QUESTIONS DUE: January 6, 2026 – 4:30 PM (EST) RESPONSES DUE BY: January 16, 2026 – 4:30 PM (EST) STATE CONTACT: James Meyers, State Senior Purchasing Agent E-MAIL : BGS.OPCVendorDocs@vermont.gov Revision Date: 11/12/2025 Page | 2 CONSTRUCTION INVITATION TO BID DEPARTMENT OF BUILDINGS AND GENERAL SERVICES STATE OF VERMONT Contractors are invited to bid on the CCC Road Plymouth Switchbacks Repair and Clean Water Project for Buildings & General Services on behalf of the Agency of Natural Resources – Department of Forests, Parks & Recreation at 2-1866 Shrewsbury Road in Plymouth, Vermont. This project consists of, but is not limited to: The CCC Road Plymouth Switchbacks Repair and Clean Water Project consists of repairing and upgrading the eastern 1.95 miles of the CCC Road, a State Forest Highway. The road serves as important access to Coolidge West State Forest for recreation and forest management activities as well as a valued travel corridor over the Green Mountains between the towns of Shrewsbury and Plymouth, VT. 1.0 Repairs will be made to damaged sections of road from the July 2023 Flood and upgrades will be made to meet Clean Water Quality Standards, outlined below. The project includes work in the following three categories: Ditches, Culverts, and Road Resurfacing. It also includes requirements for mobilization, erosion control, and disposal of excess material. Work locations are flagged on the ground. Numbers on the flags correspond to the attached map and Ditching and Culvert Field Data sheets. The State will work with the contractor to identify work in the field. 2.0 The Successful Bidder shall complete the following: 2.1 Mobilization 2.1.1 Mobilization will be conducted according to the standards found in Standard Specifications for Road Construction and Maintenance Practices on Agency of Natural Resources Lands (page 6). Equipment Cleaning 2.1.2 To prevent the spread of invasive plants, all equipment shall be washed prior to entering onto state land according to the standards found in Standard Specifications for Road Construction and Maintenance Practices on Agency of Natural Resources Lands (page 6). 2.1.3 Some portions of this project will require digging in soil contaminated with gout weed. After equipment has been exposed to this soil, it shall be cleaned prior to moving to other project locations. 2.1.4 The state may require equipment to be cleaned if it is found not to be in compliance with these requirements. Notification Revision Date: 11/12/2025 Page | 3 2.1.5 Contractor shall notify the State at least two weeks prior to starting project in order to notify the public of the CCC Road closure. 2.2 Operational Requirements 2.2.1 Work shall occur between May 15th and November 1st during appropriate weather and soil conditions as determined by the State. 2.2.2 The CCC Road may be shut down during operations. 2.2.3 Contractor is responsible for supplying and maintaining road closure signage and closing/ locking gates during project operation. 2.2.4 Any changed combination codes on gates will be shared with FPR 2.2.5 If the project will not be finished before winter, the contractor will ensure that the CCC Road will be passable by snowmobile and groomer for the snowmobiling season (starting December 16th). 2.2.6 Ditch and culvert work shall occur prior to road resurfacing work. 2.3 Disposal of Excess Materials 2.3.1 Disposal of excess materials shall be done according to the standards found in Standard Specifications for Road Construction and Maintenance Practices on Agency of Natural Resources Lands (page 28). Additional specifications are below. 2.3.2 Excess material can be wasted close to where it originates from, provided it can be blended in to match existing grade and road shape. 2.3.3 Excess materials from ditches and culverts that are identified as having invasive plants in the data sheets shall be hauled uphill and dumped on a log landing site as designated on the map to allow for future efficient treatment of invasive plants. 2.3.4 If larger amounts of material need to be wasted, the contractor will coordinate with the state for a suitable location along the CCC road. Large waste areas will be smoothed, seeded, and mulched. 2.4 Sediment Control 2.4.1 Sediment control shall be done according to the standards found in Standard Specifications for Road Construction and Maintenance Practices on Agency of Natural Resources Lands (page 28-31). 2.5 Road Maintenance and Repairs Includes culverts, ditching and resurfacing. There are two sets of work points in this project, and the time and materials needed for these two sets must be bid separately as shown in the price schedule. The work is split out as follows: 2.5.1 Execute repairs and upgrades related to the July 2023 floods (FEMA). All work described below will be done according to the specifications in Standard Specifications for Road Construction and Maintenance Practices on Agency of Revision Date: 11/12/2025 Page | 4 Natural Resources Lands and any additional requirements listed below. Specifically, this will entail: 2.5.1.1 Ditches 2.5.1.1.1 Overview of Ditch Work Ditch work will occur on about 2,440 feet of ditches. Ditch work for these work points includes stone lining ditches. Stone lined ditches shall be built to the specifications above, except where otherwise stated in the worksheet. 