1. Receipt and Opening of Bids.
a. Notice is hereby given that Sealed Bids, marked "SPRINGDALE STREET AND
WESTMINSTER BOULEVARD SEWER MANHOLE INSTALLATION PROJECT,
PROJECT NO. P2025-01", will be received by the Midway City Sanitary District Front
Desk in the District Office, 14451 Cedarwood Street, Westminster, California, until
11:00 AM, on January 20, 2026, at which time they will be publicly opened in the
Conference Room in the District Office.
b. Any bid received after the time and date specified above shall not be considered and shall
be returned to the bidder, unopened. A bid shall be considered to have been timely
submitted if it is received at any time before 11:01 a.m.
c. Bids received via mail, e-mail, or facsimile shall not be considered.
d. Each bid shall be submitted in a sealed envelope plainly marked:

3. Mandatory Pre-Bid Meeting and Walk Through. A mandatory pre-bid meeting and walk
through of the project site will be held December 11, 2025, at 10:00 A.M. Meet first at the
District Offices at 14451 Cedarwood Street, Westminster, CA, at 10:00 A.M., where instructions
will be provided for getting to and meeting thereafter at the Project location near the intersection
of Springdale Street and Westminster Boulevard, Westminster, CA. The meeting is mandatory
and attendance is required both at the District Offices and jobsite to be eligible to submit a bid
for the Project.
4. General Work Description. Generally, the project consists of constructing two (2) new sewer
manholes over existing sewers at the intersection of Westminster Boulevard and Springdale
Street, and includes (a) removal of conflicting existing 8-inch VCP sewer and (b) construction
of two (2) 48-inch diameter PVC Lined Manholes. The project will also require (but not be
limited to): protecting existing utilities; coordination with utility owners, shoring, dewatering,
maintaining the existing sewer flows during construction, traffic control, pavement resurfacing,
slurry seal pavement as required, traffic restriping, replacement of traffic loop detectors and
installation of raised pavement markers and appurtenant work.
5. The Engineer’s estimate for the Project is $1,195,620.
6. Contract Time. This project shall be completed within Ninety (90) calendar days from notice to
proceed.
7. Contractor’s License Requirement. Pursuant to Public Contract Code section 3300 and
Business & Professions Code section 7030.5, the Contractor must possess a valid Class A
Contractor's License at the time of the bid opening and specify its license number.
8. Requirement to be Authorized to do Business in California. All bidders and all designated
subcontractors shall be duly authorized to do business in California at the time of bid opening.
Contractors and subcontractors that are organized as a corporation, limited liability company,
or other entity under the laws of another state must be properly registered with the California
Secretary of State pursuant to applicable law.
9. Wage Rate Requirements.
a. The wage rates applicable to this Project are the State of California Department of
Industrial Relations (“DIR”) prevailing rates of per diem wages. Pursuant to the provisions
of Section 1770 et seq. of the Labor Code of the State of California, the Director of the
DIR has determined the general prevailing rate of the per diem wages and the general
prevailing rate for holiday and overtime work in the locality on which the work is to be
performed, for each craft, classification or type of worker needed to execute the contract
which will be awarded to the successful bidder. Per Diem wages shall be deemed to
include employer payments for health and welfare, pension, vacation, apprenticeship or
other training programs, and similar purposes. Copies of the prevailing rate of per diem
wages are on file at District’s principal office, which shall be made available to any
interested party on request, or on the Internet at the State Department of Industrial

Relations website (www.dir.ca.gov) under Office of the Director - Research. It shall be
mandatory upon the Contractor and on any subcontractor to pay not less than the said
specified rates to all workers employed in the execution of the contract. A copy of said
rates shall be posted at each job site during the course of construction. The Contractor
and all subcontractors shall comply with all provisions of the California Labor Code relating
to prevailing wage rates, including Sections 1770-1781.
b. Apprentices may be employed in conformity with Section 1777.5, 1777.6 and 1777.7 of
the California Labor Code. Every apprentice shall be paid the standard wage paid to
apprentices under the regulations of the trade at which he/she is employed. Information
relative to the employment of apprentices shall be obtained from the Director of the
Department of Industrial Relations, who is the Administrative Officer of the California
Apprenticeship Council. Copies of all collective bargaining agreements relating to the
work as set forth in the aforementioned Labor Code are on file and available for inspection
in the office of the State of California, Department of Industrial Relations, Division of Labor
Statistics and Research.
c. The Project is subject to compliance monitoring and enforcement by the Department of
Industrial Relations (DIR). The Contractor is responsible for complying with all
requirements of the DIR, including filing electronic payroll reports.
d. A contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal,
subject to the requirements of Section 4104 of the Public Contract Code, or engage in the
performance of any contract for public work on a public works project, unless currently
registered and qualified to perform public work pursuant to Labor Code Section 1725.5. It
is not a violation of Labor Code Section 1771.1 for an unregistered contractor to submit a
bid that is authorized by Section 7029.1 of the Business and Professions Code or by
Section 10164 or 20103.5 of the Public Contract Code, provided the contractor is
registered to perform public work pursuant to Section 1725.5 at the time the contract is
awarded.
10. Demonstration of Responsibility. Bidders must demonstrate to the satisfaction of the District
that they possess the trustworthiness, quality, fitness, capacity, and experience to satisfactorily
perform the contract. Each bidder must submit the information required by the contract
documents necessary for the District to evaluate and determine the bidder’s qualifications and
ability to perform the contract. Prior experience performing similar projects is necessary.
Bidders must provide evidence that they have successfully completed a minimum of five (5)
public projects involving the installation of sewer facilities within the public right-of-way, and a
minimum of three (3) public projects involve dewatering operations, in order to be eligible to be
awarded a contract. Projects that include both sewer installation and dewatering may be used
to satisfy both requirements. A contract will not be awarded to any bidder determined by the
District to not be a responsible bidder.
11. Securing Bid Documents. Plans and specifications are available online at the Midway City

