#1 Should parking area be quoted as well?  Answer: Just a concrete apron - additional parking will be taken care of by the VIllage
#2 Are utility extensions included? Answer: The building should be turn key - electric and gas are close to the building.
#3 Please clarify drainage needs. Answer: Sloped drainage is appropriate. Drainage is needed for light washing of vehicles.
#4 What type of insulation? Answer: Insulation should meet building code.

1. General Overview
The Village of Plain City (the “Village”) is soliciting bids for vendor(s) to design and build a metal
or wood pole barn at 225 Central Avenue, Plain City, Ohio 43064. The location is the current site
of the Public Works Department. Pole barn building size shall be no less than 40’ wide by 80’
deep with four overhead garage doors with powered openers (12’ x 12’) and two walk-through
doors, concrete floor with drainage, building heat, electric and lighting. Project shall include all
design, drawings, site permitting, excavation, brush/tree removal, preparatory work,
concrete/stone, materials, labor and electrical associated with the building. The selected vendor
is responsible for obtaining all appropriate stamped drawings, as approved by a professional
engineer, and obtain all required permits, inspections, and approvals from the Village of West
Jefferson Building Department for the project. The desired term of this agreement between the
Village and the selected vendor(s) will be effective immediately and conclude upon building
completion.

4. Vendor Disclosures
Vendor must provide a disclosure of any pending or threatened court actions and/or claims
against the vendor. This information may not cause rejection of the proposal; but withholding the
information may be cause to reject the proposal and/or termination of any potential contract.
5. Conflict of Interest
No vendor will promise, or give to any Village employee anything of value that could influence
that employee in their decision on awarding contracts. No vendor may attempt to influence an
employee of the Village to violate any procurement policies of the agency, the Ohio Revised
Code, or Federal Procurement Regulations.

6. Contractual Requirements
(1) Insurance - The Contractor shall not commence work under the Contract until it has
obtained all the insurance required hereunder and has submitted, in quadruplicate, an
appropriate Declaration of Insurance, as evidence of coverage which has been approved
by the Village and concurred by the Engineer. The Contractor shall not allow any
Subcontractor to commence work on its subcontract until all similar insurance required by
the Subcontractor has been so obtained and approved. Approval of the insurance by the
Village shall not relieve or decrease the liability of the Contractor hereunder. Such
insurance is as follows:
A. Workmen’s Compensation and Employers Liability as required by the laws of the
State of Ohio.
B. The Contractor shall acquire and maintain during the term of the Contract Bodily
Injury and Property Damage Liability Insurance under a standard Comprehensive
General/Automobile Liability Policy which shall provide and include coverage on
all Contractor's Operations, Protective (Sublet) Liability, Contractual Liability,
Completed Operations Liability, Owned Automobiles and Non-Owned and Hired
Automobiles.
C. Coverage for an "if any" basis: Property Damage Liability Insurance shall be
provided on any demolition, blasting, excavating, shoring or similar operation on
an "if any" basis.
D. Bodily Injury Liability limits shall be for an amount of no less than One-Million
($1,000,000.00) Dollars for injuries, including wrongful death to any one person
and subject to the same limit for each person, in an amount of not less than One-
Million ($1,000,000.00) Dollars on the account of any one occurrence.
E. Property Damage Liability Insurance in an amount of not less than One-Million
($1,000,000.00) Dollars per occurrence with General Liability extended to provide
"Broad Form Property Damage Liability" and in an amount of not less than Two-
Million Five-Hundred Thousand ($2,500,000.00) Dollars aggregate for damage on
account of all occurrences.
F. Any combination of underlying Comprehensive General/Automobile Liability
coverage with Umbrella/Excess Liability coverage which provides no less than
Two-Million Five-Hundred Thousand ($2,500,000.00) Dollars Single Limit Bodily
Injury & Property Damage Liability Insurance for the Contractor will also be
acceptable.
(2) Prevailing Wage – Pursuant to R.C. 4115.03, the prevailing wage does not apply to this
project as the total contract price is less than $250,000.
(3) Requirements of Contract Performance Bond – Provided that the successful Bidder
has not previously submitted a combined Bid Guaranty and Contract Bond with the Bid
Proposal, the successful bidder must, within ten (10) days after the award, and before
entering into contract, furnish a bond in form consistent with the requirements of Section
153.54 and related sections of the Ohio Revised Code, to the approval of, and of the form
prescribed by the Village, in an amount equal to one-hundred (100) percent (%) of the full
amount of the bid. Said Performance Bond shall have a date of validity until "final payment"
is deposited with the Contractor or until a later date as required.
(4) Execution of Contract - The Contract shall be signed by the successful Bidder and
returned, together with the performance bond, if applicable, within ten (10) days after the
bidder has received notice that the Contract has been awarded. No proposal shall be
considered binding upon the Village until the execution of the Contract and performance

