Notice of Sole Source Award

This is a notification of an award of a sole source procurement under NAICS code 513210: Software Publishers: This industry comprises establishments primarily engaged in computer software publishing or publishing and reproduction. Establishments in this industry carry out operations necessary for producing and distributing computer software, such as designing, providing documentation, assisting in installation, and providing support services to software purchasers. These establishments may design, develop, and publish, or publish only. These establishments may publish and distribute software remotely through subscriptions and downloads. This will be awarded to Data Innovations for service and support of Instrument Manager Maintenance and Support for the Phoenix Indian Medical Center (PIMC) in Phoenix and Hopi Health Care Center (HHCC) in Polacca, Arizona.

This will be for Indian Health Services at the PIMC and HHCC for four (4) month period for 1 September 2025 thru 31 December 2025 under the authority of FAR 8.405-6(a)(1)(i)(B), Only one responsible source and no other supplies or services will satisfy agency requirements. Data Innovations is the manufacturer and sole provider of technical maintenance and support services for DI Products to the Indian Health Service (IHS) for use at IHS sites nationwide. Direct end-users of the software receive support, maintenance and upgrade services. Data Innovations owns all intellectual property rights in the DI Products and does not support third-party technical services. These services provide patient support and services at both locations for treatment and care for laboratory testing.

If you can provide the services requested, all responsible sources may submit a capability statement, which shall be considered by the Agency and may be e-mailed to Michele.Lodge@ihs.gov referencing notice number PHX-SS-25-017 by 10AM (EST), 24 September 2025. A determination by the Government not to compete this proposed contract acquisition based upon responses to the notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. This notice does not obligate the Government to award a contract or otherwise pay for information provided in response. The Government reserves the right to use information provided by respondents for any purpose deemed necessary and legally appropriate. Any organization responding to this notice should ensure that its response is complete and sufficiently detailed. Information provided will be used to assess tradeoffs and alternatives available for the potential requirement and may lead to the development of a solicitation. Respondents are advised that the Government is under no obligation to acknowledge receipt of the information received or provide feedback to respondents with respect to any information submitted.

Any solicitation resulting from the analysis of information obtained will be announced to the public in Federal Business Opportunities in accordance with the FAR Part 5. However, responses to this notice will not be considered adequate responses to a solicitation. No proprietary, classified, confidential, or sensitive information should be included in your response. The Government reserves the right to use any non-proprietary technical information in any resultant solicitation(s).
