Emergency Islandwide Debris Removal, Hauling, and Disposal

Questions and Concerns received from Guam Cleaning Masters, Inc. on August 18, 2026.

1. Our strategic approach for IFB GSA-047-26 is for Guam Cleaning Masters, Inc. to serve as the Prime

Contractor, retaining overall responsibility for contract administration, project management, DPW

coordination, quality control, load-ticket reconciliation, invoicing, subcontractor oversight, and contract

compliance, while subcontracting the specialized debris collection, loading, hauling, transportation,

recycling, and disposal activities to qualified and properly licensed and permitted subcontractors.

Under this proposed structure, the subcontractor(s) performing the physical debris-removal operations

would hold all licenses, permits, registrations, and authorizations applicable to the work they perform,

including applicable Guam business licenses, Guam EPA solid-waste collection permits,

contractor/specialty licenses, vehicle registrations, and disposal or recycling authorizations.

We respectfully request clarification regarding the licensing requirements applicable to the Prime

Contractor under IFB GSA-047-26. Specifically, please confirm:

1. Whether the above-described prime/subcontractor structure is permissible under the IFB;

2. Whether the Prime Contractor may satisfy the specialized licensing and permitting

requirements associated with debris collection, hauling, transportation, recycling, and disposal

through appropriately licensed and permitted subcontractors performing those activities;

3. Which Business License, Contractor’s License, Specialty License, Guam EPA permit, or other

license/permit, if any, must be held directly in the name of the Prime Contractor prior to award,

as distinguished from licenses and permits that may be held by the subcontractors actually

performing the regulated work; and

4. If a Contractor’s License or Specialty License must be held directly by the Prime Contractor,

whether the Prime Contractor may satisfy that requirement by qualifying through a properly

licensed Responsible Management Employee (RME) / Project Manager formally associated with

the Prime Contractor.

Response: The proposed prime/subcontractor arrangement is not prohibited under the Invitation for

Bid (IFB). The prime contractor may utilize qualified subcontractors for portions of the required services,

provided such arrangement is consistent with the IFB and applicable laws and regulations.

Where a subcontractor performs work that is subject to separate licensing, permitting, or authorization

requirements, the subcontractor shall comply with the requirements applicable to the work it performs.

Both the prime contractor and subcontractor shall independently satisfy the licensing and permitting

requirements applicable to their respective roles or activities.

With respect to the Contractor’s License, Specialty License, RME, or Project Manager requirements, the

prime contractor shall comply with the requirements applicable to the prime contract under Guam law.

The Guam Contractor’s License Board (CLB) is the appropriate authority for determining applicable

contractor licensing requirements, including requirements concerning the RME and classifications.

Please Note: Follow-up/Clarification to the Questions and Concerns responses dated 9/2/2026 must

be submitted to the General Services Agency via email to bids@gsadoa.guam.gov no later than 5:00

PM, Thursday, September 3, 2026.
