INTRODUCTION
The City of Wheaton ("City") is seeking a contractor to perform public-side lead service line replacements (LSLRs).
The goal of the LSLR program is to be compliant with the Lead Service Line Replacement and Notification Act that was
signed into law in 2021.
TERM
Anticipated start date: August 15, 2026
Substantial Completion Date: December 31, 2026
The term of the contract shall be for one (1) year from the date of award and acceptance by the City.

DISADVANTAGED BUSINESS ENTERPRISE (DBE)
The City encourages minority business firms to submit proposals for the LSLR program. Plumbers or utility contractors
soliciting subcontractors shall also make a good faith effort to contract with subcontractors meeting the minority
business firm requirements.
QUALIFICATIONS AND EXPERIENCE OF CONTRACTORS
Contractors shall have the following minimum experience:
* Ten years' experience as a continuously operating entity engaged in the performance of similar work.
* Must have successfully completed at least five (5) lead service line replacements and restorations within the
last three (3) years.
SCOPE OF WORK
The City has a multi-year full LSLR program. The 2026 LSLR program consists of a total of approximately 50 public-
side lead service line replacements. Work includes replacement of Public Lead Service Lines between the existing
water main and the B-box in the parkway
The project includes restoration of outside areas such as sidewalks, driveways, roadway patching and sodding which
is described in the attached specifications. The work to be done under this contract includes but is not limited to; the
providing of all labor, materials, supervision, equipment, services, incidentals, and related items necessary to
complete the work in accordance with this specification and scope of work. All work is to be performed in accordance
with all applicable federal, state, county and local laws, ordinances, and codes; and in accordance with the detailed
Specifications included herein.
The City may add, delete, or change the work locations or details of the marking layouts at any time during the work
period, with at least two (2) working days prior notice to the Contractor.

WORK HOURS
All work shall be performed Monday-Friday between the hours of 7:00 a.m. and 3:30 p.m. City representatives will
only be available between 7:00 am and 3:30 pm on weekdays. Except for work required to maintain warning lights,
barricades and other safety/health-related systems, no work shall be performed on Saturdays, Sundays, legal
holidays, or between 3:30 p.m. and 7:30 a.m. on other days without specific permission of the City. Additionally, no
work will be allowed in certain areas of the project on days as specified by the City.
SUPERVISION OF WORK
The Contractor shall properly supervise the performance of the work so as to ensure its completion in a timely
manner, safely, accurately, and in accordance with the requirements of the contract documents. The Contractor shall
be fully responsible and assumes liability for the acts and omissions of all persons directly or indirectly employed by,
or working at the direction of, the Contractor in the completion of the work.
The Contractor shall have on the work site at all times, as the Contractor's agent, a competent English-speaking
representative capable of reading and thoroughly understanding the Contract Documents and thoroughly
experienced in the type of work being performed. The representative shall also be capable of receiving instruction
from City staff and shall have full authority to promptly respond to such instruction. He/she shall be capable of
supplying such
materials, equipment, tools, labor, and incidentals as may be required. The Contractor shall not replace him/her
without prior written notification to the City. The Contractor's agent shall address all concerns and communicate
resolution to the City's Project Manager or designee, within a one (1) hour window.
ACCIDENT PREVENTION AND PROTECTION OF PERSONS AND PROPERTY
The Contractor shall exercise every precaution at all times for the protection of the persons and properties. Respect
for all property is very important. The Contractor is responsible to protect all existing and newly installed work,
materials, equipment, improvements, utilities, structures, and vegetation at all times during the course of this
contract. Any property or incidentals damaged during the course of this contract shall be repaired or replaced to the
satisfaction of the City at the Contractor's sole cost.
The safety provisions of all applicable laws and ordinances shall be strictly observed. Any practice obviously hazardous
in the opinion of the City's Project Manager or designee shall be immediately discontinued by the Contractor. The
Contractor shall abide by all applicable laws, standards, and regulations that apply to the completion of the work,
including EPA and OSHA safety standards and regulations. The Contractor shall assume and bear all risk of damage to
the work, and all risk of any accident(s), from whatsoever cause arising, until the work herein provided for shall be
fully completed and accepted by the City.
PROPERTY DAMAGE
The Contractor shall take great care to avoid damaging adjacent property, including sidewalk, fencing, landscape
borders and landscaping (trees, shrubs, turf, etc.). The Contractor shall be held responsible for all damage to property
including, but not limited to, existing landscaping including turf, planters, bicycle racks, litter containers, light and
traffic signal poles, parking meters, fire hydrants, curbs, vehicles, buildings, and structures, etc. All damage will be
the responsibility of the Contractor to repair to its original condition and to the satisfaction of the City.
MOTORIZED EQUIPMENT
Under no circumstances shall any motorized equipment be permitted to be driven on the private property or
driveways without prior authorization from the resident and the City's Project Manager or designee while performing

