    NOTICE TO PROSPECTIVE BIDDERS
    SUBJECT: INVITATION TO BID FOR DIVISION 12 PROJECT.

    DESCRIPTION: TRAFFIC SIGNAL / ITS SYSTEM INSTALLATION &
    MODIFICATION, UPON REQUEST
    The North Carolina Department of Transportation is requesting bids for traffic signal installation
    type work in all counties of Division 12. The Contractor is to furnish labor, material, equipment
    and traffic control:
    CONTRACT TIME:
    The availability date for this contract will be September 1, 2026.
    The completion date for this contract will be August 31, 2027.
    PROPOSAL COPIES:

    under Division 12 or obtained from the Division 12 Office, located at 1710 E. Marion Street in
    Shelby, N.C. 28152, by contacting Greg Brittain at 980-552-4222. Please refer to the WBS
    element(s) or project description when making requests.
    BID OPENING:
    Sealed bids must be received in the Division Engineer's Office, located at 1710 E. Marion Street,
    Shelby, N.C. 28152, by 2:00 p.m. on Tuesday, July 28, 2026. Bids must be submitted on the
    official bid sheet as detailed in the Instructions to Bidders along with the complete proposal and
    display the following statement on the front of the envelope:

    ADDITIONAL INFORMATION:
    Potential Bidders must be prequalified as Bidder or P.O. Prime Contractor at the time of bid
    opening in order to be considered responsible. Information about prequalification can be found at

    Paper Bids will be accepted as detailed in the Instructions to Bidders contained in the Proposal.
    Electronic Bidding will not be accepted. Bid Bonds are not required.

    The North Carolina Department of Transportation, in accordance with the provisions of Title VI of
    the Civil Rights of 1964 (78 Stat.252) and the Regulations of the Department of Transportation (49
    C.F.R., Part 21), issued pursuant to such act, hereby notifies all bidders that it will affirmatively
    insure that the contract entered into pursuant to this notice will be awarded to the lowest responsible
    bidder without discrimination on the grounds of sex, race, color, or national origin.

    Notice Regarding Upcoming Buy America Changes
    On January 14, 2025, the Federal Highway Administration (FHWA) terminated its General Waiver
    for Manufactured Products and established specific Buy America requirements for their use on
    Federal-aid highway projects.
    This means that as of the following dates, materials defined as manufactured products
    permanently incorporated into Federal-aid highway projects will have to be manufactured in the
    United States.
    Key Implementation Dates
    * Phase 1: contracts obligated on or after October 1, 2025
    Final assembly of all manufactured products permanently incorporated into
    o
    Federal-aid highway projects must occur in the United States.
    * Phase 2: contracts obligated on or after October 1, 2026
    Final assembly of all manufactured products permanently incorporated into
    o
    Federal-aid highway projects must occur in the United States.
    AND
    The cost of U.S.-produced components in manufactured products must be
    o
    greater than 55% of the total cost of all components.
    Definition of Manufactured Products
    Manufactured Products are defined as articles, materials, or supplies that:
    * Have been processed into a specific form and shape, or
    * Have been combined with other articles or supplies to create a product with different
    properties than the individual articles, materials, or supplies.
    This places greater emphasis on using domestically produced materials on these projects and is
    consistent with the Build America, Buy America Act (BABA) under the Bipartisan Infrastructure
    Law (BIL).