2.5.1.2 Culverts 2.5.1.2.1 Overview of Culvert Work There are four culvert head walls to repair. This work is summarized in Table 5 below. Additional specifications are below. • Culvert head walls shall be constructed and repaired with dry laid stone. Stone used will be appropriate for building dry laid stone walls, having two parallel sides for stacking, such as shot or blasted rock. Large rocks, at least 18” in one dimension, shall be used. Rocks found on-site may be appropriate and may be used, but shall not be taken from a stone wall, cellar, or other historic structure. For bidding purposes, assume all head and outlet wall rocks will need to be purchased and trucked in. 2.5.2 Execute additional upgrades unrelated to July 2023 floods (CWF). All work described below will be done according to the specifications in Standard Specifications for Road Construction and Maintenance Practices on Agency of Natural Resources Lands and any additional requirements listed below. Specifically, this will entail: 2.5.2.1 Ditches Overview of Ditch Work Ditch work will occur on about 3,280 feet of ditches. Ditch work includes cleaning turnouts, pushing back berms to allow road surface drainage, installing new shallow ditches, installing new ditches, and stone lining ditches. This work is summarized in the table below. The State will supply all culverts, and they will be stored at the VTrans District 3 Mendon Garage. The contractor is responsible for loading and transporting them to the jobsite (approximately 13 miles away). This includes new intermittent stream crossing culverts, new ditch relief culverts, and an upgraded culvert to replace an undersized culvert. This work is summarized in the table below. Culvert installation work shall be done according to the standards found in Standard Specifications for Road Construction and Maintenance Practices on Agency of Natural Resources Lands (pages 14-15, 22-26). Additional specifications are below. ? If the bell end is to be used on the inlet side, the bell end shall be cut off as it will not be able to support the head wall as well as the main body of the pipe. ? When replacing an old culvert with a new installation, the old culvert shall be removed from the site and disposed of. The State may indicate certain culverts to be retained by the State and delivered to a reasonably close-by transfer site. ? Culvert head walls shall be constructed and repaired with dry laid stone. Stone used will be appropriate for building dry laid stone walls, having two parallel sides for stacking, such as shot or blasted rock. Large rocks, at least 18” in one dimension, shall be used. For bidding purposes, assume all head and outlet wall rocks will need to be purchased and trucked in. 2.5.2.3 Resurfacing Overview of Resurfacing Work The final portion of this project is resurfacing 6,248 ft (1.18 miles) of road and road shoulder repair of about 120’ on the CCC road. The base bid for CWF funded work shall include only 1 –1 ½” minus crushed granite or hard stone material. The alternate bid for CWF funded work shall include mixed loads of 1 – 1 ½” minus crushed granite or hard stone material and 1 -1 ½” minus crushed slate or similar material that compacts well. Volume of material is estimated to be 1,950 cu yds. Specifications • Road resurfacing work shall be done according to the standards found in Standard Specifications for Road Construction and Maintenance Practices on Agency of Natural Resources Lands (pages 7-8). Additional specifications are below. • Road resurfacing work shall follow the order and specifications outlined in Table 17 below. • Material used shall be approved by the state prior to hauling on site. • New material shall be applied prior to the freshly graded road packing down in order for the new material to bond well with existing material. • If mixed load option is chosen by the State, material shall be applied in mixed loads with equal proportions of each material in each load. Every effort will be made to post this information as soon as possible after the question period ends, contingent on the number and complexity of the questions. Bidder’s attention is directed to: 1. General Conditions for Construction Contracts. It is the Bidder’s responsibility to thoroughly read and comply with all requirements. 2. STATEMENT OF RIGHTS: The State shall have the authority to evaluate Responses and select the Bidder(s) as may be determined to be in the best interest of the State and consistent with the goals and Revision Date: 11/12/2025 Page | 13 performance requirements outlined in this RFP. The State of Vermont reserves the right to obtain clarification or additional information necessary to properly evaluate a proposal. Failure of bidder to respond to a request for additional information or clarification could result in rejection of that bidder's proposal. To secure a project that is deemed to be in the best interest of the State, the State reserves the right to accept or reject any and all bids, in whole or in part, with or without cause, and to waive technicalities in submissions. The State also reserves the right to make purchases outside of the awarded contracts where it is deemed in the best interest of the State. 2.1. Presentation. An in-person or webinar presentation by the Bidder may be required by the State if it will help the State’s evaluation process. The State will factor information presented during presentations into the evaluation. Bidders will be responsible for all costs associated with providing the presentation. 3. COST OF PREPARATION: Bidder shall be solely responsible for all expenses incurred in the preparation of a response to this RFP and shall be responsible for all expenses associated with any presentations or demonstrations associated with this request and/or any proposals made. 4. CONFLICTS OF INTEREST: 4.1. Organizational Conflict of Interest (OCOI): An OCOI arises when a bidder as a business entity has interests (for example, customers, partners, contracts) that could undermine, or reasonably be perceived to undermine, its faithful and unbiased performance of a contract with the State that may result from this solicitation. 4.2. Personal Conflict of Interest (PCOI): A PCOI arises when an interest held by an individual, agent or employee of a bidder could undermine, or reasonably be perceived to undermine, its faithful and unbiased performance of a contract with the State that may result from this solicitation. 