12. Bids. Bidders shall comply with and agree to all instructions and requirements in this notice
and in the contract documents.
a. In conformance with Section 20483 of the Public Contract Code, all bids shall be
presented under sealed cover on the proposal form provided and accompanied by one of
the following forms of bidder's security:
i. Cash
ii. Cashier's check made payable to the Midway City Sanitary District.
iii. A certified check made payable to the Midway City Sanitary District.
iv. A bidder's bond executed by an admitted surety insurer, prepared on the
forms provided and made payable to the Midway City Sanitary District.
The security shall be in an amount equal to at least 10 percent of the amount bid. A bid
shall not be considered unless one of the forms of bidder's security is enclosed with it.
BIDDER’S SECURITY SHALL BE FORFEITED, PAID TO, OR RETAINED BY THE
DISTRICT AS LIQUIDATED DAMAGES, SHOULD THE BIDDER TO WHOM THE
CONTRACT IS AWARDED FAIL TO ENTER INTO THE CONTRACT OR FAIL TO
PRESENT SATISFACTORY BONDS OR INSURANCE TO THE DISTRICT AS
REQUIRED BY THE CONTRACT DOCUMENTS.
b. Midway City Sanitary District reserves the right to reject any or all bids or waive any
irregularities or informality in a bid. The Midway City Sanitary District also reserves the
right to withdraw this Invitation for Bids at any time for any reason without prior notice and
the Midway City Sanitary District makes no representations that the contract will be
awarded to any Bidder responding to this Invitation for Bids.
c. No bid will be accepted from a contractor who is not licensed at the time of bidding in
accordance with the provisions of Chapter 9, Division III of Business and Professions
Code and in accordance with the Public Contract Code.
d. The award of the contract, if awarded, will be to the lowest responsive and responsible
bidder whose proposal complies with the requirements prescribed. Such award, if made,
will be made within sixty (60) calendar days after the opening of the bids. This period will
be subject to extension for such further period as may be agreed upon in writing between
the DISTRICT and the lowest responsive and responsible bidder. All bids will be
compared on the basis of the Engineer’s Estimate of the quantities of work to be done.
e. If tie bids from two or more responsive and responsible bidders are received, the District
may, at its discretion: (i) reject any and/or all bids presented and re-advertise; (ii) accept
any of the tie bids; (iii) accept the lowest bid made by negotiation with the tie bidders; or
(iv) award the contract to any one of the low tie bidders by lot occurring during a public
meeting.
13. The successful bidder will be allowed to substitute securities or establish an escrow in lieu of
retainage, pursuant to Public Contract Code Section 22300, and as described in the contract
documents.
14. In accordance with Civil Code section 9550, the successful bidder will be required to furnish a
Payment (Labor and Material) Bond in the amount of one hundred percent (100%) of the

Contract Sum, and a Faithful Performance Bond in the amount of one hundred percent (100%)
of the Contract Sum, said bonds to be secured from an Admitted Surety (an insurance
organization authorized by the Insurance Commissioner to transact business of insurance in
the State of California during this calendar year), and U.S. Treasury listed. The successful
bidder will be required to furnish insurance as set forth in the contract documents.
15. District’s Rights Reserved. The Midway City Sanitary District reserves the right to reject any or
all bids, to waive any irregularities or informalities in a bid, and to make awards to the lowest
responsive, responsible bidder as it may best serve the interest of the Midway City Sanitary
District.
16. The District does not maintain a list of pre-qualified approved contractors. Any qualified
contractor may submit a bid.
