Description of Benefits

IAW FAR 7.107-2(b), the Contracting Officer has determined that the consolidation of this requirement is necessary and justified if the benefits of the acquisition would substantially exceed the benefits that would be derived from each of the alternative contracting approaches, including benefits that are quantifiable in dollar amounts as well as other specifically identified benefits.



This acquisition involves the consolidation of awards 75N91023P00709 ARIA/Eclipse/InSightive), 75N91024P00494 (RGSC), and 75N91024P00581 (TrueBeam platforms). (The VDCs are new and currently not under maintenance agreements). In accordance with FAR 7.107-2, a written determination that the consolidation is necessary and justified has been composed to include all required information required under FAR Subsection 7.107-2. The requirements subject to the proposed consolidation are not currently provided by small businesses. As such, there is not a consolidation of separate smaller contracts performed by one or more small business concerns affected by the consolidation. The consolidation of the three (3) purchase orders will greatly reduce the Government’s administrative burden associated with the award and administration of multiple awards for maintenance of one system. By virtue of a reduction in administrative burden the Government can more effectively utilize personnel to achieve other agency missions. Consolidation would facilitate quality improvements which would result in a higher level of patient care and patient safety. Additionally, performance under one (1) award will greatly reduce risk associated with scope gaps in between system components, as well as mitigate potential conflicts of interest for services that affect multiple components of the system. Allow for more transparency and consistency in communication between the National Cancer Institute (NCI), Center for Cancer Research (CCR), Radiation Oncology Branch (ROB) and the Contractor to address system issues, as well as allowing for better coordination and monitoring of performance issues, monitoring of system cost, as well as addressing issues pertaining to systems interoperability. The above description of work is for the purpose of general information about the consolidation efforts only and is not intended to encompass the entire scope of work.



THIS IS A CONSOLIDATION NOTICE. THIS IS NOT A SOLICITATION. The NCI OA posted a Sources Sought Notice # HHS-NIH-NCI-SS-CSSB-0006 to SAM.gov on 12/04/24 through 12/11/24. The NCI OA posted a Pre-solicitation Notice of Intent to Sole Source #75N91025Q00006 to SAM.gov on 01/17/25 through 01/27/2025. Justification and Approval for Other than Full and Open Competition was signed by the NIH Head of the Contracting Activity and Competition Advocate on 7/11/2025. The consolidation Determination and Findings was signed by the NIH Acting Deputy Assistant Secretary for Acquisition (DAS)/Senior Procurement Executive (SPE) on 7/30/2025 This acquisition will be processed under FAR Part 12 – Acquisition for Commercial Items and will be made pursuant to the authority in FAR Part 13.501(a) and is exempt from the requirements of FAR Part 6. The North American Industry Classification System code is 811210 (Electronic and Precision Equipment Repair and Maintenance) and the business size standard is $34 Million. This notice does not commit the Government to award a contract.
