CALL FOR SEALED BIDS
ONE-TIME PURCHASE OF HIGH-DENSITY POLYETHYLENE PIPE
INVITATION TO BID #2026-0035-01
Cowlitz County will receive sealed bids until 1:30 p.m. on Monday, August 17, 2026, for the one-time
purchase of High-Density Polyethylene Pipe, as specified herein.
All bids received will be publicly opened and read in the training room of the Public Works Administration
Building at that time. The bid opening will also be accessible via Zoom by visiting
https://us06web.zoom.us/j/84769294913. A recording of the bid opening, along with bid results, will be
posted on the Cowlitz County website following the meeting.
All bids must be submitted on the attached Bid forms. By submitting a bid, the bidder agrees to be
bound by all terms, conditions, and requirements contained herein, unless a proposed deviation is
expressly identified in the bid and accepted by the County.
The outside of the envelope must have the following information:

Firm prices are solicited for High Density Polyethylene Pipe IPS SDR 17, PE4710, with a minimum 2%
Carbon Black UV Stabilizer, in 40-ft lengths. Cowlitz County will accept no additional charges, including
but not limited to freight, fuel surcharges, or any other fees. This includes products shipped directly
to the County by a manufacturer or distributor on behalf of the vendor.
Bids can be mailed or delivered in person to the address listed above. Faxed and/or e-mailed bids will
not be accepted. Cowlitz County offices are not open for mail or other deliveries on Fridays, weekends,
County holidays, or inclement weather closures. Cowlitz County will assume no responsibility for any
delay in U.S., County, or any other delivery service resulting in a bid being received late. Bids received
after the date and time stated in this call for bids will not be accepted and will be returned unopened to
Bidder. There will be no exceptions or waivers of this requirement. The County's determination of
when a bid was received shall be final and non-appealable.
All documents received in response to this invitation to bid will become a matter of public record and
subject to the Washington public disclosure act under chapter 42.56 RCW.
The Board reserves the right to reject any or all bids, waive informalities or minor irregularities in any
bid, and award the contract to the lowest responsive and responsible bidder whose bid is determined
to be in the best interest of the County.

APPENDIX A
COWLITZ COUNTY PUBLIC WORKS
PURCHASE CONDITIONS
A. This bid is intended to provide a firm price for the one-time purchase of High-Density Polyethylene Pipe in
accordance with the specifications contained herein.
B. In event of a discrepancy between the bid unit price and the unit price extension listed in the bid form, the
bid unit price shall govern. The County does not guarantee any additional purchases beyond the quantities
identified in the bid documents. The awarded bidder shall furnish and deliver the quantities requested by
the County in accordance with the contract requirements.
C. Term: The contract shall commence upon issuance of the County's Notice of Award or Purchase Order and
shall remain in effect until all materials have been delivered, accepted, and payment has been made, unless
earlier terminated in accordance with these Purchase Conditions.
D. Right to Reject/Accept: The County reserves the right to reject any or all bids, waive informalities or minor
irregularities, and award the contract to the lowest responsive and responsible bidder whose bid is
determined to be in the best interest of the County.
E. Changes: Prices may be increased with 30 days' written notice from the vendor. Any increase shall be limited
to the documented increase in the manufacturer's cost. Upon request, the vendor shall provide written
documentation from the manufacturer supporting the increase.
F. Freight: Cowlitz County will accept no additional charges, including but not limited to freight, fuel surcharges,
or any other fees. This includes products shipped directly to the County by a manufacturer or distributor on
behalf of the vendor.
G. Invoices: Payment will be made in accordance with applicable state law following receipt of properly
completed invoices and acceptance of delivered materials.. Vendor shall accurately invoice per the prices in
the contract and shall issue one invoice per order. Invoices shall be mailed to:

H. Cooperative Purchasing: RCW 39.34 allows cooperative purchasing between public agencies in the State of
Washington. Other public entities (cities, school districts, and so forth), which have filed an interlocal
cooperative joint purchasing agreement with the County may elect to purchase from the vendor based on
the terms and conditions of this agreement, subject to vendor's consent.
I. Deviations: Deviations or alternatives to these specifications will be considered to allow manufacturers to
follow their standard manufacturing processes. Any proposed deviation or alternative must be clearly
identified and fully described in the bid, unless otherwise specified. The County, in its sole discretion, may
approve such deviations only if they do not adversely affect the quality, strength, performance, efficiency,
effectiveness, or service life of the materials. A bid containing deviations or alternatives may be accepted
only with those expressly identified and approved by the Board as part of the contract award. Any deviation
not disclosed in the bid shall not be permitted.
J. Contract/Award: The contract between the County and the successful bidder shall be formed upon issuance
of the County's written Notice of Award or Purchase Order. The contract shall consist of this Invitation to
Bid, including these Purchase Conditions, any addenda issued by the County, the successful bidder's
submitted bid, approved deviations, and the County's Notice of Award or Purchase Order. The bidder's
acceptance of the award constitutes agreement to perform in accordance with all contract requirements.
K. Delivery: The vendor shall deliver the quantities specified in the bid documents to the location designated
by the County. Delivery schedules shall be coordinated with the County following award. The vendor shall
provide all necessary labor, equipment, transportation, and handling required to complete delivery unless
otherwise specified in the contract.
L. Inspection and Acceptance: The County shall have a reasonable opportunity to inspect delivered materials
for compliance with the contract requirements. Materials that do not conform to the contract may be
rejected by the County. Rejected materials shall be removed, replaced, or corrected by the vendor at no
additional cost to the County. Payment shall not constitute acceptance of defective or nonconforming
materials.
M. Warranty: The vendor warrants that all materials furnished under the contract shall conform to the
specifications, be new and unused unless otherwise approved by the County, and be free from defects in
material and workmanship. The vendor shall provide any manufacturer's warranties applicable to the
materials. Any manufacturer's warranty shall be in addition to, and not in limitation of, the vendor's
obligations under this contract.
N. Risk of Loss: Risk of loss or damage to materials shall remain with the vendor until delivery and acceptance
by the County.
O. Compliance with Laws: The vendor shall comply with all applicable federal, state, and local laws, regulations,
ordinances, and requirements applicable to the performance of this contract.
P. Conflicting Terms: Any additional or conflicting terms contained in vendor quotations, acknowledgments,
invoices, packing slips, or other documents shall not apply unless expressly accepted in writing by the
County.
Q. Assignment: The vendor shall not assign or transfer any interest or obligation under this contract without
prior written consent of the County.
R. Governing Law: This contract shall be governed by the laws of the State of Washington. Venue for any action
arising under this contract shall be exclusively in the Superior Court of Cowlitz County, Washington.
S. Severability: If any provision of this contract is determined to be invalid or unenforceable, the remaining
provisions shall remain in full force and effect.
