Electronic bids will be received via Bid Express at www.bidexpress.com on behalf of the Cobb County Board of
Commissioners, until 12:00 noon on October 9, 2025. NO BIDS WILL BE ACCEPTED AFTER THE 12:00 NOON
DEADLINE. Those received late will be unopened. No submitted bid may be withdrawn after the scheduled bid opening for
a period of Ninety (90) days.
All bids shall be accompanied by an Electronic Bid Bond via Bid Express a Paper Bid Bond, or a Certified Check
delivered in a sealed envelope, indicating the project name and project number, to Cobb County Procurement Services
Department, 1828 West Oak Parkway, Marietta, Georgia 30062, BEFORE THE 12:00 NOON DEADLINE. Bid Bond
shall be drawn in favor of the Board of Commissioners, Cobb County, Georgia, in the amount of five percent (5%) of
the bid for the complete work.
The bids will be publicly opened and read aloud at 2:00 p.m. on October 9, 2025, at the Cobb County Procurement
Services Department, 1828 West Oak Parkway, Marietta, Georgia 30062.
A prebid conference for all bidders will be held in person and by teleconference, at 9:00 a.m. on September 23, 2025. Any
questions must be received by Cobb County Procurement Services Department the Friday prior to the bid opening.

Receipt of addenda must be acknowledged online at www.bidexpress.com. It is the bidder's ultimate responsibility to
ensure that they have all applicable addenda prior to bid submittal and to utilize the latest bid schedule.
All bidders submitting bids in excess of $2,000,000.00 shall be prequalified with the Georgia Department of Transportation
(GDOT). All bidders submitting bids $2,000,000.00 or less shall be registered subcontractors or prequalified with GDOT.
All subcontractors, including DBE firms, shall be prequalified or registered with GDOT.
The work to be performed consists of the furnishing of all materials, labor, equipment and other things necessary for the for
the complete construction of:

Project Name: Resurfacing Contract 2026-1 Local Roads (Northwest)
Project consists of asphaltic resurfacing on various county streets, including variable depth milling, patching, and
pavement markings.
All roads to be completed by October 31, 2026. Liquidated damages of $2,000.00 per day shall be assessed for failure
to complete the project within the specified time frame.
Payment will be made monthly based on approved invoices.
For all bids on contracts involving utility work as defined in O.C.G.A. 43-14-1 et.seq., the Contractor and/or its
subcontractor(s) that will perform utility work must have a valid State of Georgia Utility Contractor License and comply
with all applicable provisions of Chapter 14 of Title 43 of O.C.G.A.
All work performed for this project will be in accordance with the Georgia Department of Transportation Standards and
Details; GDOT Standard Specifications Construction of Transportation Systems, 2021 Edition (including modifications dated
April 2024); all Georgia Department of Transportation Construction Standards and Details are applicable unless otherwise
noted and any modifications identified in the bid documents.
Disadvantaged Business Enterprise (DBE) Participation and Small Business Participation (SBP) in all DOT contracts is
encouraged. Bidders are subject to the requirements of Title 49, Code of Federal Regulations, Part 26, Participation by
Disadvantaged Business Enterprises in Department of Transportation Financial Assistance Programs. Contractors must
submit a DBE Participation Schedule to the County with this bid and a final DBE report must be submitted at the end of a
project. Any subsequent changes and/or substitutions of DBE firms from the original DBE Participation Schedule must be
submitted and approved by the County in advance. Monthly DBE reports must be submitted with each monthly invoice.
DBE firms must be certified with the Georgia Department of Transportation’s Equal Employment Opportunity (EEO)
office.
No Small Business reports are currently required; however, this is subject to change at the County’s discretion.
The Cobb County, Georgia, Department of Transportation in accordance with Title VI of the Civil Rights Act of 1964 and 78
Stat. 252, 42 USC 2000d—42 and Title 49, Code of Federal Regulations, Department of Transportation, Subtitle A, Office of
the Secretary, part 21, Nondiscrimination in federally assisted programs of the Department of Transportation issued pursuant
to such Act, hereby notifies all bidders that it will affirmatively ensure that in any contract entered into pursuant to this
advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and
will not be discriminated against on the grounds of race, color, sex, national origin, disability, or age in consideration for an
award.
Bidders must comply with Title VI of the Civil Rights Act of 1964, the Anti-Kickback Act, the Contract Work Hour Standard
Act, and the National Occupational Safety and Health Act of 1970.
Bidders must certify that they do not and will not maintain or provide for their employees any facilities which are segregated
on a basis of race, color, creed or national origin.
The Contractor and their subcontractors are required to be in compliance with the "Georgia Security and
Immigration Compliance Act." The Contractor must execute and submit at the time of the bid the "Contractor
Affidavit and Agreement," or bid will be determined non-responsive and will be disqualified.
Failure to comply with any of the requirements and procedures of the County (i.e., failure to timely supply required affidavits
or compliance certification documents; failure to utilize federal work authorization procedures; failure to permit or facilitate
audits or reviews of records by records by County officials upon request; and/or failure to continue to meet any of the
statutory or County obligations during the life of the contract) shall constitute a material breach of the agreement and shall
entitle the County to dismiss any general contractor or to require the dismissal of any subcontractor or sub/subcontractor
(irrespective of tier) for failing to fully comply with these requirements, and that upon notice of a material breach of these
provisions, the Contractor (or subcontractor, regardless of tier) shall be entitled to cure the breach within ten (10) days and
provide evidence of such cure. Should the breach not be cured, the County shall be entitled to all available remedies,
including termination of the contract, the requirement that a subcontractor be dismissed from performing work under the
contract, and any and all damages permissible by law.
All bidders must be on record Bid Express as being plan holders. All bids shall be submitted through Bid Express at
www.bidexpress.com. Paper bids will no longer be accepted.
Registering as a vendor with Cobb County is NOT required for bid submittal. Registering as a vendor does not
guarantee receipt of future Cobb County bid packages.
The Cobb County Board of Commissioners reserves the right to reject all bids and to waive formalities. Any claims for cost
incurred by any Bidder in preparation of any part of or total package for this project will not be considered for reimbursement
by Cobb County.