work under the provisions of this contract. Plywood or other support or protection must be placed on the parkway
and/or private property prior to operating or parking vehicles or equipment on or over such property or other support
or protection must be placed on the private property prior to operating or parking vehicles or equipment on or over
private property.
CONTROL OF WORK
No work shall commence by the Contractor until a pre-construction meeting has been held and a 48-hour notice has
been provided to the City's Project Manager or designee. The Contractor and/or their sub-contractor shall contact
any resident prior to a temporary loss of access to their house or water service a minimum of 48 hours but not more
than 72 hours, prior to the commencement of these activities. The morning of the work, the Contractor will again be
required to notify the residents door to door. The Contractor should provide information regarding the anticipated
time that full access will be restored. Coordination between activities should allow for work to be done in a timely
manner.
CONSTRUCTION SCHEDULING
All scheduling related to construction or pre-construction activities shall be coordinated by the City's Project
Manager or designee. At no time shall the Contractor contact a homeowner regarding the scheduling of a pre-
construction inspection or the construction of a water service replacement. The Contractor acknowledges that there
is work taking place that requires cooperation with private home and business owners and as such, acknowledges
that there will be no additional payments made for downtime due to home or business owner related scheduling
issues.
Should a scheduling issue occur due to a home or business owner, the City's Project Manager or designee shall make
an effort to fill lost time with an alternate location, but this shall not constitute a guarantee that this will happen. City
assumes that the Contractor shall be utilizing any inadvertent downtime to be working on restoration work if there
are locations that still require restoration work to be completed or that preparatory work will be completed at the
next scheduled location.
The Contractor acknowledges that alterations to the construction sequencing and schedule may be required for
coordination with any third-party utilities. The Contractor shall be responsible for any necessary coordination with
utility companies. Any delay to the contract caused directly or indirectly by third party utilities shall not be cause for
adjustment to the contract sum.
The Contractor shall be responsible for providing updated project labor schedules to the City's Project Manager each
Tuesday by the end of business hours. Schedules shall be completed to the quality and satisfaction of the City.
REPORTING
A status report indicating the work completed the week prior and the work planned for the current week should be
provided to the City's Project Manager or designee before the close of business each Friday. The weekly report shall
include any issues that the Contractor has experienced during the week as well as any work planned that was
not accomplished. City staff will be spot checking locations each week.
CONSTRUCTION INSPECTION
Any work performed without the presence of the City's Project Manager or designee to inspect said construction
shall not be accepted for payment as directed by the City. The Contractor shall notify the City's Project Manager or

designee a minimum of 24 hours in advance of the start of construction or the continuation of construction following
a pause in work. Inspectors will not be available on Saturdays, Sundays, and official City holidays.
The City will provide services as needed for construction observation/inspection between the hours of 7:00 a.m. and
3:30 p.m., Monday through Friday, except for official City holidays.
EXISTING UTILITIES AND DRAINAGE STRUCTURE LOCATIONS
The City does not guarantee the completeness or accuracy of the information shown on any plans regarding gas and
water mains, sewers, inlets, buffalo boxes and power lines, poles or any other existing utilities or drainage structures.
The Contractor shall make its own investigation to verify or determine the existence, nature, and location of all
utilities on the site that may interfere with construction before commencing work. This shall include the televising,
if necessary, of the sanitary service line when boring operations may impact it. No additional compensation for the
cost of this work shall be provided. The Contractor shall report to the City's Project Manager or designee any
omissions or differences in location from that shown on any project plans. Care should be taken while working near
these utilities to prevent damage. Any damage to existing utilities due to construction operations shall be the sole
responsibility of the Contractor to resolve at no cost to the City.
MAINTENANCE OF DRIVEWAYS
The Contractor shall provide vehicular access to residential or commercial/industrial driveways that shall be
maintained to the property line except, when necessary, construction precludes such access for reasonable periods
of time. If backfill has been completed to the extent that safe access may be provided, and the street is open to local
traffic, the Contractor shall immediately clear the street and driveways and provide and maintain access. Any
aggregate or steel plating used to maintain access to driveways shall be considered incidental to the various bid
items.
OBSTRUCTION OF STREETS AND RIGHTS-OF-WAY
All work in the public right of way shall be done in accordance with the City of Wheaton Code of Ordinances. The
work described in this specification shall be done with the least inconvenience. The amount of time that normal
operations are interrupted must be kept to an absolute minimum and shall be coordinated with the City's Project
Manager or designee.
The Contractor shall arrange to keep sidewalks open for traffic when possible, and to block portions of the streets
only when deemed necessary to protect private property. The Contractor shall erect appropriate warning signs and
furnish adequate barricades that identify the work zone for the motoring public and pedestrians. No off-street parking
for equipment shall be provided for by the City on any of the City's public properties except as may be designated by
the City's Project Manager or designee.
It shall be the Contractor's responsibility to see that material is delivered within or adjacent to the area of installation
repair as specified by the City. The Contractor shall remove all surplus materials and debris from the streets as the
work progresses so that the public may have the use of the streets a maximum amount of time.
PERMITS AND NOTICES
The City will issue permits for work on City property or private property located within the City of Wheaton. When
applicable, the Contractor is responsible for procuring permits from the Illinois Department of Transportation when
working within the State Right of Way. City permit fees are waived for City projects. Should the work to replace a lead