bond.
(5) Failure to Execute Contract - Failure to execute and file an acceptable performance
bond, if applicable, and as provided herein within ten (10) days from date of award shall
be just cause for the annulment of the award and the forfeiture of the bid guaranty to the
Village, not as a penalty, but as liquidated damages. Award may then be made to the next
lowest and best bidder or the work may be re-advertised, as determined by the Village.
Said forfeiture shall be guided by the provisions of Section 153.54 of the Ohio Revised
Code.
(6) Lump Sum Contract - If the work is let on the basis of a lump sum contract, the estimated
quantities of work are only approximate, although the result of calculations, and the bidder
must obtain and be responsible for the data upon which it based its bid. It shall not be
entitled to any additional compensation in case the quantities of work actually done to fulfill
the contract and complete the project are greater than said estimate quantities, and
assumes all risks for any mistakes in calculations.
(7) Auditor of State - Section 9.24 of the Ohio Revised Code prohibits the Village from
awarding a contract to any entity against whom the Auditor of State has issued a finding
for recovery, if the finding for recovery is “unresolved” at the time of award. By submitting
a bid, the vendor warrants that it is not now, and will not become, subject to an
“unresolved” finding for recovery under R.C. 9.24 prior to the award of any contract arising
out of the RFP without notifying the Village of such finding. The Village will review the
Auditor of State’s website prior to completion of evaluations of bids submitted pursuant to
this RFP. The Village will not evaluate a bid from any vendor whose name or the name of
any of the subcontractors proposed by the vendor, appears on the website of the Auditor
of the State of Ohio as having an “unresolved” finding for recovery.
(8) Federal Acquisition Regulation (FAR) - Subpart 9.405(d) requires the Village to review
the Federal Excluded Parties Lists System prior to the award of any contract arising out of
the RFP. The Village will not evaluate a bid from any vendor whose name or the name of
any subcontractors proposed by the vendor appears on the Federal Excluded Parties List.
(9) Equal Employment Opportunity - The vendor shall comply with Executive Order 11246,
“Equal Employment Opportunity” as amended by Executive Order 11375 and
supplemented by Department of Labor Regulations.
(10) Amendment - This contract may be amended at any time by written instrument,
agreed to, and signed by all parties. Either party, the Village or the vendor, upon thirty (30)
days written notice given by either party to the other may terminate this contract.
(11) Breach - The vendor shall not be relieved of liability to the Village for damages
sustained by the Village by virtue of any breach of contract by the vendor. The Village
reserves the right to legal, administrative, and contractual remedies for damages sustained
by the Village by virtue of any breach of the contract by the vendor. The Village may
withhold any compensation from the vendor until the amount of damages due from the
vendor is agreed upon or otherwise terminated.
(12) Non-Discrimination - The vendor agrees that there shall be no discrimination against
any customer or any employee because of race, color, sex, religion, disability, national
origin, or any other factor as specified in Title VI of the Civil Rights Act of 1964,
Rehabilitation Act of 1973 and subsequent amendments. It is further agreed that the
vendor will comply with all appropriate federal and state laws regarding such
discrimination.
(13) Audit - The vendor shall retain and make available for audit by the Village, the State of
Ohio (including, but not limited to, the Auditor of the State of Ohio, Inspector General, of
