General Notice

City of Le Mars (Owner) is requesting Bids for the construction of the following Project:

Le Mars Water System Improvements 2023

Membrane Water Treatment Plant

MEC Project No.: 210896-000

Bids for the construction of the Project will be received at the Office of the City Clerk located at Le Mars City Hall, 40 Central Avenue S, Le Mars IA 51031, until Thursday, November 21, 2024 at 1 PM local time. At that time the Bids received will be publicly opened and read.

The Project includes the following Work:

1. New Membrane Treatment Plant
   1. Construction of a 12,000 SF precast concrete building with precast concrete and steel joist roof.
   2. Installation of insulated membrane roofing system.
   3. Installation of Membrane treatment equipment, ancillary process piping, valves, and other appurtenances.
   4. Plumbing, Electrical, HVAC, Standby Power and SCADA equipment installation.
   5. Finished operations area containing locker room, bathroom, offices, and control room.
   6. All other work shown on Drawings or called for in the specifications.
2. New Caustic Building Addition
   1. Construction of addition to existing water treatment plant consisting of cast in place and precast concrete construction.
   2. Installation of process piping, chemical storage, and feed equipment.
   3. Plumbing, Electrical, and HVAC.
   4. All other work shown on Drawings and called for in the specifications.

1. Existing High Service Pump Station Renovations
   1. Demolition of two existing high service pumps.
   2. Installation of two new high service pumps and ancillary process piping.
   3. Removal of existing pump drives and replacement with new variable frequency drives.
   4. All other work shown on Drawings or called for in Specifications
2. Water Treatment Plant Site Improvements
   1. Site erosion control and management, including SWPPP preparation and management throughout project.
   2. Removal and relocation of existing utilities.
   3. Expansion of existing backwash basin.
   4. Site grading, piping, paving, seeding, and other required landscaping.
   5. All other work shown on Drawings or called for in Specifications.

The Owner will meet in the Council Chambers at City Hall, 40 Central Avenue S, in said City, on Tuesday, October 15 , at 12:00 p.m ., at which time and place a hearing will be held on the proposed plans and specifications, form of contract and estimate of cost for the Project. Any interested party may appear to be heard.

Sealed bids will be opened and tabulated at 1:00 p.m ., on November 21, 2024 in the Council Chambers at City Hall, 40 Central Avenue S, Le Mars, Iowa. The bids will be considered by the City of Le Mars during their meeting beginning at 12:00 p.m. on December 3, 2024 in the Council Chambers at City Hall.

All bids must be filed in the office of the City Clerk before the time herein set, on forms furnished by the Owner, and must be enclosed in a separate sealed envelope and plainly identified. Each bid shall be accompanied by bid security as defined in Iowa Code Section 26.8, and in the amount of 5% of the total amount of the bid, as specified in the Bidding Documents, as security that if awarded a contract, the bidder will enter into a contract at the prices bid and furnish the required performance and payment bonds and Certificate of Insurance.

Each successful Bidder will be required to furnish Performance and Payment Bonds acceptable to the Owner on forms provided in the specifications in amounts equal to one hundred percent (100%) of the contract price.

Work on the improvement shall commence within 30 days after the Effective Date of the Contract, or on the day indicated in the Notice to Proceed.  The Notice to Proceed will be issued upon approval of the contract and bonds by the City of Le Mars. The work shall be substantially completed on or before December 31, 2026 , and ready for final payment in accordance with Paragraph 15.06 of the General Conditions on or before June 15, 2027.  Failure to meet either the Substantial Completion dates or Final Completion date will result in liquidated damages of $2,000.00 per calendar day.

To the extent allowed by Federal law and regulation, and to the extent required by Iowa law, a resident bidder shall be allowed a preference as against a nonresident bidder from a state or foreign country if that state or foreign country gives or requires any preference to bidders from that state or foreign country, including but not limited to any preference to bidders, the imposition of any type of labor force preference or any other form of preferential treatment to bidders or laborers from that state or foreign country. The preference allowed shall be equal to the preference given or required by the state or foreign country in which the nonresident bidder is a resident. In the instance of a resident labor force preference, a nonresident bidder shall apply the same resident labor force preference to a public improvement in this state as would be required in the construction of a public improvement by the state or foreign country in which the nonresident bidder is a resident.  Failure to submit a fully completed Bidder Status Form with the Proposal may result in the Proposal being deemed nonresponsive and rejected.

The Owner hereby reserves the right to reject any or all bids, to waive informalities and irregularities, and to enter into such contract or contracts as it shall deem to be in the best interest of the Utility.

By virtue of statutory authority, a preference will be given to products and provisions grown and coal produced within the state of Iowa.

Bidding Documents may be downloaded from the designated website. Prospective Bidders are urged to register with the designated website as a plan holder, even if Bidding Documents are obtained from a plan room or source other than the designated website in either electronic or paper format. The designated website will be updated periodically with addenda, lists of registered plan holders, reports, and other information relevant to submitting a Bid for the Project. All official notifications, addenda, and other Bidding Documents will be offered only through the designated website. Neither Owner nor Engineer will be responsible for Bidding Documents, including addenda, if any, obtained from sources other than the designated website.

Prospective Bidders may obtain or examine the Bidding Documents at the Issuing Office on Monday through Friday between the hours of 8am-4:30pm and may obtain copies of the Bidding Documents from the Issuing Office as described below. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including addenda, if any, obtained from sources other than the Issuing Office.

Printed copies of the Bidding Documents may be obtained from the Issuing Office by paying a deposit of $150 for each set. Bidders who return full sets of the Bidding Documents in good condition within 10 days after receipt of Bids will receive a full refund. Non-Bidders, and Bidders who obtain more than one set of the Bidding Documents, will receive a refund of the deposited amount for documents returned in good condition within the time limit indicated above. Make deposit checks for Bidding Documents payable to McClure Engineering.

Pre-bid Conference

A pre-bid conference for the Project will be held on Tuesday, November 12 at 1 PM atLe Mars City Hall, 40 Central Avenue S, Le Mars, Iowa, 51031. Attendance at the pre-bid conference is encouraged but not required.