line require a permit from DuPage County the Contractor shall be responsible for all fees associated with the permit
and plumbing inspection associated with the permit.
DUE DATE FOR WRITTEN QUESTIONS
All questions, either administrative or technical, shall be submitted via email to Tony Sperkowski at
asperkowski@wheaton.il.us no later than July 28, 2025 at 11:00 am (CST).
ADDENDA
All questions, clarifications or revisions regarding this bid will be issued via a written addendum and published on the
City's website and DemandStar.com. Each Contractor shall acknowledge receipt of any addenda on the
Acknowledgment of Receipt of Addenda form. Each Contractor, by acknowledging receipt of any addenda, is
responsible for the content of the addenda and any changes to the bid. Failure to acknowledge issued addenda may
cause the bid submittal to be rejected.
BID SUBMITTAL
Submittals shall be received no later than August 4, 2026, at 11:00 am (CST). Late submissions will not be accepted.
An original Bid Bond shall be included with each bid submittal. Copies will not be accepted.

All costs incurred by the Contractor for bid preparation and participation in this competitive procurement will be the
sole responsibility of the Contractor The City will not reimburse any Contractor for such costs.
CITY'S CONSTRUCTION SERVICES AGREEMENT (EXHIBIT B)
The attached 'Draft' Construction Services Agreement is the City's standard agreement which specifically outlines the
contractual liabilities and shall be used for this project. In submitting a
bid, the Contractor agrees to enter into an agreement with the City utilizing the City's standard Construction Services
Agreement.

BONDS
Bid Bond: A Bid Bond/Bid Deposit of 10% of the full contract price is required with your bid submittal.

Payment Bond: The successful Bidder shall provide an original Payment Bond equal to one hundred percent

(100%) of the full amount of the award.
Performance Bond: The successful Bidder shall provide an original Performance Bond equal to one hundred

percent (100%) of the full amount of the award.
The cost of said bonds shall be included in the total bid amount.
WARRANTY PERIOD
The Contractor warrants that all materials furnished under this contract shall be new and of the
most suitable grade for the purpose intended and that all work shall be of good quality, free
from faults and defects and in conformance with the contract Documents. A one (1) year warranty shall be provided
by the Contractor effective one year from its completion and acceptance by the City.
INSURANCE (EXHIBIT C)
The Contractor must carry and maintain adequate insurance consistent with the requirements listed in Exhibit C-
Insurance Requirements. Provide a current Certificate of Insurance with bid as proof of insurance.
INVOICES
All invoices shall reflect the following applicable information: Agreement number, name of the Project, name of the
Contractor, and the services/deliverables with the price depicted in the same format as the offer.
WAIVERS OF LIEN
* The first Application for Payment shall be accompanied by the General Contractor's partial waiver of lien,
called Waiver of Lien to Date, for the full amount of payment due.
* Each subsequent Application for Payment shall be accompanied by the General Contractor's Waiver of Lien
to Date, plus the partial waivers of lien of Labor, Subcontractors and Material Suppliers who were included in
the immediately preceding Application for Payment to the extent of that payment.
* The final Application for Payment shall be accompanied by the Final Waiver of Lien for the full amount of the
Agreement from the General Contractor, Labor, Subcontractors, and Material Suppliers, including those who
have not previously furnished such final waivers.
PROJECT CLOSE OUT
* Verification of quality and completion of service.
* Completion of Punch List and all areas of non-compliance or incomplete tasks.
* Review of Liquidated Damages.
* Review Retainage.
* Final Payment: Prior to authorization of Final Payment, the following documents shall be submitted:

1. Scope of Work
The Contractor shall complete all Work as specified or indicated in the Contract Documents. The work
consists of replacing approximately 50 lead water services, between the existing water main and
the B-box in the parkway. Work also includes surface restoration items such as sidewalk, driveways,
roadway patching and sodding. The average length of service, from the water main to B-box, is
estimated to be 10 ft. for Near Side services and 45 ft. for Far Side services.
2. Standard Specifications
The applicable portions of the following specifications, henceforth referred to as standard
specifications, shall serve as General Specification for the referenced project unless
otherwise modified by these contract documents:
1. The Illinois Department of Transportation (IDOT) Standard Specifications for Road
and Bridge Construction, latest edition, hereinafter referred to as the Standard
Specifications.
2. The IDOT Supplemental Specifications and Recurring Special Provisions, latest
edition.
Additionally, all work shall also be in accordance with the following Specifications,
Manuals and Codes:
* The Standard Specifications for the City of Wheaton, latest edition.
* The Illinois Society of Professional Engineers (ISPE) Standard Specifications for
Water and Sewer Main Construction in Illinois, latest edition.
* The Federal Highway Administration (FHWA) Manual on Uniform Traffic
Control Devices for Streets and Highways, latest edition.
In the event of conflict between these Special Provisions and the above listed
Specifications, Manuals and Codes, the Special Provisions shall take precedence and shall
govern.
Any work specified herein for which there is no bid item in the schedule of prices of the
proposal shall not be paid for separately, but shall be considered incidental to a logical
bid item.