4.3. Requirements: The State does not seek to contract with any individual or business entity having a conflict of interest which cannot be mitigated to the State’s satisfaction. To ensure the State’s awareness of actual, potential, or reasonably perceived PCOIs and OCOIs, bidders shall: a) Prior to submitting a proposal, conduct an internal review of its current affiliations and activities and identify actual, potential, or reasonably perceived PCOIs or OCOIs relative to a contract with the State that may result from this solicitation. b) Disclose in your proposal any actual or potential PCOI or OCOI or the existence of any facts that may cause a reasonably prudent person to perceive a PCOI or OCOI with respect to a contract with the State that may result from this solicitation. Disclose, also, any actions proposed to mitigate the PCOI or OCOI. 4.4. The State shall have sole discretion to determine whether a PCOI or OCOI can be mitigated to the State’s satisfaction and may discuss the conflict with the bidder if and to the extent the State deems discussion necessary to its determination. The State reserves the right to (a) reject from further consideration any proposal having a PCOI or OCIO that cannot be mitigated to the State’s full satisfaction and (b) terminate a contract upon discovery that a contractor failed to disclose facts pertaining to a PCOI or OCOI in its proposal, or otherwise misrepresented relevant information to the State. 5. Unsolicited Bidder-Confidential Information Prohibited. Bidders are hereby expressly directed not to include any confidential information in their proposal submissions, except as specifically permitted below. By submitting a proposal in response to this RFP, bidders acknowledge and agree to abide by the terms and conditions outlined in this document, including the prohibition on submitting confidential information. This prohibition reduces the burden on the State while preventing bidder-confidential information from entering the public record. Revision Date: 11/12/2025 Page | 14 5.1.1. Disclosure under Public Records Act. All information received by the State in response to this solicitation will become part of the contract file and subject to public disclosure in accordance with the State’s Public Records Act, 1 V.S.A. § 315 et seq. The State may also choose to publicly post responses to this solicitation and the resulting agreement(s), following conclusion of this procurement process. 5.1.2. Unsolicited Confidential Materials. This RFP does not solicit bidder confidential information and bidders are expressly prohibited from providing confidential information in response to this RFP. All materials furnished by bidders in response to this RFP, including those marked as confidential by bidders, are subject to disclosure if requested under the Public Records Act, or public posting. 5.1.3. State Not Responsible for Disclosure of Unmarked Bidder-Confidential Information. It is the sole responsibility of the bidder to ensure that, other than where specifically directed or permitted by this RFP and accordingly marked as described below, no information that should not be publicly disclosed is included in their proposal materials, including any 1) trade secrets or intellectual property, 2) proprietary financial or business information, 3) personal information, or 4) any other information that should not be disclosed to the public. For example, bidders should avoid including specific details of their proprietary technologies or methodologies that they consider confidential, and any references to previous client engagements should be presented in a manner that does not disclose the client's confidential information. 6. Funding Source: This project is being funded using Vermont Capital Construction Act funds and federal funds. Placing qualified small and minority businesses and women’s business enterprises on solicitation lists; 1. Assuring that small and minority businesses and women’s business enterprises are solicited whenever they are potential sources; 2. Dividing total requirements, when economically feasible, into smaller tasks or quantities to permit maximum participation by small and minority businesses, and women’s business enterprises; 3. Establishing delivery schedules, where the requirement permits, which encourage participation by small and minority businesses, and women’s business enterprises; 4. Using the services and assistance, as appropriate, of such organizations as the Small Business Administration and the Minority Business Development Agency of the Department of Commerce; and 5. Requiring the prime/general contractor, if subcontracts are to be let, to take the same affirmative steps as listed in numbers 1 through 5. This project is being funded in whole or in part using federal monies. The awarded Contractor must fill out and sign the Executive Order 02-22 Vendor Certification as part of the Contract awarding process. This certification is required for all subcontracts for work performed solely for the State of Vermont and subcontracts for work performed in the State of Vermont. 9. BIDDER QUALIFICATION PROCESS DOCUMENT: The Department of Buildings and General Services is requiring that all contractors meet certain minimum qualifications to be eligible to bid on this project. 10. BID SUBMISSION INSTRUCTIONS: 10.1. CLOSING DATE: Bids must be received by the State by the due date specified on the front page of this RFP. Late bids will not be considered. 10.1.1. The State may, for cause, issue an addendum to change the date and/or time when bids are due. If a change is made, the State will inform all bidders by posting at the webpage indicated on the front page of this RFP. 10.1.2. There will not be a public bid opening. However, the State will record the name, city and state for any and all bids received by the due date. 10.2. ELECTRONIC BIDS ONLY: 10.2.1.
