as specified in the DOH regulations, shall be provided always when work is scheduled.
FF. HAWAII BUSINESS OR COMPLIANT NON-HAWAII BUSINESS REQUIREMENT:
Bidders (Contractors) shall be incorporated or organized under the laws of the State or be registered to do business in the State as a separate branch or division that is capable of
fully performing under the contract, as stipulated in 3-122-112 HAR.
GG. COMPLIANCE WITH ACT 190, SHL 2011, (SB 758) Amendment to HRS 103D-310(c)
All procurements $2,500.00 or more will require Hawaii Compliance Express (HCE) proof of vendor compliance prior to the award or purchase. Individual compliance documents not produced by HCE are no longer acceptable. If the HCE certificate is not submitted on a timely basis for award of a contract, a bidder otherwise responsive and responsible may not receive the award.
